**WON** (with very little effort)
I have just had a response back from BC and I screwed up with my sums! For some dumb reason I only added up the charges for 2011, thinking that’s all I had, added a bit of their interest the total I said I was claiming was about £210.
BC have pointed out the error of my ways and produced a spread sheet of all the charges going back to 2006 and have agreed to pay them all back - £684 plus £396 contractual interest. They say that they don’t have statements prior to this, but to be honest I’m not bothered at all.
Even though there is still a balance on the card, they are transferring the funds to my Bank as soon as I tell them the details. Something to do with the BC Acct being terminated.
Length of time taken from postage of my claim to their offer = 4 Days!

Hmm Im still waiting for my SAR to be delivered. It was sent recorded on the 21st and the track/trace shows that it ....."is being progressed through our network for delivery."
How long should I wait and what should I do next?

As predicted the only charges that have been added was during 2011 when things went pear shaped for me. In total there are only 16 x £12 charges (late/overlimit) which comes to £192.00. The APR on this card is 15.30%.
I’ve filled in the CISheet v101.xls (and interestcalc.xls), added the APR and the total is £213.73. Not a lot I know but if it reduces the current balance then it’s fine by me!
I take it my next step is to send the template claim letter, although I will tweak it a bit to personalise it?

Sorry you were missed.
So long as all the accounts are definitely with one company, ONE SAR is all you need. All you do is write each account number and then they have to supply the data for each account.
I would get all the statements before you begin the reclaim. Saves messing around at a later date.
As you wish to act on your wifes behalf you will need her signed authority to do so

All of the accounts are with Shop Direct but with different companies within SD. VERY, Additions and K & Co.
Does this make any difference?

I am about to go through the process of reclaiming the entire £12 missed/late/letter fee’s from 3 separate accounts with Shop Direct. Is it best to SAR Shop Direct for each account, this way it keeps everything tidy or just one SAR for all?
If it helps, the status of each acct is:
1. Defaulted last year & legally assigned to Lowels who have since closed the acct when I tried to obtain a credit agreement, so I have no idea where in the world this is!
2. Paid off about 4 month ago
3. Still current and under a payment plan with Bouncers NDR Money.
I have the statements for the past year for each account and the combined total of fee’s paid would pay off the current account, so I don’t know whether to actually go the SAR route or simply submit my claim for the past years’ worth of charges.
Finally but much more importantly these are in my wifes name can I act on her behalf legally?

I am trying to determine which creditor will be next for me to start re-claiming for all of the outrageous charges I have been ripped off with over the years. I need to choose one of my creditors for February and Lloyds CC is high on the list. I was wondering what other peoples experiences are with them and what they are like defending etc.
So far in 2011 I have been stung for just short of £300 in late fee’s/over limit fee’s. so I will need to SAR them for the previous 5 years (pretty much the same I’m guessing).
It will be the Court route I will take not the FOS

Brief Circs:
Debt of about £280 to a catalogue company with a payment plan in existence with a DCA who is collecting on their behalf. (I am unaware of any legal assignment).
The payment plan is for £20 PCM and has been running for about 4- 5 months.
The DCA is ‘Droyds Debt Collection’ (Apt name)
This month I was two days late with payment and this letter has just dropped thru the door:

Okay I know this won’t happen but please tell me they have breached something somewhere so I can complain to the OFT.
It infuriates me that these people can threaten people in this manner.

I have taken out a 30 day trial with Credit Expert that is due to finish next week. What is the best way to cancel this? I cant seem to find anywhere on the website how to do this and the last thing I want to folk out is £15 a month just to look at depressing debt!

Unfortunately DX the way the forum software works when you search for DE Money, its pulls back every post with the word ‘money’ and ‘de’ in it. Even when you use the syntax “de money” and de+money it still pulls back every post with ‘money’ in it.
If First National Tricity Finance/Lombard was actually taken over by GE Money, all I am trying to establish is who GE Money is. I genuinely don’t know who they are, hence my previous post.

