  1. What r u stuck with, I will try and help. Just my opinion though. The judge, while not telling me, seemed to insinuate that it was important that I mention the OFT report as a means to how I had discovered the charges were unlawful. To be honest, and I may be WAY off, I got the impression that they were peeved of with the banks as he pointed out none had gone to court, the OFT report, etc etc
  2. Right In court today, got the judgement set aside despote the Bank Of Scotland objecting in their letter. Basically, I pointed out that i was unaware that these charges were unlawful and since the OFT report, I have acted within a reasonable time scale to ask for the set aside. He has given me 14 days to file a defence, which will be a counter claim, and a further 14 days for the completion of the allocation questionaire. I did try and pick his brains a little when he said none of these cases actually get to court, he replied no they dont and I said I believe their was one that was referred to the Mercantile and he said it had been settled also

To post on a forum and then to not only complain after 1 hour 52 minutes that no one has replied to your question, but to also have a little dig is not going to win you any friends which you need. I suggest you wait till tonight when people are home from work and see what is posted
  5. On point 3 on a technicality, they can call it in if it is in default OR if he has in arrears they can make the arrears instantly repayable and if he unable, put him in default
  6. In court on Thursday regarding Judgement The beauty of it all is they are not playing ball with my DPA request. They had until Aug 5th to supply the statements but despite 2 reminders they have not. I have today faxed the branch regarding this as they will not have enough time to have them too me by Thursday. If I am able to have the judgement set aside, am I able to claim back all the Bailiffs fees on the account Thanks

  9. We bought a 60" plasma from Currys and it was delivered on the 3rd July. The 28 days is up on Wednesday On sunday it stopped working, being stuck in stand by. I telephoned Mastercare and someone is coming tomorrow to verify it is faulty. NO PROBLEMS Now, because it was so big, we paid someone £115 to have it put on the wall. I have now found out by an absolute miserable sow at the store that I will have to pay for the plasma to be taken off the wall and then for the new one to be re fitted. I have phoned the bloke and he said it will be £80. He will have to come to our house twice. Please explain why I should have to pay. The woman was adamant and even walked off from me in the store which I just found to be bloody pig ignorant. Surely they should cover the cost. They even offer the fitting service and her only excuse was that they would not be insured. I said well Ill pay for it to come down if you will put it back up. Her answer was, why should we, we are a business, we dont do anything for free. Advice URGENTLY needed

  11. Just received their defence. Christ it looks impressive. Anyway, filled in the allocation Questionaire and will send Special Delivery tomorrow. Quick question, since this started I have had a few more charges on my account. Do i need to ask the solicitor to include these in their settlement or do I need to get this one paid then go for them again. Cheeers
  12. Received a letter today. I am sorry to learn that you are unhappy with our offer to refund £210. As we have explained previously, the charges we apply to your account do recover costs so we cannot agree to return them all. However to reach an amicable settlement we are prepared to increase our offer to £610. I have replied via email to [email protected] Dear Ruth Thank you for your letter dated 24th July 2006 that came to my attention today. I note your part, and I quote, "The charges we apply to your account do recover costs." That is excellent, if this is the case then I have no claim and will withdraw my Summons. Please could you therefore provide me with a FULL AND COMPLETE breakdown of how the charges are come too. I note the current charge is £35. I would require a full break down of Postage, Stationary, hourly rate of a administrative assistant, and also a breakdown of the manual intervention required. You may note that my Subject Access Request did ask for a breakdown of "Manual Intervention" but you chose not to disclose that. I require the above information within 7 days.   13. But that is my arguement. He wont accept my £50 on the horse but will accept someone elses £50. This can be proved. I am being discriminated because of my success but the bookie will not take my £50 on a horse but will take £50 on the same horse from someone else. How can this be right
  14. Right, I have just received a court date for August 7th but I am on holiday. Now, I have phoned the ocurt and they say I have to pay another £65 to change the date. Surely this cannot be correct.

  16. Firstly, I have been contemplating posting this all day as I know alot of people have prblems with gambling. Now, unfortunately for my sins, I am a profeesional gambler. I dont make £100,000 a year but I make enough so I dont have to "Work" and I live very comfortably. Now the problem I have is bookmakers restict me SEVERLEY online. Now the problem is, I am being discriminated by these bookmakers because I am sucessful. I recently have had an account secerley restricted, IE I can back a horse to win £150 rather than £3000 on another account. This is affecting my ability to provide a living. I have asked the bookmakers why and all they say is "Trading Decision". This is the most annoying thing in the world. They just usethe multi mentioned term to cover all evils. While I admit, in their T&Cs they say they can make these decisions, but is there a bigger picture. Are the immpositions a restiction of trade. Are the descriminating against me for another customer (I can prove customer A can have more money on than me). This is my occupation and it is causing me an inconvenience that I believe is unfair.   17. As far as Im aware, to withdraw from an ATM, you do not need to have a pin. The metalic stripe is all that is needed

  19. This is just my opinion The banks agreed to halt interest on your loan to benefit you. They agreed to the DMP. Now, for me, I cant see the arguement against the bank completely offsetting the amount from your loan. Could the bank, upon paying you this money and you keeping it, not decide to right to the Debt Management people and say, WOW hang on, we have just hgiven him £XX.XX and he hasnt paid us back, thats not the spirit of this agreement, we want our money now and we will add interest. Like I said, just my view

  21. Hope someone will know the answer. I have AQUA credit card, run by Halifax. As alot of people on here, I had problems with money sorted them out and am now building my credit worthiness up. My card charges 32.4% APR (2.75% per month OUCH) so I always pay it off in full and have never been charged interst. Last month, for what ever reaon, I though my bill was £208 so paid £210 as I hate the interest rate but it is serving a purpose. The money was received before the due date. Now I had got it wrong and I owed £240 so was £30 short. Now they have applied interest, fair enough, no problem, BUT they have charged me interest on the full £240. Surely I should be charged on the £30 I owed, not the £240 Can anyone share their views or am I wrong
