I am about in the same position as you are Bajills, I will accept 552 out of my 792 and would REALLY rather not file a claim, all of the form filling, legal stuff just seems a bit stressful and I work about 78 hours a week so could really rather do without.. for the sake of 250 quid I would rather settle early. How did you reach Tommy Mclean directly? They will probably credit the amount into your current. Are you worried they will revoke your o/d?

BC, I didnt need to do the DP step as my account has only been open for 2 years I have all my hard copy statments (kind of relieved there as that seems to be the most painful step waiting game-wise Both letters (Prelim and LBA) were sent recorded delivery. which i stated in my email to Mr. Mclean. So just being ignored I guess
  11. you can use the contact us thing on your online statement page. however i sent my prelim for 60 quid on aug 10th and they have just left a message for me at home "concerning a letter they recieved". May be faster to mail it

    oooooo have a message from my other half that Crap one called last night concerning a letter i sent them! will call on lunch break and let you all know! Message is from a laura garret, anyone know anyting or spoken to her before... since my prelim they have also added on another 20 pounds of charge. I think I will just call back as a "goodwill gesture" stating all correspondence in writing please!

  14. Your flatmate can state on any application for housing that the old tenancy is in dispute, so the new agency/landlord ect doesnt have to contact him. Also let him/her know that they can always use a guaranteer if this most recent landlord was his/her's only reference..
  15. The thing that REALLY GETS ME, is that my branch was really REALLY good when I first opened my account. I have only been in the UK for 2 years and RBOS was the ONLY high st bank to offer me a current account right away.. I feel loyal to them in a way.. but all it took was wages paying in late by 2 days to spiral into 750 quids worth of charges... For them to not even respond to my letters really irks me. I am addicted to these threads! BC you are about a month ahead of me so always keen to see how you are progressing..good luck everyone!!!!! :)
  16. Just wondering if anyone has any input.. I have had a p reg golf automatic GL for a year.. had 29000 miles on when got it last june everything fine until it cut out once when driving. thought maybe it was a small electrical blip so didnt think anything of it started happening more frequently but still random, generally happens once per trip although it does seem to be completely random. The effect it has on the car is similar to stalling but its definitely not stalling the car because I am driving at 40mph for example and have no intention of changing gear. This is causing major problems as you can imagine because this could lead to very dangerous circumstance. Anyway I took it to my local guy who said perhaps its the camshaft so hes replaced that... no joy,m and NOW it wont start at ALL!!! any motor heads have any ideas??? this is causing me tons of grief

Call them and tell them you are shopping around for a mortgage, and need to have all financials together in order to compare the best rates, your financial history ect; therefore could they kindly fax or email statements to you asap. They seem to drag their heels if they think its for reclaiming charges.. tell em its for something else I am sure you will recieve them asap

  21. Also you may be able to avoid the fees as you are a student however I wouldn't know too much about this. Also worth talking to your local Citizens Advice Bureau maybe before you start. I didnt use the spreadsheet template, just copied and pasted from my online statements into an exel page added up a total and sent it in with my letters. However if I do get to money claim stage I will claim interest and use the spreadsheet, wont be much as my charges only started Feb 2006.

  23. I mailed both the prelim and lba to my branch, july 24th and august 8th. Heard nothing! I sent this email to tommy mclean, ccing margaret king and carol stickland on Monday:- Dear Sir/Madam, ACCOUNT NUMBER: xxxxxx Sort Code xxxxxx I am writing to you to express my extreme disapoinment in regards a claim I have filed against my branch and yourselves. I sent a letter requesting a refund of all charges levied against my Interest Paying Current Account on July 24, 2006. I then sent another letter requesting again all charges be refunded on August 8th. Please note that both of these letters were sent via recorded mail and both were signed for at my branch, 45 Head Street, Colchester. I have attached a copy of both letters as well as the schedule of charges for your reference. The total I am claiming is £792.00 To date I have recieved no response or even recognition of my claim. I feel extrememly undervalued as a customer and am shocked at the lack of customer service I am recieving. I have always recieved prompt and polite service from my branch and from RBOS Telephone and Internet Banking. However, due to recent media coverage, I now believe that your charges are a Penalty, penalty charges being irrecoverable at common law. It has been held that a contractual party can only recover damages for an actual loss or liquidated losses. It is clear that your charges do not reflect any actual and or real loss. However, if you say that your charges are not penalties, I would be interested if you would demonstrate this by letting me have a full breakdown of the costs to which you have been put by as a result of my breaches, in order to reassure me that your penalties really do reflect your costs. I would be more than happy to receive this via email: missm I look forward to hearing from you and to a resolution of this. I will wait for until August 22nd as outlined in the letter dated 8 August 2006 then I shall begin a claim against you for the full amount plus interest plus my costs and without further notice.   24. YAY! good for you IMHO I would settle for 552 (my claim is for 792) giving them 12 quid a charge. ONCE A MONTH. I think that in this day and age if I went over my overdraft I should be penalised and that 12 quid is ao OK sum. The thing is we all know they are going to have to make money some how.
  25. send prelim-wait 14 days, no refund? send LBA (letter before action), wait 14 days. no refund? file money claim then it gets fuzzy as they take different steps. Just read the faqs over and over till you are clear and everyone on here will help you as well!
