  4. Thanks. I found an address for shop direct financial services in bootle, it appears to be the head office. Would this be better or is it no better than the one you have gave. Because of the bankruptcy I think the amount should have been settled, not defaulted so I'm gonna send me quid and send this. Good idea or not? I have no recollection of ever receiving such a notice, and I therefore require you to substantiate this data. You should be aware that I was made bankrupt (now discharged) on 28/2/2001 and Great Universal was made aware of the fact and it was listed as a creditor to the Official receiver. Using my extensive knowledge, I believe that this account should have been marked as satisfied; certainly not default. However, whether I am right or wrong, please follow up the following request. 1. You must supply me with a true copy of the alleged agreement. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit). Your obligation also extends to providing a statement of account. I enclose a £1 postal order to cover the statutory fee. 2. Please also supply me with a signed, true and certified copy of the original default notice. 3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. I would request that this data is provided to me within the next 14 days. If you are unable to provide this data then I require all adverse information to be removed completely, including any defaults that may have been applied. Please note that mere correction or amendment to the entry will not be acceptable.

  6. I sent for a CCA to logic on 13/3 and it's not yet been signed for. As far as I am awrae the address is still "live" as my most recent correspondence (asking to increase my debt payments) came from there. Roll on the 42 days.
  7. Didn't need a sar, had all that I needed. I've requested a refund of charges from cap 1 but fred are collecting payments. Charges will outweigh the outstanding debt. 42 days for CCA is up on 8/4. If nothing comes from fred I'll request everything back that I've paid to them.

  9. Is anything happening? No posts for a while. I'm persuing Freds for a CCA but the request wasn't signed for (I assume anyway as there's no proof of delivery, so I've had to go to the Postal Order transaction section to see if it's been cashed). It drags its heels as well.

  11. I never bothered to pay this month's instalment and usually, Frederickson are sh*t hot but I've not heard anything. Methinks they got my CCA request and most definetely, the dispute letter.

  13. Zooman I could not agree more. The system stinks and if I wasn't a well mannered geordie my language would be well, you can guess. Although it was my wife's bankruptcy we shared the burden like good couples do. I was actually the 2nd largest creditor. Good old Lloyds was the biggest. Knew I'd get the barstewards back somehow! The unfortunate side is that I ended up not being able to pay my credit card bills but I did set up small token payments. They might go away eventually with the help of CCA's. Another thing, I got a credit report yesterday and I've got a CCJ which I knew absolutely nothing about. I now have to investigate this. Could turn out to be a good thread. We've decided that the excuse of a CCA sent from Stevensdrake is not a kosher CCA. I've contacted Stevensdrake again asking to send the real "I am". They are investigating. I have received a copy of my credit report and was horrified to find a CCJ. I can honestly say I know nothing about this and it is certainly there without my knowledge. I have of course, set the ball rolling re investigation. It could only have been SDrake/Amex who put it there (as the court is Brighton) but I made arrangements to pay my debt off at a nominal sum before the case went to court. I am gunning for these twits well and proper now! 12 working day expiry is up to day, roll on the next thirty. SDrake are looking into my claim re; the CCJ. I'm sending an Email everyday but it seems they work at snail pace in Crawley, no offence to all you hard workers out there in Crawley. Even Brighton court haven't bothered to reply' What is it about Sussex?
  14. Having received an improper CCA I Emailed the company concerned on Monday requesting that the "real I am be sent". I've heard nothing so I Emailed again today requesting acknowledgement - nothing. Would it be in my best interests to send the request again by recorded delivery (without the quid po). Can I take it that original the time limits still stand?
  15. Thanks for the post Zooman. I hope I've done this right. At the time of the bankruptcy (2001) we did not have anything left to purchase the wife's share. I have read all the bumf and while I can understand most of it (I was a civil servant for 30 years) there are bits that I am probably mis-reading. Under the new rules I think the OR has until 1/4 to take action on our property and not 3 years following bankruptcy. I may of course be wrong; perhaps you would like to comment, all advice is greatly appreciated. Rightly or wrongly we've got our fingers crossed for 1st April.
  16. I just picked this thread today couldn't stop reading. Good luck with your quest, your lass doesn't want to be made bankrupt, it seems to hang round the neck like a noose. Wor lass was made bankrupt on 28/2/2001 and discharged 28/2/2004 and has now fallen off the the credit file because of the six year rule. However, we seemed to cope better then. Beacuse my eldest son is getting married VERY shortly we tried to raise extra funds; there's no chance. Although we managed to keep our property (the OR could pounce though) there is a Caution shown at the land registry. I tried to borrow £3000 off my mortgage company but because of the caution the second word was off. It seems to me that criminals who come out of jail are treated better than honest citizens who lost all their money because of a business failure. Bankrupts will never really have a "clean sheet". Sorry to go on but I realise that many ex bankrupts end up doing well but personally, I think it is something to avoid. Your lass does not want to go down this road. Again, best of luck but the system is sh*t.
  17. It's my first visit to this thread and I imagine, it won't be my last. As an associate, my wife is listed on my credit file which I have received a copy of today. I am rather horrified to find that there is a default shown in respect to Shop Direct financial services. My wife was made bankrupt in 2/2001 and it has now dropped off her credit record. She had an account with Great Universal, not Shop Direct. can i take it that this is the same company. I have tried to find a web site for Shop D but it is "temp" unavailable. Great Universal were one of the creditors at the time of her bankruptcy and I don't think it should have been marked as defauly; but what do I know? Can any one enlighten me on this situation and perhaps an address for Shop Direct/Great Universal as I'm going to have to write to get this default removed.
  18. Can I hijack this thread please? The topic is not wholly unrelated. Having received a copy of my credit file I was astounded to learn that I have a CCJ against me. It quotes the court name (Brighton) and case number and shows active. I cannot remember receiving a notification regarding this. How do I find out who placed the CCJ. I assume that I have to write to the court (after finding the address) with the case number but if anyone can confirm this it will be appreciated. I do have a debt (which did of course, include penalty charges) with a firm based in Crawley (which is near to Brighton) and it could be this but my instalments were set up voluntarily.

The document will be filed and retained in the event of any litigation and if you would be so kind, please forward the fully executed agreement with ALL the prescribed items as specified by the Consumer Credit Act 1974. I understand that under the Consumer Credit Act, creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act. I am sure that you will be aware that until such time as I do receive the fully executed agreement I am well within my rights to cease further payments. I look forward to hearing from you within the stipulated time limits.

  22. Like ncf, I would like to paste a copy of my supposed CCA for a spot of scrutiny; unfortunately, although copied, I'm having trouble pasting it. I haven't attempted to do this before in this situation. Can someone tell mr thicky what to do please? Cheers.
  23. Re Post 15, should I cease paying instalments to Fredrickson as the account is now in dispute? My CCA stil hasn't been signed for/delivered (it probably has) and I have had to write to the postal order transactions centre for confirmation that the PO has been cashed.
