  1. Hi Caggers, I put a SAR request into LTSB for the OH and got a couple of replies with conflicting information. The background Part One: SAR'd LloydsTSB and they sent the DPA DSAR application form. I asked for all information relating to a certain account, loans, credit cards and all other information held on the OH. The part that asked for a signature or a branch to pick the information up from, I choose the pick up from a certain branch, as all caggers recommend no signatures. I got a letter from Customer Care LTSB Insurance (for PPI purposes) in Newport on the 16 Aug 10 stating that DSAR was received and they had 40 days blah blah blah and the information would be sent recorded delivery by the 06 Sep 10. Happy days, however on the original DPA DSAR from LTSB I stated I would pick up from my certain branch??? Anyway background Part Two: Got a letter dated 25 Aug 10 from LTSB DSAR Team (received 06 Sep 10), 2 weeks after postage??? That DSAR documents have been sent to my certain bank for pick up within the month. This leaving me not even 2 weeks to pick up the documents (l live abroad by the way and I get all my other letters after about 2/3 days after the date stamp on the envelope, but I'd made arrangements to be back in god's country for the date the information was due, but it's passed). It stated must show letter and passport/driving licence to pick up the documents. Well, I found this quite strange when the LTSB Insurance department sent me the documents via recorded delivery and I received them after 2 days (I signed for them today). I also have to point out that the PPI paperwork also held sensitive personal information, addressees, bank details and medical information. So my question is, why can one department in LTSB send out paperwork recorded delivery (that holds very personal data) without me verifying my identity, when the other department (DSAR team) insist I have to go to my choosen bank to pick the rest up with my OHs identification? Just even thinking about it, surely this must break some laws and open them up to litigation not only for reclaiming PPI being missold (the orignal reason for the DSAR) but for not following their own regulations. If I am wrong, I'm sure what they have done to the OH is illegal?? I only ask as I'm about to write a ****ogram to them and demand the outstanding requested information is sent registered post or I'll take further action with the ICO and possibly court.   3. Hi got the attached yesterday, just need advice on how to proceed as below. First off the this account is in dispute , 1st credit sent me the below paperwork and said pay up. The covering letter didn't have any date on it and it has 4 different options for me to choose from. The first option being if this is your signature , confirm and we'll send you the rest of the agreement. Why didn't they just send the whole thing like they are supposed to? Also a big absence of NOA, default notices, etc relating to the account . Second off on the Breakdown page it had what looked like my signature with the 05 Oct 01 on there, if you look at the company signature and date it is the 04 Oct 01. That is saying to me that the quickest postman in the UK obviously was employed to delivery the agreement for me to sign it the next day??? Third off they sent me only part of the CCA agreement. Unreliable Collections sent me the attached letter asking for an answer on what I'm going to do with the account within 28 days. Now same as above the account is already in dispute. Send them another dispute letter or is there something else I can send them. Because surely NOA, default notices etc should have been enclosed with my CCA? Well after going round the houses to get to the front door, my question is, what next? Send them another account in dispute letter or is there some other template I can send them to say send me everything or I'm not paying? All help as always is much appreciated.   7. Hi CAGGERs, I have another thread on here which is getting congested with large amounts of c*&p from various DCAs/OCs, got this letter off Robinson Way today, see Below. "We refer to your recent request that we cease collection of this account as we are unable to provide the documentation that you have requested. The fact that we are unable to obtain this documentation does not mean the debt does not exist or that we are not entitled to pursue you for the sums outstanding. Your data will continue to be processed in lin with the principles of the Data Protection Act 1998 and the account will continue to be reported to credit reference agencies, where appropriate. If you neglect to make payment to us, further action may be taken against you. We require your payment proposals with 14 days." I was under the impression if there was no CCA, it was unenforceable and that they could not process my data. Robinson Way obviously beg to differ. The account was put in dispute on the 22 July 10, is there another letter that I can send to say do one, the Account has already been put in dispute? And should I write to anyone else to get them to stop my data being processed. Thanks PM
  8. Hi mate, if they ring make them go through your security questions, they get pished off very quickly and say goodbye. Then just for good measure ring the number that they have just used and ask them your security questions again. Once they hang up, ring them back again and do the same thing. They go away. Like many other CAGGERS ignore the letters, I've learnt to from the site. My personal favourite used to be placing them on hold, whilst I went to find myself about 10 minutes later I'd go back and they were gone. Must have cost them a fortune in phone calls (sometimes about 10 a day) before they clicked on, I live abroad! They are mugs and always will be!