I’ve been going through old paperwork (as you do on a Friday night!) and I have found a carbon copy of an original credit agreement for a loan when I bought a computer with Tiny Computers in 1998 spread over 3 years. This credit agreement clearly says I have opted for Payment Protection Plan Premium (optional) and is for £143. (The loan was for £1205). Had I known what this PPI was there is no way on this earth I would of forked this out.
The credit agreement says the creditor is Lombard Tricity Finance Ltd, Trinity House, 284 Southbury Rd, Enfield, Middlesex.
I also have a letter sent afterwards from First National Tricity Finance, same address with all the payment blurb on it.
Now I want my 143 quid back plus any interest but does anyone know who or what happened to Lombard/First National Tricity Finance and where they are?
Plus any suggestions how I go about claiming this back

Last year I was struggling to pay the minimum payment on one of my credit cards and fell into arrears. I basically paid what I could and left it at that. Naturally I was issued with a S87(1) Default Notice and didn’t think much about it. I was then issued with three more default notices which I thought odd, is that normal?
I then received this odd letter
Dear Geordie
You have missed payments and your account is in arrears. In order to give you a fresh start we want to bring your account up to date and clear all of the payments that we have asked you to pay in the past which you have not paid.
In order to clear the arrears we need to make a change to condition 123 of your agreement. It will now read “We may choose not to enforce our contractual rights against you and make this contractually binding against you a notice which expressly states that we have chosen to do so under this term of the agreement. In all other cases, if we choose not to exercise rights against you, we can still do so later. The arrears standing on your account at the date of this letter have now been cleared. You still owe us these amounts which form part of the balance blah blah”
What’s all that about?
I thought they could only issue one default notice but then they send me this letter?

Hi Ho Hi Ho its off to Barclarycard I go...
Spend last year negotiating with all of my creditors when my circumstances changed and what a stressful time that was. Never again. Now it my turn to reclaim for every penny they took from me by way of charges. Every month I will SAR one of them and I’m kicking January off with Barclaycard.
I never check my BC statement I just pay the min amount and file it away. I’ve checked all of 2011 statements, low & behold I’ve had £12 slapped on every month for ‘over limit’. Well that’s odd because my limit on my statements is £0.00, they cancelled my account yonks ago, add a few late fee’s and its already just short of £200 for 2011 alone!
Tomorrow the SAR goes off to see what the previous five years hold as well as any PPI (Ive no idea if it has) and I am setting off with a mind-set of taking my claims all the way to court, I have no problem with that whatsoever.

Is it still possible to claim for charges when Banks were charging very high penaltys, ie, £25 letters/cancelled DD's, overlimit etc. In the days prior to the £12/16 fee's

Have you checked how much you have paid them in credit card charges? If you consider late payment charges and interest paid on those charges, you may well find that your level of debt to them falls significantly

I haven’t checked. I am guessing that there may well be maybe only a dozen or so late payment charges over the years, particularly during that year when I got into difficulties when pretty much every month I was slapped with £12 penalty.

I have (had) an RBS credit card for a number of years and about a year ago my circumstances changed so I went through the routine of contacting all my creditors. Nearly all of them have frozen interest or reduced it significantly and I am on reduced payment that suits me.
About 6 month ago RBS accepted my reduced payment of £200 per month but refused to reduce interest, the problem is the interest is slightly more than the payment, so for the past 6 month I have paid them £1200 but my balance has increased!
Ive just recieved a letter from them telling me that they have reviewed my account and will continue with the reduced payment but no reduction in interest.
At this rate I may as well chuck £200 down the bog each month. Any idea what I should do

One of the crapalogue companies within Shop Direct are refusing to hand over the money that I am in credit with, its only £100 but every time I email them to close the account and send the money back, they refuse telling me that 'security this' 'security that'. I have even contacted via my account onthe secure 'contact us' and they replied asking loads of security stuff.
I would mind but the idiots were swift contacting me when I got into debt with them and chopped down half of Keilder Forest sending letters to me.
Now all of a sudden its them owing me money (I over paid !) and they have gone all quiet.
Im going to give them one last chance and if they dont give me my cash back I am going to charge them interest (their 45% rate too)

I thought NDR were the in-house collection arm for Littlewoods catalogues et al.
NDR Money (Nationwide Debt Recovery) are the in house moneys for Shop Direct lot.

I have had experience with Resolve Call in relation to EGG (now Barclays).
I sent a letter to both Resolve Call & EGG from the template list about trespass and EGG were unbelievably apologetic to the point of that I thought I had ‘over done things’ and RC just never surfaced, ever. Do make a formal complaint to the creditors – they don’t like it, makes them look bad to the OFT !
Print a spare letter and keep it should they re-appear and thrust it in their hands
