  3. Hi Russel, Please can you set up a thread in the Halifax forum, where we can keep track of your claim and give any further advice you need. You need to take all 3 copies to the court for them to seal (stamp). You then keep a copy, and either the court can send the bank a copy, or you can do it, either way is fine. The staff at court offices are generally very helpful. Good luck
  4. Hi Smartbucket First of all, just carry on with your claim on your timetable. You are giving them 14 days to reply to your prelim anyway. If you want to you can give them a few extra days to reply, it wont hurt. Please now set up a thread in the Lloyds TSB forum, so that any queries you have can be responded to there. Best of luck

  6. OK, if you put 'in full and final settlement' on the letter, then this is a good start. Now the law states that 'part payment of debt is no consideration', however it sounds like this guy may not be owed any money anyway. If you paid him the amount agreed before he broke the bath, then he is trying to claim extra money for work rectifying his own negligence. I would say that you should be fine on this, make sure you have all your paperwork to hand if you discuss it with anyone. Good Luck

  9. Right, all other claims settled, now going to have a go at this one. We (my ex and I) had to sell our home last year to avoid it being repossessed by other lenders (my exes, not mine). My case seems to be similar to Zoots in that there was only about 14 days left of the ERC term left when the house was sold. Off to do SAR, will keep you posted

Hi Seasiders OK, first of all, I would reccomend that you send the prelim letter (and all others) to your local branch to deal with (also put that address on the court forms if it gets that far. 2. You need to set up a thread in the Natwest forum, we can answer all your queries there. 3. If natwest have provided all your statements, you dont need to send the DPA default letter, just keep in the default paragraph in the prelim letter if you have defaults because of the charges Best of luck

  12. Sorry worried mum, but in this case it isn't a penalty charge, it's just horribly expensive Not a lot either of you can do, except perhaps try and find another network that is cheaper abroad and possibly cancel the O2 contract if possible

  17. Hi Either way is fine, but if the 2 accounts charges add up to over the £5k it is better to do them separately to keep the claim in small claims track and not fast track, where it all gets a bit complicated. Best of luck

I didnt get a single offer or letter til I filed my AQ, they paid in the end tho This bit is definitely the worst in my opinion, waiting for the money, knowing they WILL pay, but when? Keep smiling

    Are you really happy to accept part payment of what they owe you? If you are, well done and enjoy , but if you are accepting this because you are concerned that you wont get the whole amount then please think again. There is no-one that has not reclaimed the whole of the bank charges if they have stuck it out. Entirely your decision, just wanted to make sure you are happy with it
  20. Hi Tristesse Claiming your charges back should not affect your arrangements at all. The banks have been told by the FSA that closing accounts or cancelling facilities is retaliatory action and is not allowed. Welcome to the forum it's good to have you Before you start a claim just make sure you have had a read of the FAQs and are comfortable with the process.   21. It always amazes me that they dont bother to reply and offer the payment instead of costing themselves more money because of the 8% court interest. Go for it, just make absolutely sure that you are happy with the court forms and how to fill them out before you go ahead. Shout if you need any help

Hi Noel you need to set up a thread in the relevant bank forum so that we can help you with your claim as it progresses. http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html these spreadsheets are very useful, just input the information it asks for,and job is one for calculating the debit interest you have been charged on the charges. N.B DO NOT try and claim the 8% court interest until you issue proceedings. Good luck
