  3. has anyone successfully claimed compensation from a cra for inaccurate info on file? i asked all three to remove an inaccurate default placed by lowell on the grounds the default date was two years late. cras contacted lowell who said the default was accurate. i asked what checks cras made to ensure accuracy of data to be told that as part of their contract, creditors and dcas must ensure data is accurate. i complained to the ico about the date of the default and the ico investigated with the oc and upheld my complaint. defaults have now been removed but i fancy shafting the cras and feel i have a good case for compensation.
  4. I doubt very much our tokens were paying her debt, if it was thats downright criminal from SP. Its bloody ridiculous that a standing charge can't be deducted from the next credit after using emergency credit. I wouldn't say the emergency credit function was used all that much.
  5. Its only for about £20, but its the principle. The landlord had run up a debt on post pay, so had a pre-pay installed, and as far as i know a percentage of each top-up went to paying off her debt. When we moved in she had the account changed to my name. We were only in the property for three months and the landlord moved back in the day after we moved out. I never took a meter reading and she changed the account back to her name. The night we moved out the meter was in credit, but low, so i flicked the emergency button. At most i reckon it would've used £1.00 of emergency credit overnight, but thats a push.
  6. please someone, can you explain how the hell i have been sent a final bill from scottish power, when the electricity was on a pre-payment meter??
  7. flexi-loan went to a dca, can't remember who though. f+f for somewhere between 40-50% of the total due i think.
  8. standard with banks, particularly at weekends. if you have two payments due on a sunday, one a so, the other a dd, the so will be paid on the friday and the dd should only be paid on the monday. however, the bank deduct the dd amount from your balance at the end of the friday, but it doesn't actually get paid til the monday.
  9. well, its only taken them a year, but the ico have ruled in my favour. a bit miffed though, as the the oc cahoot basically said that "due to the length of time that has elapsed since the debt occurred and the debt has now been sold they have been unable to establish why the default was not filed sooner". the ico are taking no action against either cahoot or the dca lowell, as cahoot have already removed the default and are liaising with lowell to have them remove their default. time to ask for compensation from lowell...
  10. i think i would need to pay for that. my gripe is the fact that if it was a personal or small business account, they would just steam roller through the takeover. obviously a major corporation's money is better than mine.
  11. does anyone have a great email address for complaining to bt? have been on the blower through 150 and just get the usual runaround. I need someone high up and who isn't in an outsourced call centre in india. anyone have knowledge of bt policy? long story short, 7 weeks on from the due date, i'm still waiting on my services being transferred to my new address. stumbling Block seems to be that the line was previously rented By a major corporation, and as such bt can't force a takeover of the line.
  12. give them a wee while to look into it. i've found santander to be quite reasonable to deal with regarding refunds.
  13. definately sar them. ask for a copy of the signed agreement, the t&cs at account opening and as varied, a copy of the default notice, details of when and how the default notice was dispatched. are there any unlawful charges or mis-sold ppi?
  14. sar them. ask for a copy of the default notice and ask when and how it was sent to you. is this a credit card, overdraft, or loan?
  15. why don't you think its the original agreement? can you post it up?
  16. when applying for council tax benefit, is the benefit calculated on just the council tax element, or the council tax plus water and sewerage elements?
  17. it doesn't matter whether you make paments, the default must still disappear after six years. the default date clock can't be re-started. personally, i'd ignore the letters for another year or so, so the debts become statute barred, unless of course you live in scotland in which case the limitation period is only five years. and of course that depends on whether you've actually acknowledged the debts are yours since they defaulted.
  18. apply to the issuing court to have the ccj set aside. explain you never received the court paperwork in time. explain your dispute over unlawful charges, and that the fos backed your claim.
  19. whybother, go to the ico regarding cahoot. this is clearly vexatious. if cahoot had a problem with your dmp then they should've defaulted you 3-6 months after your dmp started.
  20. wrote to egg again. they still no budging. what next?
  21. in feb i complained to the ico about cap one and their failure to provide. the ico have just the other day written back siding with cap one. their decision is based on the fact that i had moved house but hadn't informed cap one, and the request for a signature was reasonable to identify me, despite the fact my signature has changed considerably. before the account defaulted, i moved house and i forgot to inform cap one. they sold the account to RW so i am not going to inform cap one of subsequent address changes, am i.
