  2. [ATTACH]45110[/ATTACH] Thank you for that Brig, do I send a copy to the OFT too? It is definitely showing as two defaults, although as I said the amount differes by £1. I know it is Studio as the date of birth is incorrect on that one. I have screen shotted it, I take it this needs to be included in the letters.
  3. Thanks Renegade, it won't let me dispute it online as it makes me try to sign up for a questions account, then says my email is already in use and never sends me the password for it. Driving me insane. I'm pretty sure the default wasnt there a couple of weeks back in June either as I checked, although it says added may 2013. There is no other debt it could be, I keep a pretty close eye on it.
  4. Would i need to complain to Experian, Call Credit and Equifax? Is there a template I could use? I don't want them to remove the Studio one and leave the MacKenzie due to the dates

  6. Sorry if in the wrong place. I checked my credit file today as for some reason i had an email from Equifax even though I cancelled my account with them last month. I noticed a new default showing as added in May with a default date of January 2012 from MacKenzie Hall, the date of birth is slightly wrong. Just underneath is a default from Studio with the same date of birth, the amount differs by £1 and the default date was December 2007. This was never paid as I was not 100% certain it was my debt, I don't recall owing studio anything when the account was closed and they ignored any correspondence asking them for any proof. I was not overly bothered as I do have a default that was due to drop in June this year and another in April next year, but now it looks like this one will drag on. I'm pretty sure that these are the same debt, what can I do to get the MacKenzie Hall one removed? Thanks for your help.
  7. One more question please, I posted it off last week and will ring the court and make sure it has been agreed this week, will the ccj automatically be removed, will Westcot do it or will I need to do something?

  9. Ok update: Went to court last week only to be informed once I got there that it had been adjourned at the request of the claimant, I never got that letter either weirdly. Anyway, this morning a letter from Wescot arrived, it states they due to lack of documentation if I should sign the attched form agreeing to 1. the set aside, 2. claimants claim to be withdrawn, 3. no order to costs. What do you think, the sceptic in me thinks they just want my signature.......
  10. I have my date for court, 3rd October Thought I would have longer than that as the court have requested a copy of anything I want to use in my defence. I have requested a copy of the summons and claim information but apparently it was filed online and the court do not have the file yet as it was sent elsewhere to try to clear the backlog. For my defence so far I have: Assignment of tenancy showing the date we moved into our current property Experian Credit Report showing 2 loans with provident, both cleared, there is no default from either Wescot or Provident Equifax credit report showing no defaults from Westcot or Provident and a sentence that was added back in 2006 to our previous address saying we disputed accounts after we had moved out A letter from Wescot admitting they dont have a copy of the credit agreement and cannot obtain one I have also requested a statement from Provident showing a clear account, it has not arrived yet. Provident confirmed on the phone I do not owe them anything and they cannot trace the account number given, again this is not in writing though. Anything else I can do?
  11. Thanks Andy, getting worried about this now. I am going to ring Northampton Court to request the paperwork they hold, is it a claim form? And ring Provident to request my statements for them for the last 8 years, and if they have anything else from the address beforehand. I already have the letter from Westcot saying they have no evidence, is there anything else I may need? Proof of tenancy for the last 8 years?

  13. Received notification that it has transferred to my local court today, is that a good sign?
  14. Just a quick update and some help please guys. The court claim they sent out the notification to my current address on the 2nd July, I have no idea why I did not receive them. I have the forms ready to fill in to request a set aside, I contacted Westcot to request paperwork and they informed me that it is from a previous address and dated 2007, we moved out of said address in 2004. I asked them to provide me with any paperwork they held on it. Today I received a letter saying. "Further to your recent request for a copy of the signed agreement. Unfortunately we are unable to provide you with the information. However Judgement has already been obtained against you. Therefore, the court has adjudged that you are liable for the outstanding balance. Please ensure that you arrange to repay the judgement debt asap. Trusting the above clarifies the situation." SO, no it doesn't clarify anything......The court have advised I seek legal advice but I really can't afford legal advice. Please could someone help with the wording on the N244 form, I am really worried I am going to end up having to pay £2000 that I don't owe.

  16. Thank you, I have vague recollections of receiving a letter from either provident or westcot, and asked them to confirm as I have no knowledge of it. Although to be honest I could be getting confused as like I say I have had a few random requests in the last year or so, including one from a company representing Southern Water claiming I owe them from 4 years after I moved out of the previous address. I had to send them tenancy agreements before they went away. I also had some court paperwork about 2 years ago, again for something from the previous address and they could not provide any proof of the debt. I didn't keep any of the correspondence from that though.
  17. Thank you, how would I request the paperwork from the court? They don't answer the phone, also is it possible to request redetermination as it is within 14 days? Or is that only if you admit the debt and can't afford to pay it?
  18. I received a CCJ this morning without any pre warning. I am slightly annoyed that I did not receive the opportunity to defend this as I had asked the company involved to provide me with information on the alleged debt a few months ago with no response. The reason I asked them is I have no knowledge of the debt they are talking about and I get the feeling that it may be from our previous address (which we moved out of 8 years ago) as I receive odd requests now and then. When I query them the dates are always a few years after we moved out and nobody can provide me with any paperwork. In this case, the claimant is Westcot, who claim to be acting for Provident Personal Credit, I have been a customer of Provident in the past (recently finished paying a loan with them), and I definitely don't owe them anything now, as far as I am aware. Anyone have any advice on how I can get the court to look again, I don't want to pay £2000 that I don't owe. Thanks

Thanks Gary, I have a complaint going through with Candy, who seem to think that they cannot guarantee when they can get the part and if I don't like how long they are taking then their answer is to buy the new machine at a discount from them..... Domestic and general are also trying to hurry it along (probably as if they cannot repair they have to refund all my payments to them). The problem is Candy just are not really very interested, they say (and I have looked at the warranty info) that they have no time limit to adhere to, which just seems bonkers!
  20. I think you misunderstand, I have a policy that is still valid with domestic and general but as the parts are covered by candy they only supply the labour.
  21. Hi there Thank you for your reply, candy provide a parts warranty, domestic and general provide the labour warranty, it is candy who cannot provide the part needed so that domestic and general can carry out the repair, I hope this clarifies things.
  22. 3 years ago I bought a Candy washing machine that had a 5 years parts only warranty provided free of charge, the machine was making a bit of noise on spin in december so I called the compay who then sold me a domestic and genearl policy for 1 year to cover the labour charges. 24th December the engineer came out and stated a bolt had sheared off of the drum so we would need a new drum but because of xmas and ew year may take a few weeks. We then received a new repair date of 8th january, the day before i received a phone call to say they were having trouble with the part and as soon as it came in they would contact me with a new repair date. I have since phoned them every couple of weeks as never hear from them, last week they stated they did not want to keep me waiting any longer so offered to deliver me a new machine at a reduced cost of £179. They seems quite surprised that I did not see this as accepable seeing as I have a 5 year parts warranty on the machine I have that they are failing to honour. I can't get any sense out of them, domestic and general (rightly I think) are saying candy are wrong as they cannot provide the part so I think I am going to have to take them through the small claims court as it has been 3 months now! Any advice would be great, also is it unreasonable to try to claim for use of the launderette for 3 months? Thank you
