OK, having given this a bit of thought, what do we all think of something like this :- Your Name Address Ref No Cap1 The address the settlement letter came from Court address Parveyb v Cap1 Case No To (if you have a name from the settlement letter) or Dear Sirs As you are now aware, at the recent allocation hearing, Judge (insert name) instructed you to try and reach a settlement of this case within 28 days. In order not to waste any further court time I am prepared to offer the following :- The return of the charges to me you have already offered in your letter of the (insert date) The removal of the Default notice you have entered on my credit files. Not just marked as satisfied. If you are prepared to do this, I am prepared to withdraw my case and inform the court I have done so. If you are not prepared to accept this generous offer of settlement, I will continue to pursue this case in court. I reserve the right to present this letter at court and ask the court to consider awarding the compound interest rate you have charged me and also wasted costs. As I am away on Holiday from xx/xx until xx/xx I require your agreement by the xx/xx. I enclose I copy of your offer letter. Yours sincerely Parveyb

  4. Hi Parveyb, First, I think you did great today. It's not easy to take your first setps up the court steps !! You know where I stand on this, I'm alongside Car. I am thinking a letter to remind Cap1 the Judge has given THEM 28 days to settle this claim. I'll work on a draft for you. Lex
  5. Hi Andy and a big welcome to the Consumer Action Group ! , Silverfox is right, you need to send an Account in Dispute letter. Our templates are being rewriten at the moment and all the links may not work !! So here we go ;- A letter used when a debt collection agency contacts you about an unknown debt. Red script is editable Name/Address: Date: Dear Sir/Madam You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves. I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name). I am/we are familiar with the CPUTR 2008 and the Office of Fair Trading's Guidance on debt collection, which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question. I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. AND in not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods. Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment. I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question. I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to Trading Standards and also inform the Office Of Fair Trading of your actions. I/we look forward to your reply.   7. Hi Parveyb. I'm sorry to have dropped off the radar but have explained in my PM. As The Shadow has said this should only be about what track the case will proceed on. I have doubts that Cap1 will even attend, if they do, it will be a first, but you never know. You want this Small Claims only. So, do attend, take your court bundles, do not give them to Cap1 unless the Judge insists. IF Cap1 turn up and try to turn this to a hearing, respectfully bring the Judges attention to the fact that it is supposed to be an allocation Hearing and nothing more. Explain you are at a disadvantage and have not preped for the main avent. I know it's late, but have you a list of cases Cap1 have already paid up on??   9. I agree Do you have anything in writing ?, i.e. any emails, letters etc, or is this just word of mouth. Will your friends back you up in court if it comes to that ? which I expect it will. How was the property advertised, do you have a copy you could show us ? Also, if you have been there three months, have you ever signed a lease agreement ?? This really is a bit of a minefield but don't be intimidated into moving out, it sounds like you have kept your end of the agreement. Lex

  12. I have started this thread on behalf of a well respected Cagger. The details are below. If you have visited, stayed at or a resident of BALMORAL GARDENS Bexley Kent, and received one of their 'invoices' please post the details of what happened etc, did you pay it , contest it or just ignore it. We are interested in finding cases of where you have had Letters claiming you owe us blah blah etc from PARKFORCE. If you live there or visit, information that you need to know. 1) PARKFORCE do not issue the TICKET they come from on the estate, but there is a cover-up of who is plastering the cars. 2) PARKFORCE only act as a DEBT recovery agent for the mystery person putting the tickets on the cars. 3) The tickets and signs are bought from PARKFORCE as a package; once again our mystery person did this and gets the new tickets. 4) My interest was in the past we were visiting family there and went in 2 separate cars, only one of the cars got a ticket, and my sister tried to appeal it, but instead, received demands increasing every time. I need to find out more about just who is the mystery person behind these self ticketing scams, before we take legal action against the [EDIT], no one on the estate will answer questions, other than we have yellow lines and you get fined if you park there ( remember this is private property ) To protect my sister and her identity I have asked the mods/site team to post it. As I already know how the whole thing works, what we are after by contacting anyone else that has been scammed or may be in the future, most of all just who the mystery person is because he is the one causing grief to many innocent people.   14. I'm sure Erika can suggest a timetable, but it will veary from area to area. When you ring them, all you are doing is telling them there's a problem. Thats good for your case, they havn't found you out !! Please ring them and start to free yourself from the worry, their only people after all. Regards, Lex

You will not have to say how much you think you have overclaimed now, that will come later, the most important thing now is to keep within the time limits.
