    OK just so that I am 100% clear...you know that PPI was paid from 2003 but you only have copy statements (not to be confused with transaction history) for the last 6 years.

     

    Sorry for the questions but for the PPI it is important because it will dictate which spreadsheet to use.

    SD have supplied copies of statements for the past six years that shows all the transactions (one page per month), balance, payments, returns etc. The have also supplied various bits n bobs and one document simply lists all admin charges, insurance charges and interest in chronological order starting with the first insurance payment on 26th April 2003 (each line shows SD code, date, description [ins/int/charge], amount etc). The list goes on & on until the account was sold to Lowels in Sept 2011.

     

    The spread sheet I have used is the CISheet v101.xls

     

    One question I have is that the last PPI payment was made on the 7th August 2010, so is that the end date of the claim, or does it roll on until the claim is settled?

  2. Thanks very much! Just when I was wading thru the link you gave SD have delivered the missing data from the two accounts. :-)

     

    So I now have all three accounts, with all statements showing all the charges of £12 that are listed as simply 'Administration Charge'. I’m going to spend the next few days reading through this lot and tot the total up using their interest they have been charging me. (44.9%)

     

    As an additional bonus I’ve discovered that insurance premiums have been factored into the minimum payment into one of the accounts since 2003 until mid-2010. Nice!

    Original SAR sent 20th February

    Acknowledged 3rd March

     

    Partial SAR received (two accounts missing) 20th March

     

    Failed SAR sent 26th April

    Delivered 30th April

     

    They have had since 3rd March to provide the information and have so far failed.

     

    I did say in my last letter that I will take court action to get my information, is this the best route or ...?

  4. Just a quick update for the benefit of those re-claiming from Shop Direct.

     

    SD failed to provide all of the information I requested. Only partial info from one account and nothing from the other two, so I have sent a failed SAR letter along the lines of …. (lets see what happens)

     

    Dear Sir

     

     

    This is not an exhaustive list by any means, it is just an example of some of the information I am missing. Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998.

     

    The time for compliance with my request expired on the 13th April 2012 and as a gesture of goodwill I allowed a further 14 days to allow for Bank Holidays & general administrative delays.

     

    Should there be any doubt what my original request was, I have attached a copy of this request.

     

    If you do not comply fully with my Subject Access Request within 7 days, I shall apply to the County Court for an order to enforce compliance, together with legal costs & damages at the discretion of the court.

    Just a quick question.

     

    The SAR date is up tomorrow (Friday 13th ..Urgg) and I’m not sure where to send my ‘failed SAR’ letter to. The original SAR went off to Shop Direct @ an address in Bootle, Merseyside but their partial response came from a Data Protection Unit from a Chelmsford address.

     

    They have provided some data from one account and nothing from the other two.

    I’m still struggling to find out who actually owns this debt as I sent off the letter quoted above, altering it a bit to personalise it and never heard a thing from Droyds. Out the blue this arrives from the OC – La Redoute:

     

    Dear ***

     

    Your request for a copy of the credit agreement for Redoute Account ********

     

    I have checked our records and have been unable to locate the signed agreement. A copy will have been sent to yourself for signature when you opened this account in accordance with our standard process.

     

    Nada nada nada

     

    Okay I saved myself a quid re the CCA request, but I didn’t ask for this!

     

    I have been paying Droyds every month now for months and I am receiving letters from them saying I have missed some payments when I know for a fact I have not. My bank statements will support this. I don’t want to continue to pay someone who I have no idea who they are *and* are saying they have not received payments. I really don’t know who to pay!

     

    The debt is on my credit file with Redcats and if it helps I can still log on to the La Redoute account, although the last statement was last year sometime, but some recent payments are being credited to the account.

     

    The debt is a pathetic £250 and they are making such a song and dance!

  7. Yes, this happened to me last year when a Very account was passed to them (NDR) because I wasnt paying. I didnt pay for about 3 -4 months and when I logged on I got exactly the same message. My account was passed back to Very and within about a month I got a letter from Very saying they have sold the debt to Lowells.

     

    As soon as I had my first letter from Lowells I fired off a CCA request. They couldnt supply it and closed my account with them, I have no idea where the debt is but no doubt will end up with someone else.

    I did request them by putting this little bit in my SAR

     

    Please supply me with copies of all the data which you hold on me in relation to any matter and in any form and for any period of time. Also note that I require disclosure of any personal data which you hold on me for the entire period of my dealings with you. This includes in particular, but is not limited to, the following:-

     

    1. The original signed, executed credit agreement and any terms and conditions that applied to each of the above accounts at the time were opened.

     

    I know for a fact they cannot supply me with one of them because I formerly requested it when Lowell’s started chasing me/us last year and they replied that they have asked SD for it. (It was legally sold to them last year). I have it in writing from Lowell’s that SD has informed them they do not have it due to age etc.

     

    As for the ‘over 6 years’ … I don’t know. I’ve just starting adding up the charges/interest for the statements they have supplied and I’m gobsmacked so far. I’m guessing that I will be happy at sticking to only 6 years’ worth.

     

    Also I am sticking their APR interest rate of 44.9% in the spread sheet because it’s the only rate I can find on the data they have supplied but I doubt at all it was this six years ago, should I stick with this?

    Shop Direct have responded to my SAR and supplied various statements, however have only supplied the data for one account and the statements only go back six years. They also failed to supply a copy of the credit agreement for any of the accounts. I can copy/paste my SAR if you need to see what I put in it.

     

    What should I do? The SAR cut-off date is 13th April, do I wait until then or send a letter reminding them they still have until then to comply regarding the other two accounts. What will I do regarding the CCA with terms/conditions? If they exist I really would like to see it/them if I am going to take legal action against them. Was my SAR good enough to request the CCA or should I send them a new CCA request from the templates?

  10. Sorry for the lack of updates (and I do appreciate the response/advice)

     

    RBS went on the back of the ‘things to do’ because of other eager creditors!

     

    I have continued to shovel £200 every month to RBS and to date I have paid over the last twelve months a staggering £2600. My balance owed to them (us) has reduced by only £45!!!

     

    I may as well tell them to shove their kind repayment plan without reduced interest up Stephen Hester’s arse and default

     

    Ive sent them my income/expend sheet, Ive told them how I came about into difficulties due to an accident and Ive even told them what my creditors have done in relation to freezing/reducing interest – all of them have!

     

    Except RBS

     

    Tonight I have printed off another letter to them pretty much covering BankFodders advice and telling them that it will take until 2042 to pay off.

    I put this in my reply their letter

     

    I am prepared to accept this as a full & final settlement of my claim, provided the funds are credited to my bank account within 14 days

     

    14 Days is up tomorrow (14/3) and still no show. Is it reasonable to give them a few extra days, say Friday 16th then fire off a recorded letter stating they have a further 5 working days to pay then if no show, I will take legal action. This I will do without any hesitation. Is it also reasonable to point out that since their ‘offer’ the amount claimed has increased due to interest?

    Indeed mate. I’ve sent them an acceptance letter plus telling them they have 14 days to pay the money into my bank and as soon as it received a donation is on its way.

     

    I’ll update when they paid
