T-MOBILE CCJ - don't know about it?!?!

Just a point BerryN. It is my understanding that you would need to have the CCJ set aside first, before going down the CCA/S.A.R - (Subject Access Request) route. I believe you would have good grounds for a set aside as the CCJ was issued at an old address and therefore you weren't aware of it. I would suggest you fill in the N244 form to have the CCJ set aside (the cost for going ahead with this would be £65) and take it from there. You may like to know, also, that mobile phone contracts are NOT covered by the CC Act - see this stickie in the mobile phone forums Mobile Phone Companies & CCA -
Er - right chaps. Perhaps I should just amend the last paragraph to:- "I will have no option but to make a complaint to the relevant regulatory authorities"?

Hi Oneofakind Don't know whether you'll be disappointed with this or not - but I just put the number into Google and it came up as "Space Kitchens". However, I am aware of these people and they're most annoying. It took us ages to get rid of them - they ring you up and try to get one of their salesman to call on you. I think probably what is happening is that the have one of those automated calling systems Hope that helps

I wonder if someone could help me on this. I had a mobile phone with T Mobile approx 4 years ago and due to illness was unable to pay them. I had completly forgotten about this debt and have now recieved a letter from a DCA asking for payment. My memory was not good at the time and I am unsure as to whether I paid this or not, there is no mention of this debt on my credit file. I do not want to contact the DCA by telephone as I have heard many horror stories about them. Having read the notes at the beginning of this forum, I see that I would not be able to rquest a copy of the CCA from the DCA as mobile phone contracts are not covered by the CCA. Could someone advise me on what I can request from the DCA to prove that they are entitled to collect this debt? Or would I just need to send an S.A.R - (Subject Access Request) to T Mobile? Thanks

Yes! I have sent an SAR for two accounts and only sent one payment of £10 as they were with the same OC. I simply put both account numbers on the heading of the SAR

Yes, letter N Creditors and DCAs - Letter Templates & Budget Planner At the top of the letter type I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY - and at the end of your letter TYPE your name, DO NOT SIGN. Send the CCA letter to J B Debt Recovery recorded/special delivery with a £1 postal order crossed and made payable to them. Make sure you keep the receipt. With rec/spec del, you can check on the Royal Mail website and print off a proof of delivery. Hope this helps Good Luck -

Apologies for hijacking, however, I am in the same position and therefore, am reading with interest. I have received a copy of a CCA which is the same as the original CCA I signed, presume I now SAR the original creditor? -

Angel49 I have just read your thread and am disgusted that this type of situation should arise in this day and age. What an excellent result, well done, you must feel very proud of yourself. There may be many more elderly and vulnerable people in society today being ripped off in this fashion - have you thought of talking to the newspapers? -
After reading the info on here (and looking at the "Current Active Viewers" box) it has made me a little uncomfortable as if we can register on this site, so can the DCAs - I would be extremely wary now of giving too much information - especially on private messages, you could be talking to the "Men In Black" and not know;)