  9. Hi got a CCA request back from AQUA, it looks pukka, the wife's signature was on there, statement of account, the old t&c's and new t&c's all included. I'm just curious on the signature page it says 4 or 8, were are the rest of them, shouldn't there be some prescribed terms on there and they say that its an enforceable debt aswell. Is this right?   10. Hi guys and girls, found my original CCA from CrapOne , doesn't have signature block on and refers to paragraphs that aren't there. I s it pukka, not sure about the prescribed terms bit either. Input appreciated. On another note, the long haired colonel, neglecting to tell me about another debt she's been hiding has reared it's head. It's from MLS which I think is part of Moorcroft. The letter came Oct 2009 but she's just told me about it. Should she just ignore it? I'm thinking yes because she hasn't had another letter off them since? And finally I've put up a PPI rebate letter from LTSB stating a £70ish refund. Is it right, from reading on the PPI forums I don't think it is, will put it there if someone thinks it's better me moving it. I've already SARd LTSB this is just a bit of paperwork I've actually still got. Hi MD552 the report was from EQUIFAX, but even my online Experian report which I checked afterwards didnt have anything on either (apart from linked addresses, settled accounts and people associated with me, my wife) and they both used too. And I remember years ago when I got one, that it had my parents on, showing all their finances etc, spouses details, defaults, credit cards (which are now over 6 year old defaults). But now nothing, or should I say hardly nothing. I have to say that I actually live abroad, have done since 2008 but EQUIFAX have got my new address and still no information regarding my old defaults etc very very confusing, or I'm I missing something?   13. Got a postal copy of my Credit Report with my current address on today. Now I was expected a small South American rainforest, neatly packed in a box with my extra old debts and the newer ones. To my surprise I got about 6 pages, with current bank account details, current credit agreements (nil), linked addresses etc and it was only showing 1 default with Crap One. Now I know my older debts (that are still under DCAs) are not showing on there at all, these defaulted over 6 years ago now, nor does it show that I was on a dmp or that I was paying any money at all to the DCAs (up until I found this website anyway). It also does not show some of my more recent defaults from 08/09 (except CrapOne). Is this usual, as I was expecting to see LINK, ROBINSON WAY etc etc on there showing me making payments, but nothing. Not that I'm complaining like. So I checked my experiancredit report aswell, it didn't have my current address on (so I emailed them to change it) and there was nothing. Not even the Crap One default. My question (now that I've bored you all) is there some reason why the DCAs and payments are missing, as I allegely still owe them the money, so technically they should show up? I have a thread with all the info but these questions are more specific regarding my Credit Reports and what they hold on me. Ta PM
  14. Hi BB the link won't work, I think it's the same one that I bastardised yesterday. I seem to get letters everyday now, not that it bothers me anymore (cheers CAG).   15. Yes, I strangely enough actually got one today from LINK Financial (an old debt over 9 years ago MBNA, if I remember without looking). It had the payments that I'd made from July 09 timeish to last month, then the £1 for the CCA and £1 token payment before I put the account into dispute. I did get a statement of account from Unreliable Collections (Simply Be) with a reconstituted agreement (the paperwork is on an earlier post, well the covering letter and agreement). But with Unreliable they did send a copy of all payments made on the account since opening, if this is a statement of account? As for the rest, the state of play is as follows: IQOR (Next) - CCA reply stated the OC didn't have a copy of the agreement, Acct now in Dispute. They had sent copy statements of monthly statements, one does say I've breached the credit agreement that doesn't exist!!! Robinson Way (HSBC) - They are still trying to get the paperwork, doesn't say where from. Acct now in Dispute. They will contact me. LINK - As above, Acct now in Dispute. They will contact me. AIC - Have requested the Agreement from LloydsTSB. Still waiting. Acct now in Dispute. Unreliable Collections - As above, Acct now in Dispute. Not heard anything from them they are still working for Simply Be as I keep getting mail from them, heaping on monthly charges. 1st Crud - They have ignored my Acct In Dispute Letter, and keep sending me Installment Default Notices demanding full payment. I 've just done CCA's to CrapOne and Aqua, as they are piling the charges on aswell, so they can blow me aswell. However to get my credit file in some sort of order, I'm quite willing to do a Full and Final Payment. I know most of my old defaults have passed the 6 year mark (still waiting for my credit report), however the newer ones are from late 08/early 09, however it's better to have them satisfied, then still be hoovering around . And as you say if the older debts have been sold for 6p to the £1, some of my offers will be pretty low. Your thoughts appreciated. PM

