  5. Hi darryl 1960, I am pretty sure you have to apply to the court for a notice of discontinuance , the cost of this comes out of your own pocket iam afraid. Wiser heads iam sure will confirm this Regards Sham

  8. Hi Ell-enn, Nice to hear from you again. No it was ajourned with leave to restore. So they did keep to their part of the bargain on that but not on the solicitor attending and adding more costs. Iam sure if she wrote a good well drafted letter to them she could force them to capitolise the arrears , what do you think ? Kind regards Sham

  10. Thanx Benny, Yeah, they phoned her and said that after reviewing her account her payments had been spot on for the last five years up until her current problems , so as a gesture of goodwill they were prepaired to offer her that deal Such kind hearted people:roll: Sham

  12. Hi All, Been a cagger for a good while now and have been helped with my own problems by the good peeps on here , and in turn i hope i have helped a few with theirs. Anyway, this is not my problem but that of a good family friend whom i had noticed had seemed to be carrying the weight of the world on their shoulders. After a lot of persuasion i finally got it out of her. Her mortgage is with gmac and she has got herself in to arrears to the tune of £6,393.00. she managed to negotiate with them to pay a lump sum of £2000 off the arrears and then pay them £150 per month on top of her contractual payment, if she did they would stop the court hearing and no solicitor would attend. You an guess whats coming next...... she didnt attend but the solicitor did and charged her for it. real sweetharts aint they !! I advised her that she should firstly write to these cowboys and complain about the attendance of their solicitor , and secondly remind them of their obligations under new government guidlines, as i know she is going to struggle to pay the extra £150 a month and would be better off requesting a payment holiday and capitalisation of the arrears. She did say that she felt intimidated by gmac over the phone ,and felt bullied into finding the £2000 and agreeing to the £150 a month. Any thoughts on this guys Thanx Sham:)

  15. Hi All, picked up my post this morning after returning from a rather large stint of working away. Had one from the court !!! opened it and guess what ? **STRUCK OUT** !!!!!!!!!!!!! WHOOOOOOOOOOOOOOOO:D:D:D Huge thanks for all who have helped me with these unreasonable toerags. Special thanks to PT2537 the man is a star , also 42 man who helped me get this whole thing going. But my biggest thanks and a massive round of applause goes to creditcardmug:grin: Mate, i could not have done it without you , thank you so much for all your help. Hi all and ccm, Ok, phoned the court this morning and asked if the claim had been struck out , and was told by the nice lady in the court section that my faxed request had been put in front of the judge on the 10th of september. This is the best bit guys !!!! she said "i cant tell you what the judges decision was, as all the files are in the cupboard and you wont know until we get to them at the end of next week , as we have so much of a backlog we are still working on cases from the 1st september" Can you belive that !!!!!!!!!!:-?:?:eek::grin: def going to expload !   20. Hi All, Sorry about not updating sooner but have been working away. I feel realy nervous now about ringing the court to find out the outcome of my strike out request , but gonna ring them in the morning and see what happened. Just feel let down by the whole legal process , as it seems to favour the big boys rather than joe soap. Regards Sham
