  1. I'm in similar boat with unpaid uk bank loan. Got recent letter from allied co. Saying they will transfer the debt to representatives in oz. They r also phoning a lot. Does anyone know how they obtain a silent number, weird as I changed it recently? Have read al posts on other forum, would I be right to not do anything until/if I hear from a dca over in oz?
  2. Hi I've now been contacted by N"ML which appear to be an international DCA. They phoned my house looking for me and were told I wasn't there and the phone was put down. They mentioned a previous address that I occupied here in Australia over 2 years ago so looks like they're trying to trace me. Can this agency list any debt concerns which can effect my credit rating in Australia? I'm freaking as I applied for a homeloan the other day Any advice regarding this would be great. Anyone else heard from N"ML?
  3. Hi there Hoping for some help. I've been living in oz for nearly 3 years and stopped paying a rbs loan 18 months ago. I've had a phonecall out of the blue the other day from debt collection asking me what my proposal was. I said i was unaware what they were talking about and the person said they would send me out information. What will i do? grateful for any assistance here
  4. If I try to claim through a summary cause claim, have you any idea of the timescales as I'm supposed to be emigrating to Australia early new year. Do you know if I could submit the claim and head over to oz leaving someone else to represent me at court if neccessary? If claiming via the summary cause route, is the interest added within the £1500?
  5. Hi Gargoil Can you help with some advice? Have read through this thread but still unsure about small claims proceedures. RBOS owe me £1550 in charges which would amount to around £200 interest. If I do 2 separate small claims, is it possible to submit both at the same time. Can yu also tell me if the interest is added within the £750 limit or would I need 3 claims for what they owe me. I would claim through summary cause, but I've read this takes longer and I was hoping to emigrate to Australia in jan / feb (but I want my money) Cheers
  6. Can anyone help here, I have charges amounting to £1559.14 from RBOS with another £200 in interest at the 8%. When doing small claims is the 8% interest included within the £750 limit?
  7. Just has a daft thought, but if I am in oz will the bank be responsible for my expenses to travel back for court?
  8. Hi Cheers for the info, but I'm now wishing I took RBOS's offer. I'm emigrating to Australia end of Jan and with the timescales for Summay cause claims, it's a nitemare. Spoke with Tommy McLean again to day and felt he was trying to fob me off. He previously told me on 20th December that I would be likelly to recieve a letter offering full amount the following day, now he's saying the the way in whish the bank are dealing with claims is changing from day to day. He suggested I either wait until they respond or take the legal route. To top all this off, I've been charged £152 over xmas
  9. Hi Can anyone advise me of the court process in Scotland. i think i need to pursue BOS through court, however they owe me £1200. Should I be taking out a summary cause cliam?
  10. Hi Can you help? Where will I find mcol? Need to start this process with BOS Amanda
  11. My LBA deadline is up today, been up since 6am but don't know if it's just that normal friday feeling or the anxiety over what the posty may bring this morning. I'll probably be soing the court money claim over the weekend
  12. Hi RBOS offered me £1350 on the date deadline for my prelim letter. Of course I've only accepted this as part payment Deadline for LBA is up on Friday, so here's hoping they come up with the rest. Good luck
  13. Hi I've just been offered £1350 today from Mr McLean, declining the offer as they owe me another 650. All this seems too easy to be true
  14. I thought the same about the interest, but I don't think it matters much as if they settle out of court, you will only get the actual amount in charges, not any interest; you've just saved yourself some time later if you have to go to court. I sent my DPA letter on 7th Nov and was offered £1350 today from Tommy McLean, they owe me another 650 so I'm rejecting the offer. Seems strange they have offered me money but not you. As far as i'm aware, you don't ammend the date of service, it remains the same as when you first contacted them
  15. Well RBOS have responded to me today offering £1343 although they owe me £1995. Thought it was ok for 1st offer, but rejection letter getting posted today saying I'll accept their offer as part settlement. Can't believe how easy this process is (sitting at the pc writing letters and generating huge cash sums) just hope I don't have to go to the hassle of court with any of them. Still waiting for data from Capital 1, BOS, Egg and MBNA
  16. Can anyone help me? Where do you find the court cliam forms?
  17. Hi They done the same with me and made reference to a delayed reponse in for the data info due to the need for ID. I've heard Egg are buggers to claim from, but hopefully we will all have some luck
  18. Hi there I'm way behind you all. Sent data letter asking for info on my account 7/11, but had no response yet. What stage did you recieve the 'goodwill' gesture? Amanda
  19. I'm not sure they can do that, athough I know it happens with bank accounts. I sent off a data request letter to MBNA 2 weeks ago but no response as yet
  20. Hi, I've just started the process against all of the above, rekon it will amount to around £5k in total. Would be interested to hear how anyone else is getting on with these financial vultures:x RBOS were quick at sending the statement out, prelim letter away to them. Egg demanded additional ID, so still waiting on info. BoS have acknowledged the request for data although I've not recieved anything yet. MBNA, Capital 1 and RBOS credit card haven't responded. Initial data request letters went out 7/11 Amanda
  21. I've just sent my 1st standard letter of to the rbs looing for info on bank charges. They leave everything to the last kick
