Hi All, Ok , just had a look at a few snippets of info on here and across the net. It seems that if they did try to start another action i could possibly defend using henderson v henderson (1843) which boils down to "they have had their chance and blown it" The argument would be that it has been before a court of competent jurisdiction(ie -it had the power to hear the case) and it has now been decided any comments on this would be most helpfull. Hi All, In June i had court papers from nothern rock for an unsecured loan , and after a lot of help from my fellow caggers managed to get the claim struck out. This morning i had a phone call from them asking when i intended paying my loan with them. I explained that they had already started procedings and the claim against me had been struck out. "Yes, i know that" said the nice lady "But we are still allowed to chase you for payment" Am i missing somthing guys ? I know they can restart procedings at any time, but what i think is happining is there are two different departments a few months behind each other following the same procedure leading up to issuing a claim. Any thoughts on this. Kind Regards Sham

Thanks Bona, not to sure how to delete that mate ?. Any comments on what type of of game these people are playing would be more than welcome. It seems to me that maybe they know they cant dictate things as much as they used to , which can only be a good thing for the people who have been ripped off by these sharks over the last few years. Hi All, Quick update. She had a reply to the first letter that was sent out , in the post yesterday , it says. "Before we can refer your request for consideration to our head office we require some information. Can you please provide a payment proposel stating the amount that you feel you are able to pay for the foreseeable future.We also require you to fill in the enclosed budget form (thats already been sent:evil: ) As your mortgage is on an interest only basis a term extension will not affect the monthly payments. ( no mention of a payment holiday or capitalisation of arrears as requested ) Once we have recieved all documentation ,we will refer your request to head office. What a load of tosh !!!!! What makes me laugh is the letter she had yesterday was dated 26 nov , (sent first class no postmark,i dont think so !) The letter threatining court action was dated 2nd dec:-o Any thoughts guys Regards sham

Hi All, Just a quick update. Ok... The letter that Ell-enn kindly drafted was totally ignored (suprise surprise). Yesterday she had a letter from these toerags saying that she had broken the agreement and unless she brought her account up to date within the next seven days court action would ensue. Now iam thinking the best way to deal with this shower would be to fire off another letter saying how disapointed she is that there was no reply to her request for help , this would add weight to her case if it went before a judge and showed that they were refusing to help. Any thoughts guys ? Regards Sham
