  1. hi Green and mean, You are right, I didn't trawl the local press for notifications, at the same time, there was no notifications posted on lamp posts, anywhere in the area. I would be surprised if they could amend an existing order, without notification, it would be the same as getting an extension granted. And then building, a three-bedroom house as an addition. I will contact the relevant council department to see if they can clarify what is existing and any amendments that have been made to encompass the new line markings. Just another point,surely amendments need consultation, as well as existing orders? I would just need to know this, in case I go off half cocked;) Best regards. Fwog
  2. I've searched for the relevant documentation and it seems the date is 4 days ago. There wasn't any notification of the new lines going in. This was one of the points raised when the council painted the new lines. There was talk amongst the residents of looking into the documentation, but I suppose that went by the wayside, and this parking ticket has forced my hand. I think the road resurfacing project forced the council to paint new lines, then apply for retrospective permission for new traffic restrictions. Crem, if you want me to post you a link to the documentation, I can do.I will start an appeals procedure, and also lobby for reasonable parking before the TRO permission is granted. Many thanks to your replies, it gives me a bit of ammo, and the possibility of being able to park outside my own home once again. Best regards. Fwog

  4. Thanks Crem. I think that covers all the points to a tee. It just annoyed me that we're not issued with parking allowances or anything and the council still expect you to own/tax/use a car and not give you anywhere to put it:mad: Bloody jobs worths! Fwog
  5. Hi New to this forum not to the site Just need a bit of advice really. I have been issued with a ticket for parking on double yellows. What I'm not sure about is the legalities of the council issuing tickets. The car was parked outside my home and the ticket was issued on a Saturday morning at 9.30am, we never see wardens around here (let alone a Saturday morning) and we have had no problems with parking in over a year (since we moved in). The council recently resurfaced the road and removed 12-14 parking spaces in the process through new double yellow marking. There are four spaces left in front of a row of 12 houses (all without drives). What I want to query is: Do I have any right to park in front of my property to unload etc. and do the council have and obligation to provide reasonable parking proportional to the homes adjacent? Also, is there anyway this ticket could be revoked? We have all discussed the loss of parking since the road repairs. It just seems the council are now using our predicament to finance it:shock: Cheers for looking Fwog
  6. I offer my condolencies to the family first. The fact remains as Chris said you learn to idenify as you go along. Ive managed retail outfits for the best part of a decade for the first leg of my career and you do learn this as a skill. There are no excuses for this. The guy could have done a deferral or payment plan,vinstead he marched the poor old guy to all the cash points he could. Disgusting. If anyone in my family (god forbid they ever thought of debt collecting) did this, I would be typing this from Winston Green. This needs to stop. People are getting hurt for cash. Fwog
  7. Ditto. Explain your a student, you will have to pay something, so work out a realistic offer to make the council, say £10 a month. As Chris said , if they've not seized anything, the balls still in your court. Make sure you don't sign anything for the bailiff, don't let him in and open a communication with the council.   8. That's a load of faff! Hes being informed there and then its not the case, how can he say that? What a donkey! Get a Statutory Declaration on the car from a solicitor. Its £5 and will officially establish ownership of the car for the bailiff. In the mean time, move it away from the house, if possible. You can find template letters on this forum for a Stat Dec. Just add you own info to it, sign , witness and you just made a bailiff cry Fwog
  9. Just add my tuppence wuth.. Its in the bailiffs interest to lose your cheque and/or fumble a payment as it puts them back in the driving seat. Its a simple contract that you agree to when you initiate the first payment, therefore, if you miss (onus on you to prove it was their fault), you are in breach. The full balance can now be called in. Incurring more charges, more letters and more reasons for bailiffs to exist. Cheques are abit of a dodgy way to pay, as the bailiff can say the clearance date is when you satified the payment eg. you send the cheque for friday, it doesnt clear for 5 days, Mr Bailiff says your in breach by a week...Knock at the door. Really dont give them any excuse, it really annoys them;) Fwog

  12. Hi Rad No, this is not the case. State its your parents home and make it clear you have no assets there. They still will come out with the old rubbish like' you've not heard the last of this' and 'we will be back with a locksmith' etc etc etc. In reality (which is light-years from 'Bailliffland') they cant do a thing. If you have a car, hide it. Transfer the ownership to your dad if you have to. Im sorry to hear of your plight, in these stiuations (CSA) there never seems to be any winners. More advice should be forthcoming, other members are better versed in this type of action;) Keep posting ,mate. Fwog
  13. Make a payment to the magistrates direct. Explain your situation to them ie your health, self employed status and see if you can get a schedule of payments from them. Try it ,they may accept. Fwog

I think there will be a few more like me in the comming months, trigger fingered finance departments firing off letters half-cocked.   15. Ah! Chris, You didnt see the dates. The bill was for this property but for before we moved in, over six months before. I wont bother lifting a finger on this one, I can see any court in the land backing BG on this, Im just giving them enough rope to hang themselves !! (laughs, loudly and manically) Just wanted to air,maybe a new tactic? or to show how BG maybe acting now they cant increase the gas prises any more:D:D:D:D Thanks for the reply ,Chris,hope it will give someone a bit of direction.   16. Just thought I'd share this one with you all.......... Had a bill from British Gas today stating that 'The Present Occupier' owes £140 on an outstanding gas bill. The bill is for 10/2007, we moved in here Easter of this year. 4/2008 . No correspondence from BG before this at all, now here's the best bit, the letter was dated 18/12/08 stating that the debt has been passed to the bailiffs already, thats nearly a MONTH ago! .I never thought BG stooped to these tactics. Well, Mr Bailiff will get a nice wasted journey and hopefully, BG will send me a nice bunch of flowers for the inconvenience and embarrassment caused . All it would have took was a phone call, its on our bill that's been registered against this address since we moved in! You couldn't make it up really:rolleyes: Yours smugly Fwog

  18. Well the 4% charge is evidence of that;) I just htought that your post was a great bit of info. A 'did you know' or 'bailiff tactics' thread would be apt. A lot of the posts are repetitive questions, just post it all in a sticky to outline the basics if ,say ,your due a visit tomorrow, as many new posters are.   20. I didnt know that. I think a sticky with 'Bailiffs tactics' is in order, this being the first post. The reason I say this is - there's a basic framework a bailiff has to adhere to. A lot of the posts on there are an imaginative interpretation of that framework by Bailiffs. Ergo, there are only a few points a bailiff can get you on. The rest of their shmooze is mostly smoke and mirrors Just mho Fwog

  22. Well you hit the nail on the head. Your the perfect target to these 'people', (i really dont know how a bailiff can do his job and the go down mc'ds at the weekend and happily feed his family from someone elses misfortune, it would make me gag), taxpaying, law abiding,home owning easy money. You criminaize yourselves if you tow the line in thsi country and you criminaize yourself if you dont. It would be a good idea , considering the amount of debt these people create, to calculated the amount theyve defrauded people of,with this charge, bet its a tidy sum. I might go to Companies House and download thier returns for last year. See if that can give me a figure:cool: Letter being composed, putting in asbestos envelope as I type.:D Fwog

It gauls me that in 2009 you can still get comments from members of the public, like the one above, regarding 'people' (yes the inverts were meant to be there) conducting their business ,legally licensed by the local authority!!
