Hi Unfortunately i am unable to get on the show (personal reasons) however i do know for a fact that they are willing to investigate this as a friend of mine was put forward for it and they were chomping at the bit!! So go get them interested. Another point i wanted to raise is everyone needs to email their MP and ell them what is going on in your own constituency. Each MP i have spoken to is interested in getting behind us. Please please email your M today / tomorrow and get the recognition we need.

Kat, first thing monday you need to contact bank. they have full right to take money from your personal account and pay off joint account, however they cannot take money that is not there so contact tax helpline monday and change over bank details so you have your credits paid inot another account. Contact DWP and explain the position, even of you are working you can ask to aply for a crisis loan to cover the childcare fee's [mrsfoot] 2:14 pm: crisis loan can be sorted within a day
  3. Yes. He came across as tim nice but dim but totally different once in there! When we got out of the court he walked to the car with us, he drove a fiat uno lmao!
  4. Yes on both counts! Whr is the court case being held? Is it still Liverpool? Ill be very interested on what Mark White and Matthew Paybe have to say on the day, although Payne did not attend my allocation hearing it was a barrister
  5. how are you doing, have you everything you need? have you got someone going with you? we will be hear wating with baited breath as its not too long till im in court with them , be very interested to hear who they send for their side. they guy they sent for the allocation hearing for our case was nice enough but first impressions was that he was bit slow but he was quite harsh once in the room with DJ!
  6. Im my opinion your thoughts are correct Barry, if no costs were mentioned at the original small claims track then no costs should be transferred over to the fast track. I am getting quite nervous for you now, am i right in thinking your full case is being heard Monday or is it just the costing part of it? good luck although i dont think you will nbeed it as whats law is law!!
  7. There is a claim where it is at allocation stage. The member has requested small claims and GMAC has requested multi track. The amount in question is under £3.5K but looking at the criteria the DJ has to adhere to when allocating it looks like it may got GMACs way, however the member is asking for GMAC not to be allowed costs (if it goes multi) as this will put the case on an uneven footing which is a direct discrimination in a supposedly fair trial!

  9. Ok quick update Have sent letter to court asking for further directions for the defendant with regards to Part 18. I need specific info, and im determined to get it off them. I wont back down so if your reading this watch out!!!!!
  10. Alan what a great outome You obviously showed you had a good case to answer and the judge seemed fair from what was said. Bit of a sting re costs, but then with each case there are allergic reactions i suppose! An outline of your argument might be a good idea for the board as will any links you have to any of the cases, although this is really me just being lazy so you are welcome to ignopre that lol Well done, you have shown you are willing to fight for whats yours, mrsfoot

  12. Hello and welcome to the Consumer Action Group! There are a few things that you must do before sending letters off left right and centre. By following the steps correctly you save yourself and others a lot of work! Read the FAQs. Print them out and take 2 -3 days to understand what it is you are about to do…..you wouldn’t just jump into a lake for a swim unless you knew how to swim, would you?? Understand the process. Don’t try to start halfway through, it won’t work. Its time consuming but at least you won’t be making any mistakes in getting your money back! Read through the relevant forum for your bank claim. Here you will find others journeys, celebrations and queries, most of which will help you in your claim. Start a thread in your forum, and keep it in your favourites so you can find it easier. Call it your name v bank name for example. Here you can log your own journey, ask questions and most of all offer another thread for a newer person to read (see you are giving something back already) It’s your claim; you have to do the work! Its not easy, can be very frustrating and at times you will feel like throwing the towel and letting them get away. But keep on going, seek advice from mods / site helpers/ or anyone else who is on the forum, great place for this is the chat room, try it out! And yes you do need to include a list but go over the above points first Good luck

As long as they are actual bank charges and not pre set business banking charges i am of the understanding they can be claimed Good luck

  15. Just a few points of suggestion! Lets not get carried away with the "fight or die" attitude. We all need our feet firmly placed on the ground before we can walk! Morgy must make an informed decision on her next step. While its heartwarming for us all to be behind her (and we certainly are every step of the way) we need to give her space to breathe. Once Morgy has made her decision then we help guide whatever it takes to support her. I suggest if any1 is in unions (yes i know they can be awful) but if you are a member you are entitled to legal advice, so go get some! Get your colleagues to back you, approach you full time official and get them to bring it up at meetings, let them get involved. I am fortunate (or unfortunate as some may say) to have hubby who is union official. He is talking to his colleagues to see who is affected by bank / mortgage charges and taking it to the next area meeting for the unions support on this. He will be getting a push in the right direction (was going to say something else but would only be edited lol) to get this off the ground over the next week. So lets just remain calm, you see a lot more when the glasses are not steamed with frutration! Mrsfoot xx
  16. Hi Morgy Well i have spent the last hour or so reading yout thread, sometimes with a smile, more often with tears streaming. I can only begin to understand how you must feel, however take heart with what they clerk said. I have a friend who is a clerk in court and he sees so many ppl defending themselves agianst sharks. This was not your day, your day will some. I have to say i would hang fire a few days, let your head re orient and your heart slow before doing anything. The Judge was telling you to appeal, in writing so its official so he can give you a nudge in the right direction. Most d.j's are reasonable and will help the smaller person in a claim (whethr defendant or claimant) Just a few points to consider: 1. Do you belong to union? If so you get legal advice so give them a go. My hubby is in talks with his union rep with regards to them doing something for ppl who claim, as most of his workmates and most ppl in union have been affected so its about time they helped out!! 2. Ask for a breakdown of the costs, they will have to show each call etc and it may just reduce it down. 3. Keep smiling, you have given hope to a lot of ppl on here, we all back you, and im sure if push came t shove someon from here would be happy to go with you to the next hearing as a friend (they cant speak but will be a hand to hold)

  19. Hi Zoot, here is the link for my case. Summary: Trial date for March 16th. Fast track. Have received defence. Have swapped witness statements but nothing on court directions about inspection. Have received their bundle. I dont have to send mine according to directions.   20. Thank you both for your responses. I have requested a CPR part 18, which they objected to on the ground that i would receive the information via their witness statement which was not inc. I asked for a full breakdown and certified evidence of all expenditure. They sent the above info in the W/S. I was thinking maybe to approach court to ask defence to be struck out on the grounds that they will not provide info even after sending CPR 18? Should i send a further CPR 18 to them (even though i was very specific in first?) Should i ask the Judge to order part 18? What do you think? what are your suggestions now? Really appreciate all you are doing
  21. Ok Jason you really need to re read the FAQs (see the linnk below) The necxt stage for you is to file your claim at court. You can do this one of 2 ways. I repfer N1 way as it gives you more space. I can send you an N1 via email fi you would sooner print it out rather than hand write it. As you file with the court (either way u choose) you will have to pay a fee, this depends on how much you are claiming. Once you have filed you wil recieve nnotice that your claim has been issued and that abbey should of received the papers. That gives them 14 days to respond.
