  1. Hi Guys, Thanks for the replys, i sent the aos yesterday so they would get it today. The date on the envelope was the 23rd so i would have got it on the 24th, so it actually took eight days to get to me. I work away so i didnt even know it was there until the 30th. fingers toes and everything else crossed and see what happens. Is there any appeal process in place if they say its to late ? thanks for the help Guys

  3. Hi 42 Sent the aos off this morning,gauranteed next day,and am also just going to send the cpr to the solicitors, recorded. Just aquick question,on the claim form from the court the issue date is the 16/5/08 but the post mark on the envelope is 23/5/08 am i right in thinking that the post mark is what counts as far as the fourteen day timescale is concerned Thanks mate
  4. Hi 42, No they did not not send any letter before action. Do i have to send the cpr request to the solicitors acting fo nr ? How do i acknowledge the claim and do i say that iam defending the claim or admiting the claim or what ? Sorry, this is new to me and i dont want to make a mistake
  5. Hi All, I have been a member of cag for quite some time now, and with all the first class help ive had, ive been able to sort out nearly all my debt problems except one.NORTHERN ROCK . I had an unsecured loan with them for £13000 in 2001 and until recently had always made the required payments of £130 per month. I have found it almost impossible to get my instalments with them lowered until i got back on my feet,and was about to cca them to buy a little more time,when i recieved court papers through on the 23/5/08 In the claim pack there is also a copy of a default notice that they claim to have sent me on the 2nd april,which i never recieved. Any help with this would be gratefully appreciated Thanks Guys
  6. Hi BSC, Thats a shock about thee bailliff not turning up on friday with a locksmith:D I think if they return the debt to the council it becomes "nulla bono",or uninforceable by the bailiff. Because you have already made payments to council you have shown that you are trying to pay,and no court would even consider commital to prison under those circumstances. Drop tomtubby a pm regarding what to put on your form 4,she is very good at that sort of thing
  7. Hi Sarah, What you need to do TODAY is write to the council (recorded) explaining your situation and stressing you are a "cant pay" and not a "wont pay". Ask them to take the debt back and remind them that they have aduty of care towards you and your daughter,its important to mention the duty of care aspect as this can carry a lot of weight:)

  10. Not sure if there is a template on here,i googled "FORM 4 COMPLAINT AGAINST A CERTIFIED BAILLIF" The only thing i would add is if you have any vehicles park them away from the house until this is sorted.regards mike If my posts have been helpful,please give my scales a click
  11. Thats not going to happen sarah,if they do call,which i doubt they will,tell them (through the letter box) that the wont be coming in. If they still will not go phone the police and tell them there is somone at your door who wont go and you belive there is going to be a breach of the peace,dont say its a bailiff,because if you do they wont react as quick

Well they have nothing then.No walking possession,no valid levy,seeing they can only come in by peacefull entry,which you are never going to let them,they are screwed I had a similar problem with my council,after getting advise from here i wrote to the bailiff company telling them i was considering making an immediate form 4 complaint to the court,copied this to the council saying that i was disgusted at the way their agents were acting,and also reminded them that they had a duty of care towards me and my family. Give it a try, it worked for me:)
  13. Hi Sarah, This is exactly the state they like their victims to be in,everything these people do is based on instilling fear and intimidation,when in fact they have very little powers when it comes to council tax

He cannot force entry into your home,without first having gained peacefull entry , which he hasnt He has no walking possession,so he cant attend to sieze goods He also has no valid levy You can also submit a form 4 complaint to the court about his actions Just calm down,there are some great heads on this forum who know more than me who will be along to help you soon:)

Hi All, just a quick update on my situation.Got my mortgage arrears down below two payments,and phoned my mortgage company to ask them to cancel the hearing for the19 may (had already sent them a proposal by recorded delivery,to which i have had no reply). They have said that iam not below two payments, as my mortgage has come down by £70 per month two months ago(its libour linked). I have had no notification of this from them,and had not checked my statements as i work away,they then said they would carry on with the hearing to "secure their position" even when i pointed out that when the arears were accrued it was under my old payments,which would put me £140 below two payments missed,he said that if i paid him another £140 he would cancel the hearing. I just cant do this as ive already paid them £1,300 this month:mad: Any advice guys
  18. HI Hunter, Firstly dont phone the council,put a letter together requesting that they take back the debt under their duty of care to you. Also stress the point that you are a "cant pay"and not a "wont pay" and feel that if the debt stays with the bailliffs your ability to resolve your arrears in a resonable amount of time with the council will be almost impossible.Dont forget to send it recorded delivery I hope this works for you,it did for me:-) If this has helped please give my scales a click

  20. Hi All, A friend of mine who is a self employed builder has a problem with sherforce,and iam so annoyed at what these people have done to him that im asking wiser heads here for a little help. Long story short,he owed just under £2,500 to a trade supplier for materials part of which he disputed,anyhow after a bit of twoing and frowing it ended with a high court judgement against him.Sherforce turned up at his home on friday of last week and told him unless he paid the ammount owing they would be back to break in on tuesday.anyway he panicked,and after running around friends and family to borrow the money, sent a cheque to sherforce for £4,200 Sherforce has added £1,700 in fees:eek: I have got him to send them a sar for a breakdown of fees,but what realy winds me up is that this guy made one visit to my friends home,told lies about his powers,and walked away with £1,700 for twenty minutes of Bulls**t

Hi All, Sent the account in dispute letter that saintly 1 supplied to fredrickson international,explaining that the account should not have passed to them as allied international were in breach of my cca request. What i did notice was the cheeky tw**s (allied international)took my £1 from my cca request to them off the debt before passing it to fredrickson. Is this normal practice for these dcas
