  4. OK, That was in fact the same spreadsheet but I input all the figures into it - just to be sure - and got the same result. Tries a few combinations to try and see how they got their figures but nothing so far. Jedicris
  5. The spreadsheet I used was this one: PPI Redress Calculation FOS Single Premium Policies. I was sure that they couldn't offset but thanks for confirming.
  6. Synopsis Took out £10000 loan over 60 months with PPI in July 2004. Hit financial problems in September 2008 and been paying on a free DMPsince then. In March 2012 made a claim for Mis-sold PPI. April 2012, Claim Upheld and Offered £21XX.XX + £38X.XX = £25XX.XXplus another sum for 8% interest. What are theproblems? 1. They have offered £70X.XX for 8% interest. My calculations (using the spread sheet from here)show a sum of £10XX.XX, a difference of £37X.XX. 2. They have sent £28X.XX of my PPI to the DCA. Reason not specified. But their letter states, “As your account isstill open, in line with the Financial Services Authority guidelines and as aresponsible lender with a commitment to treating customers fairly (TCF) (sic), your loan has been credited with £28X.XX to put yourloan in the position it would have been in had you not taken PPI, as far aspracticably possible.” Is my accountstill open, they sold it to a DCA? 3. Transaction history from SAR shows that Loan wassold at a balance of 17XX.XX in July 2011. CRA shows this as the last balance on the balance history for Egg. However, DCA CRA entry shows Opening balance of £28XXwhich is original default figure. A difference of £11XX. 4. Reworking the loan without the PPI shows that theloan + interest total repayment would have been for £118XX.XX 5. The total of the payments I have made to EGG andDCA total £139XX.XX and DCA shows £15XX still outstanding meaning a totalrepayment of 155XX.XX This is £37XX.XXmore than the reworked loan. Evenoffsetting the PPI refund (minus the 8%) against this, still leaves anoutstanding amount of £11XX.XX. Presumethat £11XX of this is the DCA figures. Can anyone make sense of this and advise course(s) ofaction. Many thanks. Jedicris
  7. Hi woodyt, I'm sure one of the experts will be along soon but the important part of what you said is "self-employed". I'm sure that it does not matter how many hours you work. A claim based on being self-employed is a claim based on being self-employed, irrespective of the number of hours worked. If I'm wrong, I'm sure someone will say so. Also claims usually have more than one reason for being mis-sold. Jedicris

  10. Hi, Have just had a success for a PPI claim that I made on behalf of my wife for her Smile credit card:-D. The account was closed in 2008. Looking through the SAR information that we received for this claim, I noted some charges had been applied and would now like to reclaim these as well. The charges were very small 3 lots of 11. BUT looking through the SOC spreadsheet that I did for the PPI claim, 2 of those charges would never have been made (account would have been in credit). Do I claim for just those two or for all three. I know it is very small but I am very reluctant to let them have anything. Any advice please. Jedicris.
  11. Hi odydog, I did it all myself. Just did some research on this forum and asked a few questions and received some help here. Do take the time to read some of the material signposted in certain members signatures i.e dx100 etc. It helps a lot. Don't even think about using a Claim Company, they can do nothing extra to what you can do!!!!! Plus the sense of SITTB is just so much greater if you do it yourself instead of an overcharging claims company Jedicris

  13. Hi odydog, I am in a similiar situation in that I have a DMP (Free One) and been in it for a few years. I am currently claiming back PPI and have just had a succesful claim. So, go ahead and start to claim back all of your PPI. Don't worry about wether it is "the right time etc", just go ahead and get some of your money back. There are lots of people on here who can give you good advice. Jedicris
  14. Advice Please: Well, my SAR arrived from Barclaysharks today by Recorded Delivery. Problem is, they sent it to my previous address, despite me informing them of my present address two years ago and my present address being very clearly displayed on the SAR request that I sent them. Now my query is; Do I write to them and point this out or do a formal complaint to the ICO or do both? To really pea me off and to add insult to injury, the have only sent; "Letters and Reports", no statements or transaction history. Nothing really useful except that one of the reports does show my present address but with the previous Post Code. What a load of incompetent idiots! They still have 10 days before the 40 days runs out but suppose I'd better think about preparing a "Failed SAR" letter. Any thoughts gratefully received. Jedicris.

