Hi Roger, I received a call on Friday from Abbey's legal dept regarding my hardship, they are putting 65% of my claim into my account next week. http://www.consumeractiongroup.co.uk/forum/abbey-bank/65003-ds-abbey-bank.html This is not going to prediduce my rights to the balance after the test case.   3. Hi Christian I have just received an offer on my hardship 65% of my claim. My thread is http://www.consumeractiongroup.co.uk/forum/abbey-bank/65003-ds-abbey-bank.html Basically, complete an income and expenditure sheet, evidences of your hardship ie, mortgage/rent arrears, council tax arrears, etc....plus any other debts that you are court evidences to the same, revised schedule of your claim with interest to date, a letter precisely showing why you consider yourself coming under the hardship rules. Please let me know if you already have a claim stayed in court - if you have I will give you the details where to write. You will also then have to quote your court reference as well. Tuttsi xx

    ABBEY BANK

    Hiya everyone I have recently made a claim under the new hardship rules to Abbey, having packaged it up well, it was fully documented with Income and expediture report, proof of any pending court stuff and arrears on mortgage statement an uptodate spreadie, letter fully explaining why I found myself in hardship. I was contacted on Friday they have agreed to a partial settlement on account for 65% of my claim, this will not predudice my claim for the future and should the OFT win they will then pay out the balance owing. Anyone who is suffering hardship should follow this easy process. xx
  5. I had my application to lift my stay last week - what an ordeal I was up againt the Abbey barrister for a 45 minute hearing which then lasted 1.5 hours - it was very draining. I tried to put up a good fight, but at the end of the day it was the old boys act. So now the only hope is the judgement goes in our favour. Justice Smith, seemed a decent enough during the test case as I went on a couple of occasions as I work on a Friday a few blocks away. Speak to you soon, Dxx

  11. Hubby sent in his 2nd business claim to HSBC to reclaim his charges having successfully recovered the first claim. They wrote today and have cancelled his accounts due to the fact that he dared to make another claim. Has anyone else experienced this and what action can be taken. DS
  12. I went on Friday to the last couple of hours of this case and it sat a few seats away from the BBC and Which reporters. It is interesting how each of the banks T&C's are not in PIL and yet the Barister for Nationwide told the Judge that his client's T & Cs were in PIL and different to the rest. After Mr doctors for the OFT had finished, it seems they are really no different. If as the Judge says that his judgement will translate to historical T&C's then I believe that he has seen through the banks changing their T&C's to cover up. I myself am keeing my fingers crossed in hope that all the claims will soon be paid.

    clippy v abbey

    Hi Clippy, yes we are all in the same boat. My hearing to lift the stay was greeted with at Barnet was that all cases were to be transferred to Central London Courts to be heard at bulk hearings at the request of a Judge. This cases are being stacked up waiting for the outcome of the test case. Now the Test case should have been held at the High Court and was transferred last week to a building in Fleet Street as it appears they had a shortage of courts also this new building has only 11 places for the Public and Press, the Judge then wanted 2 days to read the papers and the case was due to start tomorrow (Wednesday). But guess what, the case he was on the jury are out, so now they are saying it looks like starting on Thursday. So has he had a chance to read the papers. Now it has been decided that only the press will be able to gain access and no public, so it is already turning into a fiasco. DS ps Happy new yearxx
  14. Tom Brennan is on BBC on Monday on the morning show regarding the OFT case. I will be up in the City on Friday, 3 minutes walk away from this venue so I may just pop along during my lunch time to have a snoop about and mingle with the press, and find out what is happening and if I get any snippets I will report back. Are we planning any protest....
  15. It seems that they have also changed the venue to International Dispute Resolution Centre, 70 Fleet Street EC4Y 1EU - and NOT at the High Court. Now I am not an expert, how can this be a TEST CASE if it is not being held in the High Court. Also, the OFT made a statement at the begining of the TEST CASE and said that it would be held in Public not behind closed doors and this latest information is now that between press and public only 11 will be admitted and the same 11 will not neccessarily get the chance or oportunity to be able to see it through every step of the way. At least the BBC or one of the newspapers should be able to have a seat every day to record the progress or not as the case may be. DS

  17. Sorry MTM, the date for the commencement of the hearing is now Wednesday 16th and the hearing has been moved from the High Court, to somewhere in Fleet Street just read this info on another site. Dsxx

    PSM, welcome to the club, the banks really have the courts eating out of their hands, I think it is terribly wrong that the cases bought before the test case have been stayed pending the OFT case. I am sure that the CPR rules have been broken. I think we should all turn up at the high court for test case in our 1000'ssss to make a protest about the way we have been treated. Ds

MTM guessed it straight away.. and Determinator, yes a good idea to meet up maybe just after the test case, either to comiserate or hopefully to celebrate....... and anyone else in the London area would be welcome. I take it you mean my new avitar is funny, it is actually my cat when she was a little kitten, she is now 5 years old. Did MTM catch up with you! All the best DSxx
