  1. It's a standard letter, they probably didn't even check your account before sending it to you.
  2. Now I'm losing the will to live! My case was transferred to a Circuit Judge on February 6th, after waiting a few weeks but hearing nothing I phoned the new court. They dug out my file and i was told that the Judge had taken a look at the case but it was now being transferred back to my home Court to be allocated. I waited another week to hear from the local court but nothing, so I phoned them again, and the lady said it was "upstairs with the Judge being allocated a track". I asked(politely) how long this would take and she said about 5 days. I sent my AQ back in December and still don't have a date, this is the third time the claim has now been 'looked at', it's making me wonder if anything is wrong with it! Also, started second claim for £690 ish from Nov06 to Feb 07, they responded late to prelim saying get lost (same letter sent back to me as in first claim). Should I now sent lba for second claim, as I don't want them to pay me that one before the first case has been settled.
  3. Hi, My AQ went back on Dec 20th - I still havent had court date. My case has been passed on to a circuit judge in a town miles away from me. So now I have to wait for him to look at it even though my local court had it for over 6 weeks first. I think it depends how busy they are.
  4. Welcome Aoife. If you go to the templates library there is a list of spreadsheets in there. I believe that there is one that's works out the percentage of interest which is due to the charges. I used Google spreadsheets, but I think the excel one does it all for you. You enter the interest figure as it is on your statement and then it gives your interest figure in a seperate column from your charges. You can't claim the 8% interest straightaway - that is only if you get to the court stages. I may be corrected on that though.

  6. Agree re DD's. I cancelled every one of mine, except Talk Talk who don't accept any other payment method. I pay all of my bills standing order. I have set them all up on internet banking so I can increase or decrease the amounts as I choose.
  7. Literally 5 minutes after phoning the court a letter dropped on my doormat from my local court simply stating 'As the result of an order made on Feb 5th this claim has been transferred.

    Circuit judge

    Hi. I've posted within my own thread on the Abbey forum, but this morning I phoned my local court because I sent my AQ back on Dec 20th but hadn't heard anything. The lady told me that my case has been transferred to a circuit judge in Coventry who has taken an interest in this type of case. I asked her how many others had been sent but she said mine was the only one. Should I be worried (I am anyway!!)

The lady told me that it has been transferred to Coventry to a circuit judge, who has taken an interest in this type of case. I asked her how many others had been sent but she said none, yours is the only one. What is a circuit judge?

  11. Can somebody just confirm this is still 28.7%. I have just printed my spreadsheet after losing access to them for over a fortnight but before I send it is it 28.7% because i am doubting myself, I have in my mind that it's 25.7%. I did search through the boards but couldn't find it. Thanks

