  1. andrew, i had the same problem! im sending off a SAR as we have just remortgaged, so will start the process fully again. i will keep you informed!
  2. what i did once was to call them up and say "oh ive lost my statements and i need them as i need to make sure ive been claiming the right expenses" they might say ok or otherwise just get your account number off them then send in a subject accesss request hope this helps

  4. i filed my MCOL on friday for SPML. just the charges. when i get them back i will go for the ERC. good luck ......
  5. wow wow wow i went throught he whole process. SAR to prelim to LBA to moneyclaim last fri. in the interim they offered me £262 then £ 870. i declined both. i issued my MCOL last friday. when i got home last night i had a letter from them blah blah although no admission is given they will be transfering a total of £4311 into my account with 5 days! i couldnt beleive it. thanks to everyone for their support and as soon as it clears my account i will donate 5%

  10. what do i put as particulars of claim. its on a mortgage account if that helps. i read this You must show the court that: If the charges are to pay for the cost of transgressions that they exceed that and are disproportionate contrary to common law and consumer legislation Or If the charges are the price of a contractual service then the price exceeds what is reasonable as required by S.15, Supply of Goods and Services Act 1982 and so do i just say blah blah unreasinable charges under s.15 of supply of goods act 1982 thanks
  11. wow .... after no offers from loan account people or them or current account. i received and offer of £70 which equalled half the amount i was claiming. i called and said i would not be accepting the offer and as the timescale had expired i would be entering a moneyclaim on friday( payday .... happy days) she asked me to wait and spoke to her supervisor .... a minute later she offered the full £140. Mods: i want to donate ... so can you contact me as to how i do it.

  13. sent my SAR on 7th july. they cashed the cheque on 11th July. still no reply ! called them this morning. they informed me that they have no record of the letter! i pointed out they have cashed the cheque therefore have received the letter. i then asked for statements. they told me its £4.60 per statement. i informed them that thats is covered under my £10 SAR fee. they said no its not. it only covers information held by them about me. i said i assumed that meant statements. they said no. HELP what should i do ???? anyone??????
  14. on my statements i discovered that i had taken out this insurance at the start of my loan. firstly, it was added on to the capital sum. secondly, and rather, stupidly, i didnt realise i had it when i was made redundant. thirdly, they took me to court so the loan finished early. a few questions; 1) surely the premium should have been paid in monthly amounts. 2)were they neglecting their fiduciary duty when not informing me that i should use my repayment insurance 3) as they forced the term of the loan to end early should they repay part of the premium pro rata? if any one has any thoughts i would appreciate your help cheers
  15. they do take you to court yes .... so negotiate with them. they are very strict on payment terms ... i should know lol
  16. you are in control not them! remember this is your timetable not theirs. think of how many times they told you they wanted this paid by then or they are taking charges on x date. they would never say ok i will give you another 4 weeks before we put illegal charges on your account!

  18. it really depends. sent my SAr on 5 accounts to the halifax. i received current account statements 1st (within a week), then credit dard, then loan account after 3 weeks weeks finally mortgage account people asking for £15 per statement that was on 40 day limit!
  19. i have already sent my S.A.R - (Subject Access Request) and paid my £10 for all accounts. they have replied saying they want £15 for each statement and they are now in breach of Data Protection Act. telephoned them this morning and got a very jobsworth woman who then cut me off. so i sent them this .... LETTER BEFORE ACTION Section 7 – Data Protection Act 1998 Dear Sir/Madam Account: xxxxxxxxxxx You have failed to comply with my Data Protection Act Subject Access Request dated 28th June 2006. This does surprise me as I have received my statements from your banking side, credit card side and loan side and all over the same period. If you do not comply within the next 7 days I shall seek a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice.
  20. having received my statements for my bank accounts/credit cards and loan account ... the mortgage people inform me that they want £15 per statement ...... ggrrrrrrrrrrrrrrrrrrrrrrrrrrrr does antone have a standard letter informing them that they can only charge £10 SAR fee thanks for your help ... i just want to get the terminology correct!
  21. i think the answer is yes he can but make it difficult. mention last years letter and ask him to prove he has all the relevant gas elec water certs he should have. and i think there is a new landlords cert in london as well. dont know if this helps but good luck
  22. try saying that as you are in dispute over previous charges they should cease by taking currents ones until the matter is resolved or words to that effect.
  23. it can be a long drawn out process but its worth it. be aware tho that the halifax make you sweat! i sent my LBA before getting £240 ish offer ... i mclaiming 3300! seems 99% with halifax end up submitting moneyclaim but the upside is you get interest! have fun
  24. they refunded the difference between £20 and £12 on my charges so got £60 back. should i go for the rest ? i think so as if they hadnt charged me i would have been over my limit!
