Have you not thought about using the county court at Pontefract or Wakefield as it can be easier than using MCOL . Also what you doing next Friday evening? Hi again The transfer of courts is nothing to worry about and as for defending yourself in court I think you misunderstand.It is the bank that are defending themselves in court and believe me they are a lot more scared of any of the cases actually going into a court room than you are. The Yorkshire Bank will offer you several settlements before it reaches the hearing date , but stick to your guns until you receive FULL settlement.We are with you all the way even if it ever did go to court there are lots of people on here more than qualified to attend the hearing with you(but trust me it will never get that far) Jules

  13. Hi Macca, I would be inclined to add it at the point of submitting your MCOL . Easy as that , but once you have submitted your claim it will be harder to add any extra charges you incur and are best left to a separate claim. Thanks everyone couldnt have done it without your support and help, Just noticed on their offer for my account they have not included the £100 allocation questionnaire fee so a slight change of plan I think Accepting the offer on the joint account , but as for my account I am sending them MY OFFER tomorrow.   15. Hi All Letters came through yesterday offering the full amount + costs + 8% to date of claim. Basically I lose about £50 interest on my account and £10 on the joint account but I feel it would look greedy to the judge so I think I have to accept their offers. Letter of acceptance going in post Monday with a little add-on reminding them of the charges I will be persuing since my claim went in , I may even make these a condition of my acceptance. Its been a long haul and a bumpy ride and without the help and support of everyone on here ESPECIALLY CARO I would have probably backed down ages ago. Lots more people to thank in my next post when I have finally got the money in my account. I will also complete the survey and of course be making my donation to this fabulous site. Hi Zebby Exactly the same letter as I have (same court too:D) Dont worry about it just means they will pay up quicker as a Mercantile can set precedents better than a county court and deal with several cases all in one go. No need to respond to the letter. Ring the court and ask them if there has been a date allocated for the hearing as you haven`t got one on your paperwork(neither did I) as there are a few cases listed for the 7th of February . It also means that YB will probably offer the full amount + costs but not the 8% interest . The 8% is rightfully yours so if you are abe to hold out for it. Also send Caro a PM letting her know it has gone to mercantile she will be very interested .If her box is full(which it usually is ) email her [email protected].   18. Hi toprod, I can see no reason why you can`t send your LBA now as they have not given you a satisfactory response(albeit within 14 days) to your PRELIM letter. Yorkshire are well known for dragging their heels so take the fight to them and don`t forget to include a list of charges/dates/amounts but without the calculated 8% interest at this stage that comes later. Hi Marc, I am assuming you sent your SAR letter 50 days ago am I correct if so send them this letter http://www.consumeractiongroup.co.uk/forum/bank-templates-library/6986-data-protection-act-non.html This should gee them up a bit , unfortunately YB are one of the worst for delaying tactics but stick at it and don`t give up . Remember they have 40 days in which to supply the statements so be patient as the whole process of recovering your charges can take some time,but don`t give up YOU WILL get YOUR money back. Jules

Hi Jedii, At this stage you only need send a list of the type/date and amount of the charges DO NOT include the 8% interest , that comes into play if and when you submit a claim with the courts. You can start entering all your charges on one of these spreadsheets http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html but when you send your http://www.consumeractiongroup.co.uk/forum/bank-templates-library/671-2-letter-preliminary-approach.html do not show the column for the 8% when you print it off.