Hi BB, I've read the link, makes sense as does in writing bit, no passing or selling on the remainder of debt etc. How do I find out if they actually own the debt or are just acting on behalf of the OC as they haven't conformed to the CCA which would have include a NOA etc? I've bastardised the Full and Final Payment template that is on here with some of the points BB brought up. I was going to use the template below, could someone have a gander and suggest any deletions/additions that may be of help before I send a couple off. Hi everyone, with the DCAs that have replied to my CCA requests with either no agreement held, we are still trying to find it or they have sent reconstituted copies, should I send them Full and Final Payment letters as per the template on the CAG library? It just makes sense to get them settled when I have the chance. If so what percentage would be recommended to start with? I was thinking 10% for the DCA blaggers . Cheers PM
  18. Hi Blueboy not sure about the last paragraph, but when you CCA the DCA use their reference number that they put on the letters they send out to your missus. Someone else will be along to have a look, I'm sure to give you the correct answer on the default stage, costs and interests bit. I don't quite understand Defaults myself. PM

  20. Hi BB will get the DPA template out to Robinson Way, thanks. On the Failed letter, I've already sent this to 1st Credit (they got it last month), however they seem to have totally ignored it! Do you recommend that I send it again? PM Found some Default Notices, I'd posted them on a Invalid Default Notice thread but no one replied to say if they were set out correctly/incorrectly, Could someone please advise. The Capital One defaults are for separate credit cards and there is one from Vanquis. I have blanked out the info and barcodes etc just left the dates and amounts.   21. Morning BB, just to keep you updated on the 1st Credit situation, got two letters they were installment default notices, dated after I'd put in my Account in Dispute letters. They are threatening the usual court pish. Is there a letter I can send to say look the Account is dispute already, therefore I'm not defaulting as you have not responded to my intial CCA request or something along those lines? Just so I can get it sent off tomorrow in the post. Also I got a reply from Robinson Way saying they are having dramas getting the CCA to me, the account is on hold, but we will continue to process your information under DPA. I didn't think they could process any of my information if the Account was in Dispute? Again is there a template, had a look couldn't see one that matched the requirement, or I may (probably) I'm cronically blind! Ta PM

  24. Hi just been doing my weekly check and putting paperwork in order. I've just realised I have sent a CCA request to one address and a Account In Dispute to another different one. The CCA was for 1st Credit, my CCA went to an address in Reigate (on checking the royal mail the address is occupied by a G E Commercial Finance) however the Recorded Letter was signed and was addressed to 1st Credit - is this legal one company signing for another companies mail? and does anyone know if G E Commercial Finance are part of 1st Credit? And finally as I've already sent off the Account in Dispute letter to 1st Credit at Omnibus Bldg, Reigate they have since contacted me via email to give them a ring (I obviously emailed back saying blow me all correspondance by Royal Mail). Should I start the whole CCA process again using the Omnibus Bldg address? Cheers PM
  25. Hi people, think I've messed up on the date with my account in dispute letters, I've put the accounts in dispute as of 20 July 10 (they received CCAs 05 July 10) this was 12 working days. Should I have used the 22 July 10 (to include the 2 days post), if they should have went into dispute on the 22 July 10 should I resend the account in dispute letters again to reflect the 22 July 10? I know it's only two days but these munters can and probably would be picky if it went to court. Ta PM