  16. Hi, Well, received letter from Halifax (inc. Bank One) re: my PPI claim. They have upheld my claim and will be sending me a cheque for circa £8000. Yippee!. However, I have a query which I hope you can help with. I defaulted on this card and have been making payments through a free DMP since 2010. Default balance was circa £13000. My query is: I believe that FOS rules state that my account should be reconstructed, does this mean that my default amount should be circa £5000. Reason I ask is that about 1.5 hours after the letter landed on my doorstep, I received a phone call from the "Halifax" buit I think it was Blair O S. They were asking for my £8000 which would leave me "Just" owing them 3000. They would also consider the possibility of the £8000 being a "Full and Final". I told them to put all this in writing before I would consider anything. Am I right in thinking that the default balance should be reduced by the amount of PPI and interest because this should never have existed AND that I should receive the £8000 as refund of the monies I paid for the PPI. I can't help but think BOS ared trying to rip me off. Many thanks Jedicris.
  17. Hi, Have recently received standard rejection letter from Egg regarding my PPI claim. Am now in the process of writing a letter in response and would be grateful for any comments on my letter so far. Many thanks I am writing in response to your letter rejecting my claim for mis-sold PPI on the above account. Given the short time needed for your response, I find it difficult to believe that you have seriously considered my claim and my reasons for claiming. I wish you to re-examine my claim, giving serious consideration to my reasons for considering the PPI to be mis-sold given previously and to also take into account the points made below. In your reasons for rejecting my claim you use the present tense and not the past tense. Your practices today are not necessarily those of the past. In December 2008, Egg were fined by the FSA for “inappropriate sales techniques” It was common practice for Egg: · To have pre-ticked boxes. · Web pages that would not allow customers to proceed, unless certain criteria had been met including boxes referring to PPI purchase had been ticked to confirm purchase. This practice was banned by the European Parliament in October 2011. I believe that these are “inappropriate sales techniques” Rejection Reason One “Does not require you to take repayment protection insurance as a condition of obtaining the credit card.” The practice of having pre-ticked boxes and web pages that would not allow customers to proceed,unless certain criteria had been met, including boxes referring to PPI purchase had been ticked to confirm purchase This does effectively mean that the credit card could not be obtained without purchasing the repayment protection insurance and therefore the purchase of PPI was compulsory and also subject to “inappropriate sales techniques” In addition, when I wrote to you to cancel the PPI, you immediately cancelled the credit card, inferring No PPI = No Credit Card. This does effectively mean that the credit card could not be held without repayment protection insurance and therefore PPI was compulsory. Therefore this reason for rejection is negated. Rejection Reason Two “Does not provide an advisory service”. The ABI Code of Practice,in force at the time I was sold the Card Repayment Protection Insurance, states: ... shall ensure as far as possible that the policy proposed is suitable to the needs of the prospective policyholder. This you failed to do. · I was not asked questions about any existing medical conditions. · I was not asked if I already had any form of payment protection policy. · I was not asked if my employment terms and conditions would provide adequate income due to sickness or possible redundancy. If I had been asked any of the above questions you would have determined that the CRP (PPI) was not suitable. You were in breach of the code of practice. Therefore the PPI has been mis-sold. Rejection Reason Three “Required you to positively confirm that you wished to purchase this policy during the online application.” I refer to the previously mentioned practice, of having pre-ticked boxes and web pages that would not allow customers to proceed, unless certain criteria had been met, including boxes referring to PPI purchase, had been ticked to confirm purchase. Again, this does effectively mean that the credit card could not be obtained without purchasing the repayment protection insurance and therefore the purchase of PPI was compulsory and was subject to “inappropriate sales techniques” Rejection Reason 4 “Provided full terms and conditions of the policy and requested you read them before submitting.” Again, as previously mentioned, the practice of having pre-ticked boxes and web pages that would not allow customers to proceed, unless certain criteria had been met, including boxes referring to PPI purchase, had been ticked to confirm purchase, therefore this does effectively mean that the credit card could not be obtained without purchasing the repayment protection insurance and therefore the purchase of PPI wascompulsory and was subject to “inappropriate sales techniques” Conclusion I believe you have not treated me fairly for the following reasons; · I was not asked about any pre-existing medical conditions I suffered from/warned that pre-existing medical conditions could affect my insurance. · I was not asked whether I already had any existing insurance or employer benefits that would cover my repayments. · You have been punished by the Financial Services Authority for failing to treat customers fairly and I do not believe that the PPI I bought was sold in my best interest. Unless you can prove that the policy was fair and reasonable and that I was treated fairly when I was sold the insurance, I demand a full refund of all premiums, and subsequent interest on these payments, that I have paid in relation to this policy. Where appropriate,I also expect 8% interest to be added to each payment I have made as this is the statutory amount a court would pay. I look forward to your full and promptr esponse to this letter. If this matter is not settled within 14 days of this letter I shall undertake further action Yours faithfully, Many thanks Jedicris
  18. Hi chilli, I've only been on here a short time and I'm sure a wiser head will soon get back to you BUT I think the consenus on here is YES it is always worth claiming. I know what you mean about having the strength to fight, I am in a similar position. I have found that this forum has helped me find the wherewithall to get into this.   20. Hi, It looks as though I can roll this into my Halifax card claim. Received a letter from Halifax today, which listed the previous account numbers of my Halifax card and lo and behold the Bank One was listed. SITTB Jedicris.
  21. Yeah, Barclaycard one first, then the Egg, then the Halifax then on to loan ones plus anybody else I can find. I'm trying to do all the prep work and get everything put together and want to make sure that I have covered everything and that figures are realistic and viable. I do like to double check everything before commiting myself. (Lessons learned the hard way). I am pretty good with spreadsheets in a generalised way but this is just outside my area of expertise.
