    SORN passed to DCA

Ive had an £80 from DVLA re not sorning a vehicle. I have sent off the sorn, not got a reply and left it till I recieved a £40 fine. I wrote to the DVLA (recorded) they escalated the fine to £80:rolleyes:. I then wrote again,no reply. It went to a DCA, wrote to the head of department (DVLA) explaing the car was SORN and using the template on this forum, no reply. Im on my last DCA letter (the third), whats the advice on this? Im not a repeat offender, never been in this situation before even though I own and tax several cars. I resent being criminalised and made to pay a fine whilst Im trying to communicate with said department. £80 is alot of money to pay out for maladministration Where do I go from here? Any advice would be appreciated. Fwog
  2. Hi Thanks for looking- but the knowledge that the blue badge doesnt cover over night parking cleared it up for me. Fwog
  3. Good stuff! I wish more word smiths would convert simple points into legal speak for bureaucratic edification:D I look forward to the reply you receive. Im currently being criminalised for loss of paperwork. I've even re-iterated the cars status (SORN) in a registered letter which has been ignored. The DVLA needs a grass roots overhaul. Its faceless bureaucracy at its finest. Fwog
  4. Thanks for the reply. I didnt know there was a limit on the badge parking:confused: I thought the council would have provided a carparking space as its in a main road. The new TRO is causing all sorts of problems with parking, the council are reviewing it in 3 months at the planning meeting, not that it will change anything:-x Thanks again Fwog
  5. Hi Just a query really on the position of disabled parking. The council has reduced on road parking by nearly 80% in my area. This leaves five parking spaces. We have a neighbour has a disabled sticker, who insists on parking on the legal spaces, rather than the double yellows (even though this is over 20 yards from her door). I don't think there is any mediation with its neighbour, so therefore asking politely is out of the question. As I stated in my previous post, a parking ticket has been issued from the local council to me. Due to the lack of parking, is there anything I can do in this situation? Best regards. Fwog
  6. Right , heres the update as promised.... Had a call from the council (after much chasing) they had sent an officer to measure the lines (not really the point ).the legal department had written to the trafic office stating that nothing needed to be done as the lines correspond to the TRO. I explained that it was in reference to the previous lines, but this had been underlined in the e-mail sent to the legal department and was poo-pooed. Thanks for the input! Fwog

    SORN passed to DCA

Lol:D But seriously, if I ran a business in this manner, I'd be typing this from Pentoville Prison:evil: I spoje to an operator yesterday, I wanted to clarify why they'd ignord my letter. They said all correspondence was passed to the DCA. I said I'd posted the letter in Dec ,the DCA letter came in Feb! The convesation went.. me 'the time scale for passing to a DCA. Does a letter thats posted in December usually not get responded to till Feb?' Op 'Oh yes' Me' Im recording this converstion so I'd advise you to respond with accurate answers' Op 'CLICK..Brrrrrr' :D:D Its better than timeshare! Fwog

    SORN passed to DCA

Mmmmmmmmm.... I would go with a court case. Effectively the DVLA are ripping people off in the knowledge of what you have written Buzby. If enough take a stand, there must be a fundamental change at the DVLA. I have complained to the DVLA before and only received platitudes of '..we are trying to improve our service' and '...we do apologise for the inconvenience. Well I dont think theyre doing enough off their own back, therefore, the only way to get them thinking would be to go to court.I will win and they can foot the costs. Obviously an internal memo will be created as to why they ended up in court and this will carry far more weight than a mere 'end-user' complaint. Firing letter off to head of Midland DVLA to that effect tonight. Fwog
  10. Well done Titleist! Its time we all took these grey beuraucratic institutions to task and ask 'what exaclty am I paying for?' Would be even better if we could make the fine stick. I was driving home the other night and started to count up all the fines you can now amass that you didnt have 10 years ago, you know, non-court based incidentals'...parking (clampers), unreasonable speeding tickets, SORN declaration. You add it up ,if you got hit with all these in a month you wouldn't be able to pay! One up for the little man! Fwog

    SORN passed to DCA

Hi Didn't get hold of the PO today. What would be the situation if the letter was received and they just passed the fine to DCA? I did post notification of the SORN. The letter stated this and I also stated the refusal to acknowledge the DVLA's right to fine me.Do I fight it in court? Or open new communications with DVLA and this time send it recorded? (not registered) Im peeved to be put through this process by the DVLA. Would I be able to ramp up costs for time and inconvenience? Fwog

    SORN passed to DCA

Hi Conliff Thanks for pointing that one out, it was a DCA and not Bailiff (used the term at the top of headed letter). Just had a look for the receipt and I seem to have shredded it (have one for something else where this one should be :/) I can go back to PO and get a copy of the number , Im sure they would have a record. I assumed (wrongly) that as it was recorded, it would be delivered not lost. Maybe this is the case? Is the time scale usual for this type of thing? Will have a word with PO for my next post. Thanks again Fwog

