  1. Hi manf! The madness that is the return to school is over! I'm a bit less stressed. So ruthless have 5 more days and counting before they have committed an offence? Nice going! I'm about to update my thread but I'll let you know here anyway. I got a letter today from Capquest, in reference to one of my shLittlewoods accounts. In short they have returned the account back to Littlewoods. Thanks to Curly for the BOG OFF letter (which I tweaked slightly) which helped do the trick . deedee xxx

I'm at AQ stage now too for shAbbey and Haliprats. £200 to find after a two week holiday abroad - yiiiiikees. I guess waiting is the game now. If they apply for a stay, get an N244 Notice Application in pronto. Hope you're well otherwise. Are your boys back to school this week? deedee x
  5. Hi manf. I'm exhausted! have come back from holiday (which had a nightmare end) and then gone right back into the swing of work. Coupled with getting the children ready for school, you've got one tired woman here :o I have Curlyben's letter more or less ready to go with a few amendments to make. To be honest I am a bit overwhelmed at the moment. The fight is still in me, my body is refusing to keep up. Crapquest and Littlewoods can kiss my backside at the moment How are things with you? deedee x
  6. Hola Kenny!!! Didn't realise that I hadn't caught up with you yet. I've been away for over two weeks, so I'm still trying to catch up. I swear I posted on your thread? I don't know - half of me is still in Spain! I may as well update my thread whilst I'm at it. I received the Allocation Questionnaire relating to my Halifax case this morning, which needs to be submitted by 17/9/07. Also included was the Halifax defence. I had already received this from their solicitors (it was amongst the 3" thick pile of mail waiting for me on my return). Nothing else to report on this case anyway. Hope all is well Kenny and congratulations once again. Dxx
  7. Hi Conar! I've been away for two weeks. Came back on Tuesday to find that a date has been granted for a hearing on September 24th 2007. It is expected to last 20 minutes. I'm going to prepare an ultra mini bundle which will basically consist of the letters I have sent r.e. my CCA request, my credit file entry showing the incorrect spelling of my name and their AOE application which was applied for a full 4 months after judgement was granted plus anything else that I can think of. It is extremely annoying to have to go through this but I'm not backing down on this one. I will update this thread again after the hearing, unless something dramatic happens before then. You will see from my Capital One thread, deedee1310 v Capital One that I am also wanting them to have the CCJ obtained against me set aside too, for similar reasons, as part of the settlement for my claim against them. I'll keep pushing as I'm not forking out another £65 for an N244 Application. Best of luck with your claims. deedee

  9. CONGRATULATIONS KENNY!!!! You're right - I have been a stranger . You are a great help here and I'm glad it's finally been recognised. I am back from my holiday now, so I am allowed to be on here now. I am a CAG anorak, so my odd post whilst abroad was very restrained. Anyway I will be keeping closer eye on this thread once again.   10. Sorry to bump again but I would really love some advice from any successful Cap One claimants. I am currently trying to put something together, addressing their settlement letter and setting out unconditionally what I will accept as settlement of my claim. I will not be accepting the cheque when it arrives because a. I do not owe them any money b. They have failed to address my point with regards to CCJ removal c. They have removed the default and exchanged it for late payment markers which to me is just as bad. Looking forward to hearing from you. deedee

  16. I should add that I have not yet posted letters to Capquest, so will amend them to include what ODC has just said about not dealing with them, due to Littlewood's non-compliance. Thanks guys.

  18. Hey CurlyBen. I did wonder at the plethora of Scottish accents (I called a couple of times to make sure today). I'm ok, just didn't fancy having to take on Capquest again :o . They are sneaky and underhand but as I know how they behave, I will do everything within my power to make sure that they don't get as far as the CCJ stage. Littlewoods are in criminal default of my CCA request. I don't believe for one moment that they assigned by debt on 12 Jan. I think they have put this in to cover themselves. What do you think my next move should be? Should I report Littlewoods to Trading Standards (Consumer Direct)? My guns are still smoking from my last duel with them I have sent CCA request to Capquest today, in the first off, to start tying them up. Your opinions as always, would be greatly appreciated deedee x

