  1. Hi again!

     

    I could do with being pointed in the right direction with this.

     

    An account with 'Very' has now been legally assigned to Lowells (sold) and they are requesting the full amount or payment plan etc.

     

    I am not disputing a debt in any way and intend to repay every penny but I do dispute the amount of debt. The debt was sold to them last month, the last payment we made to Very was about Apr/May this year and back then the balance was about £1700, now its £2100, I accept interest will have been added on but I know a heap load of charges have been added too.

     

    So, I want to challenge the total (not the debt) and make contact with a realistic offer but also want to see what charges I have been fleeced with.

     

    I’m thinking – SAR – but to who? Very or Lowels and at the same time letter with an offer to pay

     

    Any idea’s?

    Four of the payment they took arrived back in my bank this morning.

     

    When I was talking to someone from my bank about this, I explained to him that one of my concerns was that I was worried that I would wake up (for example) the day after pay day only to find more 're-occurring' payments has appeared from this lot. I was astonished to be told that if they (DCA) could locate my money and that if they were owed it, then they could try to get at it by any lawful means. !

     

    Anyway ..I'm happy because I have my money they took.

    PS ... I did get a email from NDR expalining that they had "experienced difficulties on the website" ......just imagine if all 57 payments had gone thru = £1,767 would of been taken from my bank without my authority!

  3. Okay here are some scans. I know the balance is only for £60 but the point is that they have taken £150 when they should of only taken £31 but what is really worrying is that they attempted to take 52 x £31 from my bank.

    I can only attach 5 scans so please open them in this order:

     

    1. payment plan.jpg - Self explanotary. This was agreed with NDR. Regular payments was made as it was only for 6 month @ £30 which I could afford no problems. But this weird letter appered

     

    2. confused acct.jpg - Letter telling me they have been trying to contact me £12 charge. *Note* the name Very next to the blanked out account number - this confused me!

     

    3. nationwide statment-1.jpg - Next was the 5 payments they took from my bank when I only set up for one. This is my bank statement.

    My wife spoke to them on Friday 13th and they stated that their accounts dont show any payments. I send an email - they reply denying any knowledge. Look at my NDR account today (14th August)

    and make payments direct, but it may be more trouble

    than it's worth.

    Is the balance very large/small compared

    to the NDR charges?

    NDR are managing two accounts:

     

    ex K&Co - The balance prior to these five payments being made was only £60 next months payment of £30 would of finished it. But they took £150 (5 x £30) that bought my balance to about £90 in credit! But I checked the balance a couple of hours ago and it is now back at me owing them £60 - no sign of me credit!

     

    Its a dam good job I took some screen shots earlier.

     

    Give me a couple of hours and I will scan & upload the original payment plan letter telling me to pay £30 for 6 month back in Feb and will post some other stuff showing the 5 payments they took on the 12th Aug as well as the 52 failed attempts to £31 which, had there been money in my bank would come to about £1600 !!

     

    The other account they manage is for about £900 and I havent had much problem with this one - I regular pay this every 4 weeks

     

    Their APR is just horrendous - 45%

  5. Just a quick Q as I cant find the answer

     

    If I send a CCA to a company that is requesting payment and they cant supply the agreement then they cant legally request money? Basically I want to stop paying them and deal directly with the original creditors.

     

    If they do supply one then I have no choice?

     

    Or am I getting confused?

  6. Could it be because I have a debt with Very (owned by shop direct as well) and was at one point handed to NDR to manage but then was passed back to Very, this was a completely different account number to this one though and this one is showing as in credit.

     

    What I'm trying to say is sometimes a bank will try to take money from another account to pay ie, barclays/egg etc

  7. Cheers DX .. I set up the auto pay for x2 payments thats all. I have had no letters/messages or anything, just my usual statement and was looking forward to my first debt being paid off but now there is x4 what I was paying each month credit in the account that I cant get at. They guy from my bank said he is going to send me something that I will fill in, then he said they contact the company to verify they have a right to have it, if not, because its VISA then I can get my money back. Is this 'charge back'?

     

    I have a feeling this will take a little while but the problem I have, the extra they took, was to see me & the missus until the 28th - food/bus/train - its only about £120 but for me thats a lot! I dread to think what would have happened if this had happened when I got paid and all the failed 50+ withdrawls had gone thru !

