  1. Hello Van. Buenos tardes de Espana y muchos besitos a tu xxx I am sending you some TLC long distance! I'm sitting in an internet cafe writing this message inbetween checking my bank balances to ensure that I have not been charged unecessarily! I have a PDA but the roaming data charges are extortionate. I have had to use it whilst away - no doubt I will be facing a huge bill when I get home. Yikkes!! I'm hoping to have a spare flat in Brixton soon so you're more than welcome to use it Well done for getting some money back. I can't really think of another strategy for you at the moment. In your Letter of Appropriation did you mention your mortgage payments? I'll regroup my thoughts when I get home and hopefully come up with some ideas.   3. Hi Rae May. Sadly I could not find any call blocking software for a Samsung D600. If he had a higher spec Nokia or SonyEricsson, then there is a plethora of options. If he changes phones any time soon, let me know what make and can re-advise. BTW I'm off on holiday (hence my slow reply - been busy packing etc), so if you update I may not be able to reply until 29 August.   5. Hi Loz. just catching up before I go. I'm off to Spain for 2 1/2 weeks . Well done for getting your computer sorted (did I mention I used to repair PCs?) I have 10 1/2 and 9 year old girls. Yes, having family is helpful, they've spent a few days each week with my little sister, at my parents. I haven't updated my thread properly so I'll do it here. My N1 was deemed served on 20 July too. No GOGW has appeared. Even if it did it would be for a derisory amount and in any case, I'm going for default removal too, so I need to claim my claim whole. I received a letter a few days ago from Abbey stating their intention to apply for stays on claims that were currently ongoing. Yesterday I received their defence and it appears to be their standard one. The court sent me notice that the acknowledgement of service had been filed. On the form where it states the address for service of documents (Abbey's), it's blank . Is it Lambeth CC being ridiculous or has anyone else had this? Remember if they do apply for a stay, you should complete an N244 Notice Application and ask for it to be removed Application for removal of a stay - UPDATED TO ACCOUNT FOR OFT TEST CASE. So this is my Abbey saga summarised to date. I will try and resist the urge to log in but hey if I find a wireless hotspot (up in the mountains - hmmm) then I'll pop by.   8. Hmmm. N244 take longer to process anyway because they have to go up before a judge . I submitted mine against Capquest on 16/7 and still haven't received a thing. I was told last week that it was going before a judge but from experience, unless you're being evicted from your home, I know that it won't get "fast-tracked" . Hang in there. The postal strike isn't helping either. deedee
  9. Hi guys. Don't worry I have my N244 Notice Application - already prepared. It's just that I will have a 2 & 1/2 week lag now, since I will be away. Hey MacBoy, Sunday was great!   10. Hi everyone. Kia I sent it back to court today by courier - cheque enclosed! Today I received a letter from shAbbey stating that they will be applying to the courts to seek a stay of legal claims until the test case is heard. The test case is specifically regarding unauthorised bank charges. My claim relates to penalty and unauthorised charges. What they fail to realise is that I often had an unauthorised overdraft due to their penalty charges. Added to this they would charge me penalty charges because I didn't have enough to cover any DDs and STOs due to their unauthorised charges. I think that this is pretty much the case most of us here found ourselves in. I don't know if Abbey have successfully applied for a stay of my case yet. I will call the court tomorrow. However I am away for two weeks from Monday so will not be able to do anything until the end of August in any case. I will keep you all updated............ deedee

  13. Hey Jo. Good to hear from you. Likewise with being busy with school hols, etc etc. It's amazing how quickly the time is going. I'm losing track of where I'm at. Jetting off in 5 days so am focusing on that. I've seen the campaign to write your MP. I went to the Write to Them website but it does say "Use your own words (new window). MPs will ignore copied and pasted 'identikit' messages." I need to adapt the letter as MacBoy and I have the same MP! I will write when my mind is more focused however, I am behind the campaign all the way You'll be fine Jo and you know it. You need to stop underestimating your abilities. You're one of my "bestest" CAG friends! Anyway my lovely, must dash. My eyelids need toothpicks to hold them up. It's not good to do things when you're tired. Did you see my Cap One post?   15. Oh dear! I might have to consider the Court route, however, I would like to avoid this if at all possible, for the moment. I've spent a lot of money on fees recently. I'm going to keep reading and researching, as there must be other statutes that could force them to remove this rubbish. Oh well like you all, i'll keep plugging away. deedee

  17. Hey Conar. Have you had a hearing for this yet? If so, what was the outcome (sorry your thread(s) is on my list to read ) I'm thinking of going the "I will report you HM Treasury (Criminal arm)" route. I've been told that this is not threat to use lightly as they will turn the company/bank over to find the agreement. However, I know there is no agreement. I have it in writing from them, so I am quite prepared to do this, to get the desired effect. I will use this as a last resort. deedee

  19. Hi Rae May. Rory has asked me to look in. My brother had huge issues with HFO too. They called my parents house (he doesn't live there anymore) and threatened to send "bailiffs" round to the house. Needless to say I sent off a stinky well adjusted Telephone Harassment letter, which I can post here (it's based on the template letter on the site) and sent it off. The calls have stopped. If you could find out from your son what phone he has, I can tell you which software he can buy to block the calls. Let me know. He doesn't have to stop answering his phone. I have it installed on my mobile and it works a treat. The same software can also block unwanted SMS messages from these parasites too. Look forward to hearing from you. deedee

I included points on setting aside my CCJ that Cap One obtained against me and default removal. Delete as appropriate. Just goes to show that on this forum you can't tell how old anyone is or their gender either (for the most part). Cheekycherry, sorry to hear about your friend's daughter. That's awful but it sounds as though she has a warm caring immediate and extended (you) family around her, to ease the burden.   23. Don't worry JB. I was supposed to file my N1 on 19/7/07 but had to delay due to spreadsheet error :o. I filed my N1 today so you'll get to do it when the time is right. £120 is a lot to find . Including this action, I will have spent £360 to bring action against Abbey, Halifax and now these lot. With the uncertainty regarding bank claims, I have to accept that the money owed from these claims will not be forthcoming as soon as I have liked, but there you go. Get your claim in as soon as you can. Yell if you need anymore help. deedee xx

  25. Hi Kenny. I'm off to read your thread in a bit. Saw your PM but have only just got home in the last hour . Littlewoods have already defaulted me (circa 2004 I think), so this is not an issue for me. What is an issue is that they clearly have not followed the procedure before defaulting my account and neither have they complied with my CCA request. There were also charges levied on the account too. I'm trying to ascertain the best strategy to deal with this. Thank you, in any case Kenny. deedee xx
