a bit of background 1st sent SAR on 28/6 including 4 other accounts. got the info on other 4 but nothing on mortgage. chased and chased ..... still nothing eventually got to speak to a proper human who started dealing with my account. finally got a letter from them on 23/11 saying there was no record of my account with them therefore it didnt exist. tough titty etc. hmmmmmm so got on to the solicitor who did the legal stuff when we sold the property in 2001 who said that although they couldnt find the exact paperwork, they can confirm that the property was sold and Halifax were paid £xxxxx on 12/4/01! i informed Halifax this morning who said that they will do further investigations. my question is what if they cant find anything? i know i had charges in this period as they were trying to take me to court! if they cant find any record of me having an account with them ..... should they refund the money i paid them??? .... im joking but its going to be fun!

i have to put my full defence in by 9/12. im preparing at the moment. its almost scary but then i think ... ive paid the court fee.... they have my money so i have no further downside!

just handed it in to her branch and they didn want to take it. 15 mins later thye agreed as i pointed out it was her branch! they then stated they cannot guarantee it will get to the right dept. i pointed out that was not my problem as i had handed the letter and the cheque into her branch and they have 40 dyas to comply. they then told me i was being threatening and they were doing me a favour! happy days

SAR being sent today. at last she now believes me even though i got charges back from halifax and cap1 she only realised it would work when she watched GMTV yesterday morning .... funny women! even more encourages after she paid off her b'card then they reduced her limit from £1000 to £260! even though she had never missed a payment in a year!

this "little one" is just for the charges they applied to my account.... only £1000. im pretty confident as it is the same argument as the bank charges case. is your £9700 one for an ERC? i will start my ERC claim when i won this one

yeah i know. its the 1st time ive dealt with solicitors. they seem so clinical. im also brewing up for a £12k ERC claim with them ..... i must admit this is the 1st time im nervous. mind you my only downside are my fees and ive paid them! oh well

i have just spoken to their solicitor SGH and thye informed me that they will be entering their defence on friday ... last last day they have! the court will then send me a questionaire and set a court date. bugger they intend to defend ... oh well i guess itreally will be a case of bring it on and see you in court im almost nervous but very surprised as halifax and cap 1 have paid up. mind you they were all on bank accounts, loan accounts and credit cards are mortgages different?

this is exactly what spml did. i gave them an additional 3 weeks. their solicitor said that was reasonable. it expires this friday! nder law you are expected to be reasonable. so waiting another 3 weeks isnt the end of the world. i called their solicitor direct, then informed the court. hope this helps

i have a letter back from them .... hurrah . says blah blah our findings havent changed from last letter. hmmmmm im asking a different question if brains were gunpowder they would have enough to blow their corporate hat off. only a week to wait till there solicitor runs out of time!!! thats on my charges case

i honestly think as they are a relatively small organisation, the amount of claims they are receiving has hit this solicitor at once. he's asked for more time. it will be the same result chill halifax have paid out on 3 accounts for me now. they wouldnt do this unless they have to.
