  1. Hi quest I queried something along the same lines and the response I got was a resounding no no. That was one of the replies I got. On TV a week or 2 ago "tonight with trevor mcdonald" The senior county court judge (official title not sure of). He mentioned that almost all county court judges are just as peeved off as we are of the banks tactics. So as you can see writing to the court would really be a waste of time.
  2. Phoned County court today to ask why I haven't heard anything. I was told that claim was issued on wed 28th Feb, does this mean it will be served today (Fri 2nd March). The paperwork is in the post so should receive something real soon.
  3. Hi smesin Dunno if you have seen the new AQ thread link in post 37 it is really good. Basically you are asking the judge to order disclosure of how charges are reached from the bank as well as all the defence that will be used within 28 days of order from judge. At the same time you are offering to submit court bundle 14 days from the date of order. This is instead of all parties submitting all their papers upto 14 days before actual court day. This is a really good idea for those banks that love stalling to the limit tactics eg asking for stays and not settling untill the very last day before court date (these days could be months away). My personal opinion is that Nationwide do not fall into the category of "stalling to the limit" so I am thinking If I have to fill out an AQ I might be using the original AQ thus saving time and money getting court bundle together which I can't recall any Nationwide claim getting as far as this. what would you think and what would you do.
  4. Hi Yes just ignore this letter: 1: You gave them 28 days which is more than sufficient. Stick to your timetable. 2: You are not complaining as the letter states you are simply asking for YOUR money back. 3: The bank have already said your not getting your money back in the first response. This is just another stalling tactic. The same letter was posted to me the day after I submitted my court claim so I had no choice - didn't really need a choice though.
  5. hi smesin I too filed my claim at county court on 21st - however mine cost £80 and I was told it won't be issued for about 10 days:x so reckon you will get your money before me lets:-( see.

  7. I have submitted my N1 claim form along with schedule of charges (3 copies of each) to my local County Court. Was told that it won't actually be issued for about 10 days so suppose just have to wait now. Fingers cross for a smooth ride from here.

The confusion here is that there are other sites assisting people to claim bank charges. Some advise you to send one LBA thus missing out the prelim letter (not CAG). some advise you to give bank seven days to reply (not CAG). Some advise (the one you have read) you to write prelim asking for 8% at that stage (not CAG). I have read up on a few sites and decided to follow the CAG route to getting my money back. It is up to each individual as to which sites advice they follow. As far as I know everyone gets their money back so there is no right or wrong. But I am sticking to the CAG route and wouldn't divert to another site because this might cause me confusion. I hope this answers your query gsb.

  11. You are basically stating in your prelim that you want for arguments sake £100 + 8% which you would claim under S69 of the county court act 1982 if you claimed at court. If the bank were to pay you before the court stage (very much doubt it) they are not obliged to pay your 8% so therefore won't. If they paid your £100 then you have not got a claim to make. So in answer to your question. This site advises not to claim the 8% untill you start the court claim. (tried and tested). If you were claiming contractural interest though that you claim from the prelim letter.

  13. Didn't submit my claim today as planned will do it tommorrow Did anyone see watchdog tonight. I am sure that this is the nail in the coffin for bank charges. I am glad I am this far because I think the queue for refunds will grow now BBC - Consumer - TV and radio - Bank charges
  14. Hi amarsden From reading other threads Nationwide will probably acknowledge the claim stating that they are going to defend:sad: . Don't panic I reckon at about the same time money should start appear in you account:) . I am guessing about the 26th Feb lets see if I am right;) . Remember that is just by going on what has happened on other threads no guarantees. Did you see watchdog tonight. I reckon you have claimed in time before the claims start multiplying at a rate of knots. I submit my N1 claim tomorrow BBC - Consumer - TV and radio - Bank charges

  18. Just received my 2nd Fob off letter this time they are refering it to the member service department for review. I do believe this is one of their stalling statics. They will have had 14 days on the 20th so unless money arrives by then off to the court I go. I might just give Mr Huntley a phine call on the 20th just to ask whether they have come to a verdict no messing "are you going to pay my money Yes or No". If they say no then I will inform him that I am now off to the court. Definatley no more time they have had 28 days. If anyone disagrees with this call I would like to know Thanks
  19. There is no wrong or right answer. Really is up to you with both are fine to use. If you use MCOL you wont be able to submit your schedule of charges so will need to send it to bank yourself. You have to pay with a debit (not Visa Electron) or credit card. And you won't be able to put as much info in your particulars of claim (not a problem). However you can check the status of your claim online instantly without having to wait for the postie. http://www.consumeractiongroup.co.uk/forum/bank-templates-library/34887-5-money-claim-line.html If you use the N1 form you can hand/post your schedule of charges with your N1 form. You can pay by cash at the court. Your particulars of claim will be more comprehensive. http://www.consumeractiongroup.co.uk/forum/bank-templates-library/681-4-particulars-claim-n1.html If you are exempt from paying you will need to use the N1 route. The choice has to be yours. If you are still unsure you can sign up to MCOL fill it all in up the stage where you have to enter your payment details. If you don't want to continue you can cancel it. Your form will be saved untill you decide to continue and pay or delete it or after 28 days it will be deleted automatically. I don't think anybody has a solicitor. In the N1 form not sure about the MCOL though sorry (have a guess which route I have taken LOL)

Just as I have learnt from this site the slightest error in could delay the process of getting money back but I suppose it is a molehill if the bank did argue the difference I could always write them a cheque for 1p:lol:. As long as it doesn't get returned unpaid:lol: . Sorry got my humourous head on tonight and couldn't resist.
  22. Don't worry. if they do decide to submit a defence you still have to do nothing untill the court sends you an AQ. Remember the line to take on this site is to assume it will go all the way but so far post 2 is usually what happens. So don't assume its in the bank probably will but not guaranteed. Hope that makes sense.
  23. Thanks MTM I have already looked at the process of how to make a claim and understand it. It is just that the sites example of 0.00022 x 1,000 = 0.22 totals exactly 22p not 22.2p or 22.8p for example so no need to round up or down my total comes to 9.79p per day so I want to quote a daily rate of 10p but I don't want nationwide defending on basis that I am claiming too much interest then again why should I quote 9p which is less than they should pay. another thing, on the simple calc spreadsheet when I the total interest came to £110.18, but when I printed it out the figures (to 2 decimal places) on the sheet and addded it all together it adds ups to £110.17 obviously the program adds up to 3 decimal places but if the bank get their calculator out it wont look good if we can't even add up properly???

  25. No! that seems the norm. Their defence is "we have settled in full" hence keep an eye on any credits coming into your account. Don't worry if it is not there in one go it is normally in dribs & drabs over a couple of days. Almost there
