  1. Hi Sham I want to say October 2009, but not at home so cant be 100% certain. I am as sure as I can be though with the Oct date yes still stayed afaik

  4. Sorry but I don't have the paperwork to hand, but it is written down in the thread Why do you ask? I think from memory this was SB at the time of the claim form being issued?

UPDATE Had a letter from Cohens at the weekend - in short Re: Your defence - our client is prepared to accept any reasonable offer, the letter said that it enclosed NOA (whicvh was missing!!), statement of account, and recon T&C's as well as an I&E form Said that if no reply within 14 days will seek instructions from client (Hoist) - funnily enough it has the £10 on there for the SAR request and the balance has gone up £100!! Any guidance on this be gratefully appreciated. I am pretty sure that his is SB now?

  9. Good afternoon everyone My son has received a letter from Pastdue chasing an alleged BT debt, as he is away in the army at the moment, he has asked me to help deal with this. This is a bit of a story so please bear with me and I will try to explain the best I can. In 2011 my son left home and headed off to Minehead, he followed his (then) girlfriend who lived there with her parents. some 12 months or so later the relationship broke down and he turned to a housing association for help to house himself (he was working at a powerplant) so able to pay his way. Things then took a turn for the worse in 2012 as my dad passed away, my son took this very very hard as his passing was sudden and hit the family very hard. In 2013 my son signed a contract with BT to have broadband and a phone line turned on (service was already in the property but disconnected). He recalls agreeing to a contract with BT in Feb 2013, however, in March 2013 my son decided to come back home, and in May 2013 he did just that. This is where things get a bit fuzzy, today he has called Pastdue, who claim that he owes BT the best part of £800 for services provided during the period covering Feb 2013 - May 2013!!! He has asked Pastdue to provide:* Proof of Debt* Copy of the contract* Statement of account* Itemised statements clearly showing the breakdown of money owed The response from Pastdue was that they didn't have any of that information, that he would need to contact BT they were only collecting the money (oh and threatening 'further action' if monies remain unpaid). Any advice on this would be gratefully received, I presume that Pastdue are a 'usual' DCA and should be treated in the same ways as the others? I want to be able to sort this properly, he admits that he owes something but need to get to the bottom of 'what' he actually owes and potentially extortionate charges! Thanks in advance!

Hi Andy Do you see many of the claims go through to allocation? like the OP on this thread I am now nearing 28 days (heard nothing yet), and wonder if the 'debt/claim' continues to sit in the background for ever, whilst a 'Stay' invariably locks it, is it only this place in time and not the future, to be unlocked by a.n.other as the debt gets sold on again... Sorry to piggy back this thread, but reading it with interest Thanks FDAO

  14. hello Just checking in as still not heard since we filed our defence. Does it normally take this long? Can someone tell me what the process is once a defence served. I have tried to check the MCOL website tonight but it is down! Thank you in advance

Thank you - I'm off work today as too poorly to go in, so I am off to turn on the printer and go to the library tab then off to Post Office. x And I expect in the majority of cases they will too but scarring people into paying up, I am going to try and keep upright about this, my hubby not coping well. So with the help of some great people on this forum, I am going to try and be calm and remain hopeful.
  20. Serious? They have taken it seriously enough to issue a claim... would there be a reason if at this stage it wouldn't be taken seriously? I don know much about Cohen's or how vicious at seeing things through to the end they are? Stuff like this affects peoples life, I find this all very nerve racking, it has a profound effect on me.
  21. Ok, thank you Sander will look silly for attributing the £10 PO for the SAR to the account wont they!! Robinson Way now texting my hubby daily... surely if this is a matter for the courts why are they still harassing him? I have told him to keep the messages and the callers list on his mobile Defence now in as per guidance given here. Am I still apply for CCA and CPR? If so I need to get these in the post today.... Anyone have any idea how long Hoist / Cohens take to respond to the defence submitted? Thanks in advance