My account is open, but it is their overdraft that is outstanding, and also as they are still giving me monthly charges, despite the fact that I haven't used the account since the end of October. I have got a new joint account with my husband, and a single account for myself (any bingo winnings etc lol) so we do not use the abbey account any longer. The first claim is almost double what the overdraft is so hopefully if/when that is eventually settled it will clear the O/D then I will keep the remainder. I will see if I can find a template ater on this afternoon to use in response to this latest letter.
  15. Hi Glenn, I typed the letter out word for word except the hello, thank you blurb at the beginning. The whole thing reads: Dear xxx Thank you for getting in touch with us to request information on your bank account. Unfortunately we are unable to provide any information on your account prior to 2001 as any transactional data before this date has been deleted. Abbey are only legally obliged to provide transactional data for the last 6 years. Anything in excess of this period has been destroyed. Please accept my sincere apologies for any inconvenience this may cause you. I can see that we sent duplicate statements to you on 20th October 2006 however, I have re-ordered the statements from 2001 to the present date in case you haven't received them. As you have already paid the £10 fee, please find enclosed, the cheque that you sent to us. You have also asked for details of any 'manual interventions' that may have been made on your account and I am sorry that we are unable to help with this request. I can explain that we consider 'manual intervention' to mean an action that is not automatic or computer-driven. Not all manual interventions are recorded, for example, if a member of staff looks at a paper document relating to your account, a record is not always required. Similarly some interventions may relate to work carried out by a department rather than individuals where no central record of activity is kept because this is not the kind of information we need, or more importantly, that a customer would usually request. If you have any questions then please call us on the above number. Yours sincerely ...... What I find annoying is that in this letter they state that anything before 2001 has been destroyed, but in the set of statements they sent me last time, off the microfiche, they were dated back to May 2000. In which case anything that has been deleted has been sone so recently.
  16. Hi, this is my third claim with Abbey. I have already claimed Nov 2000 - October 2006, which I am awaiting a court date for. Second claim is at Prelim stage for Nov & Dec 2006 & Jan 2007. A few weeks ago I sent SAR and £10 off to receive transactions on the same account but from 1993 when it was opened - May 2000.   17. Any help guys. I have just tried again, it won't even let me amend any of my old spreadsheets - I keep getiing an error message saying that I'm disconnected but I'm not. I really need to create a new spreadsheet for my second claim.
  18. I phoned the court for an update this morning as I handed my AQ in in the middle of December. I haven't heard back so I thought I'd ask. The case was passed to the Judge on Jan 10th so apparently it may be with him for another few weeks yet!! I didn't realise just getting a date took such a long time. I don't even know how busy their schedule is so my court date when it arrives might not even be til April or May! I have now started my second claim. I have sent the SAR but will do the new spreadsheet as soon as I can get access to the spreadsheets (I've had problems this morning, it wont let me open any new ones).
  19. Hi Lula. Where do you claim this. Do you just enclose a seperate piece of paper within the court bundle, or is it to be asked for when settlement has been offered? I'm only asking as I did stipulate that I would be applying costs when I filed my POC but as I have just spent the last hour and half doing my own court bundle I just wondered where it went. I thought I'd better make a start, and I'm glad I have. My god there's hundreds of pages left to go!
  20. Hi. I always use the Vampiress spreadsheets and I have followed all my claims using these so far. However, today I have tried to save a new version of the advanced compounded contractual interest spreadsheet to amend with my own details but it won't let me rename or create a new version of it to use myself. Does anybody know if there is a problem.
  21. Okay, I will do it that way aswell I think. I am going to send my Prelim off today for Nov-Jan just gone, and see what they say to that. Also, despite sending my SAR and £10 off over 2 weeks ago for 1993-2000, I stupidly forgot to record it - so obviously they 'havent received it' because my cheque hasn't been cashed and I have neard nothing back from them.
  22. Gosh, that's spooky. Our claims are almost identical lol. I still haven't heard from the Court regarding a date or track yet, hope it won't take too much longer, AQ's went back before 27th Dec. Another set of charges are coming out on Jan 15th! At least my 2 new accounts are building up nicely because I haven't incurred any form of charge since opening them, it just goes to show how one or two charges can spiral into thousands of pounds worth of debt. Are you claiming 1993-2000 seperately from the latest few months worth of charges, or will you just claim together with a large gap inbetween the dates?
  23. Agreed Minzai. I am on my first claim but since i started that I have incurred charges in Nov, Dec and Jan despite not using the account at all. I am just waiting to get my first claim sorted out before i begin again with my second claim. I don't mind the wait as it is gaining interest. Also I have sent another SAR for statements dating from 1993 to 2000. I have done some reading on the Limitations act and I am hoping to reclaim earlier years. Would the Judge look badly on me having three claims with the same bank? Would I better applying for 1993-2000 and adding the Nov & Dec 06 months on the end of that same claim?

  25. Excellent. Thanks. I must admit i haven't been to the Citi forum because I am very busy with my own claims against Abbey and Capital One. I'm awaiting an allocation date from Abbey so I'm busy preparing court bundles etc. I have done vast amounts of reading but mainly in my own forums and the templates library. I will continue with his LBA when i see a copy of his letter. My father never rushes himself, that's why he's letting me deal with all of his claims for him (like I've got a choice!) Thanks for your help guys.
