  1. Its a try I learnt here. The problem is that the company needs prove of sending! If they can't do that then the default is out of the way. If they can its tough and he has to wait for 6 years of the first default notice.
  2. I am currently with the information commissioner to get the default out of the way. I just said I never received a letter warning from the company that they put me on default. With a bit of luck that helps. But its a long process. 1. Write to the original company insisting on removing the default as it is wrong. good luck

  4. You have the right of compensation. The amount depends on the length of the journey. Usually 250 EUR of most european destinations. See EC regulation 261/2004 Art. 4. Write to the airline demanding a compensation of the amount of 250 EUR.
  5. There is an important judgment from 9th of July 2009 from the ECJ (C-204/08). Baltic Airline is taken to court although the airline argues that it can not be taken to court in a different EU-memberstate other than where its head office is. Now the consumer has the right to say what country he wishes to take court action. Regarding Ryanair it is not clear that we can take them to court whatever EU-country we wish.
  6. I work in the private sector. Now I need to discuss with occup. health my health conditions. Previously it was not a problem but now they say I need a referral from my manager or HR dept. I do not want to tell my manager the details of my health conditions. I phoned HR and told them that I need a referral. They said they can't do it, it has to come via my manager. What can I do now? Any suggestions? Thank you very much for your advice.

  9. I took Ryanair to small claims court in the UK (because I live here and I thought it is easier than Dublin). Ryanair confirmed the UK address but argues that it does not trade there anymore (since 30 May 1985). So it feels not responsible regarding contract. Can somedy let me know if Ryanair has been sued through the UK courts? Any help would be nice.

  11. I just wanted to let you know that I have been successful with my complaint against the NHS employer. A while ago I posted that I will go alone through the court without lawyer and it was the best thing I could do. The court said it takes 8 days for full hearing and I played the game. It feels really good to get justice and the tribunal was really good.
  12. My qustion related to credit card payment. I can do the rest later but want to take it up with the credit card first as it might be quicker. Any arguments regarding liablity of credit card and "forced" payments?
  13. I would not argue with pregnancy. I am disabled and occupational health knows it. When I spoke to them a couple of weeks ago they were VERY VERY cautious with me and I know the reason is being disabled. If I were your husband I would check with occi health the needs before the hearing starts and then go in the hearing with the new information from occi health. It might be worth to postpone the hearing until occi health was involved. That should work.
  14. Hi there, I got a question regarding clamping. Parked my car on my own rented car space underground. New parking company came 1st of this month and clamped my car. Only a tiny little sign shown at the end of the garage regarding clamping. Despite that during the clamping procedure the parking company's van parked outside at the garage door so nobody could get in and out. They did threat of towing away if I do not pay. Now I paid via credit card and need some basics to get the money back via credit card (unfair trading?). How is forcing somebody to pay amounting to the fact that the credit card is liable? Need some infos and arguments. Thanks
  15. Being pregnant is no disability. Furthermore you have to show some sort of harassment and I find that difficult. That would mean that your husband needs to show that other people would be treated different when they are 3 minutes late. I would go and negotiate an extended lunch break, maybe consulting occupational health before the disc. hearing. Case C-303/06 ECHR

  17. Hi, I wonder if you could help. I had unpaid parking tickets. It went to the bailiffs and I made a regular repayment with them. Now I decided to pay the outsdanding 4 tickets (excluding the bailiff fees) directly to the council. They accepted it. Now the bailiffs want more than 100 pounds but have not be specific what for. What do I have to do now? Some fees are not justified and wrong so I am not willing to pay them. Any suggestions on how to stop them?

  19. A friend of mine did lend 500 pounds to somebody and now she moved, did not pay it back and don't answer mobile phone calls. I would like to trace her for the money but do not want to give the matter to the solicitor as it's I want to save cost. Is there any chance I can get information via the council of the last know address without getting a court order against the council to disclose information? Would appreciate any help.
  20. Got a student loan and paid it off last week. Got a letter from student loan company that if I want to remove the CCJ I have to send a 15 Pounds fee to the local court. Is there any other way of removing the CCJ. Can I just leave it and then they have to remove it themself? Would appreciate any advise on this. Thank you.
  21. No it is not. I am in a similar position. Either take the settlement or leave it and take them to court. But you should be careful as the dentist is in a better position in court.
  22. Hi, I got a question regarding fees of debt collection companies. I got 4 different parking ticket issues. I did pay instalments with the debt collection company but then decided to pay it off directly with the council. So obviously there are still some fees to pay (some of I do not agree). However, the debt collection company tries to argue that I paid only 3 tickets off (instead of 4) so they avoid to add the fees seperatly. What can I do now?
  23. Barclays called me and I complaint to Ofcom as "silent call" because I couldn't think of anything better. That stopped them!! Silent calls (when you answer the phone, there is nobody there) | Ofcom If you do not have the number just type in the customer contact number of that company. Should work! Good luck!