    SORN passed to DCA

Hi, Had a £40 fine for not SORNing a vehicle before Christmas. I had sent off a letter to the DVLA prior to declaire the vehicle off road. Having read the threads on this forum, I sent them Sorn template letter. This letter was sent recorded on December 15. I've had no contact from the DVLA, neither acknowledging the letter or responding to it. On Friday, 13 February, I had a recovery letter from the bailiff for the sum of £80. Any ideas on where I go from here? It's nearly 2 months from posting the recorded letter, and probably three months from receiving notice that the fine had Increased to £80. Any ideas would be appreciated. Best regards, Fwog
  14. Just a quick up date............ Rang council and advised on the differing lengths of markings, getting back to me Monday after speaking to their legal department.....:D:D Will post back results good or negative ,just so there's a bit of info for someone else's edification. Its getting interesting:p Fwog
  15. It just p***ed me off that they can bugger-up there own charges and not respond the my letter, but when the boots on the other foot Im expected to jump. Theyve had the letter for 3 weeks and it still hasnt been read FFS:evil: I can afford to pay them but I thought I'd play their game and do everything legally, but when it come to playing the game it doesnt seem to work as they own the ball:? 16. Hi all, A addendum to my original post..... I had an outstanding bill for 3 years of CT. Paid the biggest bill before Christmas. Was charged for using a debit card by BS. Bailiff also over charged by £35. Phoned bailiff, they said deal with the council now its settled. Rang council. I said 'I have a payment plan for the two outstanding years, but I have been overcharged for the satisfied bill' they said send the letter in and we will take it from there. Ive sent the letter in, stating that I will proceed with a small claims procedure in 7 days if I dont receive a reply. Guess what? no reply, and committal proceedings for the two outstanding years. Ive rang the council and explained Ive held the payments until I get an answer on the original letter. They said the letter (posted on the 5th jan, over 3 weeks ago) is still sitting in someone's in-box and will be dealt with. In the mean time I have to fill out a means questionnaire on the back of the letter and get it too them. They have got the dates of the payments wrong too, I said £15 a month and they reckon its a week. Any ideas anyone?????? Fwog
  17. The man in Dorset must have been in a very bad place. He was looking after his elderly mother, business collapsed around him,no income of his own, then a bailiff turns up with a locksmith. I agree with you Ellen, why wasn't this guy flagged by the 'caring' services when it had gotten to this stage? Why did the bailiff continue with a illogical pursuit? This guy was in a corner and snapped. Surely this will be a turning point for the bailiff industry? Its floundering and blundering into mistake after mistake. There WILL be debtors. There WILL be people who CANNOT pay. Am I the only one seeing this? Action needs to be taken, its real people now, not numbers on a page. Fwog
  18. Dorset. POOLE MAN GUNNED DOWN HIS MOTHER I dont know if anyone has heard but this happened recently Direct result of baillif action. It is distressing so be warned....Here Im sickened and saddened that this is still happening in a modern society. You can post all the 'fors' for bailiff action but the matter stands ,twice in a month people have died. If I was a bailiff, I would be looking for another job, credit crunch or not. Fwog
  19. Well Im stuffed! Rang the council today, they were very helpful with the TRO information. It seems they have advertised it the press(no surprise there) but as for the notices, theyre not obliged to display them its an 'extra' so they said. It seems the original order was for 180 ft from the junction ( back in 1975) the original line painter only brought it to 120 ft, so I suppose I've no argument on that one:roll: Oh well. time to bite the bullet. Fwog
  20. Oh that was a good one!!:D Don't tell me, election on the way? Public losing confidence?Headline grabbing by newbie minister? Take your pick. Prisoner on island UK lol They even said.. How would you pay the CSA if you cant get to work??? You couldn't make it up, really! Fwog
  21. Hi UR4S This sound off the scale. I hope you got the P.C.'s badge number. If you havnt threatened violence they shouldn't attend. Its a gross waste of tax payers money! So they actually got the police to search for your van and pull you like your a threat to the public? I cant see how the achieved this if its registered in your flatmates name? I would say you have a right to complain to the MET on this one. It doesnt sound right at all:???: Best regards Fwog
  22. Hi Hallowitch Its a good leter but dont give them too much information. Keep it succinct and to the point. Try to keep to the legal bits and not explain yourself too much. Hang fire a bit, hopefully an adept word smith will post you a streamlined version. Like I said, its a good letter, but your not dealing with reasonable people;) Best of luck Fwog