     

    I dont think it was a DD - It was something I set up on their website - Pay Now/Later/re-occur/amount etc

     

    But why have they taken all of this?

    I have cancelled to the that the payments were taken from to stop any further payments in the future. I cant ring them because it is my wifes account and she doesnt like getting into conflict with these. I have send them a message from within their website account asking them what they are doing etc. But I could do with some sort of letter template? So I can sent them ...god I'm fuming (and panacking)

    I have set up a payment plan with NDR (Nationwide Debt Recovery) for a set amount I pay regular every 4 weeks. It related to a debt with K & Co who are now part of Shop Direct. I used to pay this online via their website but last month, because I only had 2 month left, I set up x 2 re-occurring payments (one for each of the payment days). This would save me the hassle of trying to remember when it was due and would be done automatically.

     

    This months payment has just gone thru leaving me with only next months payment. HOWEVER immediately after taken this they started to take more payments of the same amount and were successful taken 4 more that has now left me with no money until 28th of this month! I can see from my emails that they are still trying to take out the same amount of money and so far have tried & failed 50 times!!!

     

    I have rang my bank who said because I set up a re-occurring account and because it was with VISA they could not block it or refund it. I would have to contact NDR for them to look into.

     

    I do have a account with VERY that I am trying to arrange a payment plan with ( they too are part of Shop Direct) but surely they cant just simply get NDR to simply dip into my account when they are collecting money for as part of an agreed payment plan for something else.

     

    Im fuming and now I have no money for over 2 weeks!!

    Just a quick update re this thread (and mainly for the benefit of others who are dealing with EGG)

     

    I basically complained to EGG concerning their use of ResolveCall who came banging on my door only after one week of a threatening letter! I also complained that despite making an offer of a reduced payment, they failed to respond.

     

    I have attached their response (and also the original letter from ResolveCall, a week before their visit)

     

    According to EGG the role of the trespassing door knockers is and I quote:

     

    "Their role is to hand you a telephone with an EGG representative on the other end, not to coerce payments directly from you"

     

    Funny how the letter from ResolveCall a week earlier clearly states:

     

    ....this action will include

     

    • A personal visit being made by one of our representatives to your home to collect payment.

    I could do with a hand responding to them to clearly state that I have no wish to enter a conversations over the telephone as a want everything in writing. I don’t want to be awkward or anything like that, I just simply want to pay a reduced amount (which I have allready started anyway). ResolveCall have no legal right to collect money as I’ve CCA'd EGG and they still have me on their books.

    I’ve seen on the forums somewhere a spread sheet to send to creditors listing monthly expenditure etc. But can I find it ....

     

    I know some folk don’t like sending these out and only a court can formally request one but I don’t mind completing one because I’m in negotiation with some of my creditors but I would rather send them one the "I" have produced than theirs (because there's are naff)

     

    Can someone point me in the right direction as to where it is

    I have a LSTB current account with an OD of £5k on it. I don’t use this account at all, no direct debts, no nothing but it’s costing me £75 every month just on interest they charge for the 5k. I can’t really do much in relation to paying this off as I have other priorities elsewhere.

     

    Is there anything I can do with this interest or am I stuck with it.

     

    I’m thinking of SAR'ing them as I got absolutely stung in charges a couple of years ago but as soon as I so this then they will clearly close the account and want their 5k ...?

    A couple of my partners catalogue accounts have been passed to NDR Money. I seriously regret setting up a payment plan with them, not because I don’t want to pay back what I have borrowed but because of the way these characters add charges to the account. I semi understand late fee’s, I semi understand over limit fee’s BUT just because they can’t contact me they charge me £12.00 EVERY TIME

     

    This is the latest ‘fine’ I have (and there have been loads of these)

     

    “As a result we have applied a £12 administration fee on your account due to the substantial amount of effort I have made in trying to contact you

     

    So let me get this right. They try to contact me (letter NO, email NO, answer machine message NO) and because I didn’t pick up the telephone at the material time they rang I get hit with £12 x as many times as they try to contact me!

     

    Absolutely disgraceful abuse. Can anyone think of a suitable reply? I’m not that good at letters and I am seriously thinking of making a complaint to OFT.

     

    Also should I CCA them (NDR) or the catalogue company?