  20. Hello all. I have finally started my Littlewoods thread! I will try and summarise what has happened so far, since my first CCA request letter, sent in my early CAG days - oh have I learned a lot since then! June 2007 I held two accounts with Littlewoods - 1 catalogue and 1 Flexible Account On 12 June I wrote to Littlewoods requesting a copy of my CCA under sections 77-79 OF the CCA 1974. They had until 26 June to comply with my request. Needless to say they did not. July 2007 On 23 July I received letters for each of my former accounts, dated 19 July, from Littlewoods. In one letter it stated that they would not be pursuing the outstanding balance but would note it on their internal file for future reference. The letter for the second account interestingly did not say that they would not pursue the account. It just stated that again the outstanding balance would be noted on their internal file for future reference. At this point Littlewoods were a few days from committing a summary offence under the CCA 1974. I thought that this was the end of the matter - it was not to be August 2007 Having arrived home yesterday 28 August, after a two week holiday, I find letters awaiting me from Littlewoods and Capquest. The letters from Littlewoods (one for each account) were dated 12 August and state that the outstanding balances were legally assigned to Capquest Investments on 12 January 2007 (really?!) and that all communications blah blah blah, should be directed to them. Also attached to Littlewoods letters, were letters from Capquest themselves stating that they had purchased the debts from Littlewoods. I needed to make contact by 17 Aug or account would be sent to their solicitors. Funnily enough, their letters were also dated 12 August :-? Well as I was away, I was unable to comply with this (not that I would have mind), so another letter from Capquest dated 24 August which is entitled LETTER BEFORE ACTION. I have until tomorrow, 30 August, to come to some arrangement with them. Well yah boo sucks to them!!! It is an amalgamation of several letters that I have sent for various other matters and credit goes to the original authors, from whom I have borrowed excerpts. So there you have it Oh - forgot to add that whilst we were away, Capquest were calling at least three times a day, to the point that my brother-in-law recognised their number off by heart (he did not know who they were). I only know it was them because my phone logs the last few calls received. I called the number today and was greeted by one of their representatives. On their letters they put their 0870 number. Their proper geographical number is 01252 576 300. Here ends my first post! deedee x

I see the big guns are still with you (ODC, Curly, dpick et al) and you seem pretty chilled I've been away on holiday for two and a bit weeks but was reading your thread (when I got half a chance) - yes I am sad, I know! I am finally going to start my own Littlewoods thread as I've had a flurry of activity whilst I was away and they've passed my account to Capquest (eeuuch) despite stating that they wouldn't pursue me for the debt. I hope you'll all subscribe! Ho hum - at least I know I back home. There's nothing like a bunch of letters and DCA phone calls at 8.30am in the morning to bring you back down from your holiday high!   22. BUMP!!! Hello guys. I would really appreciate some advice on how to proceed now. Cap One think that the matter is resolved but they have another thing coming. For a start they still think I owe them £440.11 which is incorrect. I'm beginning to get a little tired of all the fighting and letter writing. I have checked my credit file and they have indeed removed the default marker on my account, but have changed it to settled instead and put late markers on the account file, which were previously not there I wouldn't have made it this far without all the support from CAG members so I am calling up members of the Cap One forum to give me some advice. I'm off to re-read Tanzarelli's thread as he had a similar battle with Cap One. deedee x
  23. Hola todas! He vuelto de España hoy! I have returned home today, to find a settlement letter from Capital One. They have rejected my claim for CCI but have agreed to pay the following 1. All the purchase interest ever charged on my account 2. Interest owed to me under s.69 County Courts Act 1984 3. Court fees 5. Penalty fees. Total payable £1430.05 - 440.11 (which they reckon I owe them - I do not) = £989.94 They have agreed to remove my default but not the late payment markers . They have not mentioned the CCJ removal that I have requested either. They state that I had opportunity to correct any misspelling of my name on my credit agreement (actually it was an APPLICATION FORM). I have a copy of the form which they sent me as fulfillment of my earlier CCA request and my name was spelt correctly on the form, so I had no need to correct it. I will not accept the money until they have calculated what they owe me correctly and that they acknowledge that the late markers need to be removed as does the CCJ. Welcome home deedee!

  25. Hola MacBoy, Tilly, Dusary, Kenny and all the usual suspects! Bienvenidos a flaminscott! Soy en Espana! Two weeks away from the forum was more than I could bear! It's lovely here weatherwise and otherwise and I'm even browner than I usually am . MacBoy have a lovely time in Bulgaria. I am back in Ingleterra on Tuesday. No doubt I will have a stack of letters awaiting me I'm pleased to hear that you now have a date for your N244 Application against Haliprats. I'm hoping that amongst my letters will be a date for my N244 against CapQuest. Haliprats managed to comply with my request well outside the 40 day limit (at day 60 I think). I received over 20 envelopes with statements. I think my request was easier as I opened my accounts within the last 7 years (2001 I think was when the first one was opened). Keep up the good fight. Yes I am a sad Internet and CAG junkie but hey old habits die hard! I just thought I would send muchos besitos to my fellow Halifax and Saarf London CAG buddy, from Spain. Will catch up properly upon my return (and yours too)! Dxx
