  1. first of all, the store card that appears twice- this is illegal. it originates from 1993? if so, when was the account terminated and last payment made? second, the small accounts are probably worth offering a full and final for ease. a settled account is still a defaulted account and looks as bad as an unsettled default, so make sure its on the condition the account is fully removed from your crf. but play dumb about the debt and explain the default is restricting your access to credit, hence you are prepared to full and final without admitting liability. what dates are the defaults?
  2. We're looking at a gorgeous house that is perfect for our family. The agent is asking for proof of addresses for the last three years and previous landlord references. But they have pulled a new one on me- the requirement to produce photo ID ie passport or driving licence for "anti-money laundering regulations". What a load of tosh! Is this becoming the norm these days?
  3. RW definately own the account. LBA on its way later this week. I'm not having my credit file marred for another two years by a solitary default for a mere £400.
  4. i'm going to have to send an lba. they have now closed the accont but refuse to remove the default stating the account history has to be accurately reported. this is despite the fact they have no proof the default is accurate.
  5. i find the 5 years in scotland is disregarded by most card providers. quote the fos guidelines in your claim http://www.fos.org.uk/faq/businesses/answers/before_we_get_involved_a7.html
  6. original creditor. in other words, whoever gave you the loan/card/etc.
  7. Eh? I can't even get a decent rate credit card with a 4 year old and a 5 year old default on my file, let alone a mortgage. Rip off Vanquis is all I could get.
  8. if they refuse then go to the fos. interest is at 8%.
  9. with those figures i would definately reclaim your premiums plus interest- very handy to help when you're on maternity. cancel your ppi immediately. write to them requesting a refund on the grounds you were told you had to take the policy otherwise your mortgage application would've been refused. did your doctor sign you off with stress or depression?
  10. are your mortgage payments up to date? you're working again, aren't you?
  11. i would keep up the payments just now. why have they not paid out on you losing your job? i'd take it to the authorities if you feel you have a good case for them to pay out. saying that, you might get more money reclaiming your premiums, i don't know. edit: just saw your other post. presumably they have a clause stating they don't pay out if you're sick through stress.'ll do anything to not pay out. i'd go to the regulator to complain about the situation.
  12. i'm not too hot on the overdraft situation. i don't think there is anything you can do. they gave you plenty of time (approx 3 months) to pay it off, and as they state, they can ask for repayment on demand. the only sort of route i can think of would be to appeal on the grounds you had asked for a refund on the grounds you believed the charges were unfair, but the supreme court appeal ruling was only made on 25th November, so you feel it was unfair for them to default on the basis of awaiting the supreme court decision. does that make sense?
  13. just depends if sky report on well maintained accounts. they might only report to one cra. they may only report on negative payments.
  14. i would guess it does just check electoral roll and previous addresses etc.
  15. i'm slightly concerned that the fos wouldn't take my complaint as the account began prior to the formation of the fos. how would a court look upon the fact i have the t&cs, and even though i don't recall signing any agreement for the ppi, they clearly state the conditions i have highlighted that the ppi wouldn't cover?
  16. first of all, i would say court is probably a long way off. second of all, what kind of debt is it? how many payments are you behind?
  17. Wrote to Egg recently asking for refund of overlimit and late payment fees plus statutory interest. Received a response today stating they would only be refunding the difference between the £20 charged and the current £16 charge. They also appear to only be considering the charges from the previous 6 years. In addition, they have said they will pay the pittance refund to the DCA who bought the account. Said DCA threw in the towel many months ago, closing the account and removing default from CRF. Icertainly won't be signing the full and final acceptance slip enclosed with the letter. What next? How do the FOS usually go with Egg?
  18. lowell bought my egg account. i told them it was unenforceable. they tried to refer account back to egg. egg refused. lowell threw in the towel and account now closed and default removed. its so so satisfying.
  19. in addition, i complained about the fact the ppi premiums continued to be charged to the card for 8 months after the account defaulted. how can they possibly charge a card that has defaulted?
