  1. Thank you all for your advice I will take note. I think we will try it on a temporary trial and see how it goes,he may even miss us at home and want to stay full time,he may just need that couple of weeks break. Thanks again its very complicated

Its a hard situation as I do want my son to have his space and be happy and do not want it to come down to money.I have another two children so I dont think I would loose and housing benefit/council tax benefit but im guessing that I will loose my income support for him and also child benefit. I wouldnt sign over my carers allowance as he would be here over 35 hours a week so if I think correctly I can still get it. It sounds awful like it is all about money but I dont want to get in a mess financially as its hard enough

  4. three days a week,he has Aspergers and is at an emotional time in his life with his hormones kicking in. I want to point out that this is not about money but merely advice on how it would all work out,I asked on another well known money forum and got shot down in flames So im a single mother on income support and also get carers allowance/middle rate disability for him. His nan is 59 and has just been made redundant after 40 years of work and now claims job seekers/housing benefit/council benefit. At the moment she only gets single persons rent allowance but if my son goes to stay there friday to monday can she claim for more rent,she says she can but i will have to sign over my benefits to her to prove to the council she has him living there. Now i know only one person can claim for carers allowance and as he is here more than there (or will be if it works out) i will carry on the claim but i take it i will have to sign over my income support/child benefit to her? Im unsure as its not full time and we no longer have a benefits office nearby and our CAB is never open,thanks

  7. Ive had back a letter which reads the following and they have sent me an unsigned CCA agreement... In relation to your request for a copy of the executed agreement under section 78 of the consumer credit act 1974 under regulation 3(2)(b) of the consumer credit (cancellation notices and copies of documents)regulations 1983 there is no requirement to provide a photocopy of the agreement bearing ypour signature,it is sufficient that we supply you with a true copy of the agreement setting out the terms and conditions to which you have agreed. A true copy need no bear the debtors signature or in our case the date of the agreement. We are therefore enclosing a true copy of the credit agreement sent out to you when the account was opened. What now are they right...thanks xx:mad:

  9. ooo its so much fun when they do turn up.Tell them they have no legal right to be there,they are trespassing and next time make a damn appointment. Ask them to prove the debt is urs then step back and watch them squirm its so much fun Dont fret they rarely turn up anyways xxx

  11. Im sorry I know this is in the wrong place and have been directed to a post that explains cca's and what they mean but im still not getting what happens re banks and overdrafts. Im not very literate on legal jargon and sections this and that but have asked for a cca for an abbey overdraft (was 1800 whilst in work is now near on 3000 due to loss of job and interest they have charged) This morning all i received was a very badly photo copied bank account agreement which is only signed by my partner and not me (its a joint account) I cant even upload it as it is terrible print and think I will have to go into my branch an request another copy. So basically are overdrafts covered by a CCA,can I claim back the charges even though the high court ruling ruled in the banks favour or can i get the whole amount written off due to the CCA not being correct. Sorry I know ive posted this somewhere else but I really need it to be seen so I can take it further,thanks xx

  13. I have/had a 1800 overdraft,lost job and it is now nearly 3000 due to charges. I followed someones lead from here and requested a CCA and this morning all I received back was a standard bank account application form and only had my partners signature on and not mine. Cannot scan it as I can barely read it myself the print is that bad. Is it enforceable? Can i request another copy that I can actually read??

  15. If bailiffs have the court documents then yes they can gain access,you can only turn them away if they dont. Im unemployed also and the debt wasnt even mine but somebody who lives here but they still turned up
  16. I would not ignore this letter,Bryan sent us a letter for a debt that was only 300 and within the space of a month he had managed a CCJ and a date for bailiffs to arrive on the dorrstep. He is very quick and will carry out his threats,it happend to us at Christmas
  17. Thank you although i am not very good at putting words together I will write and tell them that the signature they have is not my partners true signature and therefore the cca is void until they sort it out!

I write in response to your requset for a copy of your executed agreement and statement of account under section 78 (s78)of the CCA act 1974. You are correct in stating that we do not need to request a signature for your request under S78nof the CCA.However for data protection purposes we request a signature to confirm your identity.As your address matches the one we have on the system I will proceed with your S78 request.. I enclose a scanned copy of your original agreement with Capital One.Please note that this sets out your name and address at the time you entered into your agreement with Cap One.Prior to signature you were provided with a full copy of the terms of your original agreement to keep and were sent a further copy of your original agreement with your credit card. (the application was done online and my partner does not recall signing anything) I also enclose a S78 statement of account which is set out at the end of this letter. We are currently in the process of retrieving a copy of your current terms and conditions and will send this to you shortly. The balance on your account remains due and owing and it is important that you continue to make at least the minimum amount set out in your monthly statements. Failure to maintain payments may result in collections activity and a defualt notice being recorded on your file with the CRA. If you are using or considering using the services of a claim management company we refer you to the warnings issued by the Ministry of Justice with regard to misleading statements issued by some of these firms about their ability to get debts written off. Statement of account Your account is in default and the amount currently due and payable is £960.49,you must continue to make payments on your account. Under section 78 we are not required to provide a copy of the default notice and statement of default. However we can confirm that a statement of default was issued on 8th Decemeber 09. Capital One have written it on the back of a letter about default notice,thank you both for your advice.I would like however to write some sort of letter letter Cap One that the signature is not my partners and therefore the CCA is void. Should I also send the DCA an account in disupte letter? thanks xx
  20. Hmm just looking at the account in dispute letter and it seems you send that if its been passed on to a DCA.I need something that says its not a true copy because its not the proper signature?? Any advice is great ta Just looking at the letter again,they entered it into default on 8th December 2009 and states that under section 28 they are not required to provide a copy of the default notice and statement of default. It took them over a month to send the CCA agreement and what they did send is not my partners true signature and now this morning he has received a CapQuest Debt Recovery letter
