  1. Did they bring any of this up with you when you handed the car back in person or has all this been done retrospectively? What repairs are they? Is it to do with natural wear and tear or more serious issues? How long did you have the car? In terms of the number plates were there any distinguishing marks on them from a particular garage? For example from a dealership? (the mercedes dealer where you bought them?)I think all number plates these days have a bar code on them which tells the DVLA or police where they were fabricated? and maybe when? I know my 'newish' ones do but i'm not an expert on that. I wouldn't pay anything quite yet until and if you can get more info from them, depending on what you have already.

  4. Crem, thats great thanks, the wording on the CCA etc.. is as you put it 'in stone' that we shouldn't have to pay anything more if it fails to meet their valuation. We will have paid 50% on 4th April 2010 which will fall roughly when we give car back and they and we are aware that there is only £140 outstanding. They've been very good about it. Just wondering therefore why so nice!? Guess we haven't done owt wrong tho. But thanks for your post. I shall get all the paperwork out again to re-check. Helford, Yeah they seem to be handling the VT very well, no probs. When you sent them the VT and they replied did they give you an option to return car or for them to collect? That's what they've done in my case but to pay £110 for the priviledge of collection. I've just sent back letter stating that we shall take car to them. maybe should have waited to read your post!?? Never mind? Did they go over the car with a fine tooth comb when collecting it?
  5. Have sent a letter to ICO and copied it in to Welcome - hope that was a good idea. have also sent the letter to the persons who's details I recieved so we shall see what they have to say!? On another note still wondering about claiming my PPI, gap, medical, emergency cover etc etc back from my previous account, figures on previous threads. Any template letter or how to calculate what they may owe? Cheers

  7. Hi beyond, the scumbags! Really sorry to hear your news, just wondering where you were up to with them when this happened. Know you had raised many issues with them and as it seems we are in a similar baot, want to try and protect myself. You've been very helpful with my thread so far, don't know how I can help you with this at the moment but if you could give me a heads up that would be fantastic. My situation is (hopefully) ineffective DN and therefore TN. I sent VT, which they said couldn't carry out cos of DN and TN. I sent yesterday the unlawful repudiation. I haven't paid since End Dec 09. Had arrears on account from before. Did they have a court order to take your car? Had you paid the 3rd of agreement or 1/2?

My girlfriend is 23months into 48 month agreement. Impeccable payment record. Has sent VT. Everything fine. BCT acting well. Couple of thoughts on it though if anyone around here can shed any light - do we apy them £110 to collect or drive 1 hour to leeds? (car has few minor scracthes - which I'm trying to iron out). Secondly when they sell the car at auction we would be liable to any shortfall in £ to their value. Any loopholes I should know/ scams/ how to play this? Help apprecaited

  11. Hey, My girlfirend is 23 months through a 48 month HP agreement with BCT. She has an impeccable payment record with them and she has now requested to VT when the next payment is due as she wants a new car on better APR etc.. BCT have promptly sent the relevant documentation back to VT, with the obvious scare mongery about potential repair costs etc if the car ain't in good nick. Now there are a few scratches etc.. that I will try to iron out best I can plus 1 damaged alloy wheel. Again as I say I will ensure getting the car in best repair possible without spending too much. Now the 2 problems/ dilemmas I have is firstly do we pay the £110 for them to collecty the car and hopefully the collection company won't follow procedures and check the car properly and just take it? Or do we drive it down to Leeds to one of their depots and see what happens. We live in North East so it's only roughly an hours drive away so to drive car would save £. Secondly is their statement in us VT'ing that if the car doesn't mean their valuation, then we would be laible for the difference the actually makes at auction. How does this exactly work and are there any loopholes I should know about or scams they may try and play? Any help greatly appreciated. Thanks in advance

  13. Ozzy, or anyone, Going back to my post #26, do you have any further thoughts on can I claim all insurances back or is it just PPI? And on my statement at the bottom of the post, why does the insurance credit not come off my outstanding balance?? Letter regarding unlawful repudiation sent rec. del. Yesterday, same day the welscum branch manager phoned me to try and help me with my account!!! laughable. Didn't answer the phone, was just a message left. I presume I shouldn't talk to them over the phone and keep everything in writing?! Wonder why they are phoning me when they've had a 'contact only via letter' letter.
  14. Well I have edited the letter above for my details and when I send it today recorded delivery, I have said I must get a reply by 8th April 2010. Plenty of time for them, me thinks!
  15. There isn't anything for me to claim at them moment is there? Guess I'll just go down FOS route. I am liable for arrears, I can't fight them??????? the only fight maybe is outstanding amounts from a debatable VT date to when agreement is terminated full stop. Are you trying to claim money back?

  19. So should I send them the same letter as you posted on the previous thread? Therefore saying yes you have sent me a DN and a TNand I accept it. Therefore only (potentially) owing my arrears. They are not going to come back and say you accept DN and TN which therefore means you accept full balance???
  20. I think maybe I'm a little lost on this now. I read your thread regarding your own DN etc but it's till a little cloudy. So what exactly am I telling Welcome by sending them the same letter you sent regarding your DN and TN. Would I not be telling them that they are correct and I whole heartedly accept their decision? Or is it a bluff? what does repudiation mean? Dumb day!
