  1. Hi Spoke to Money Claim yesterday to confirm They said that lloyds had until today to file a defence. If they hadnt, and I was to check my online account, as it would show there first, I could apply for judgement in default. Could you explain what the mistakes could be please Cheers
  2. Today is the day for Judgement by default Will keep trying every hour on the hour until it accepts it
  3. This was the type of situation that I was thinking. This was not deemed as a con. Just if Caboot had paid say £140 for my £1200 debt, why not offer them £450 for it in F&F settlement. I believe, we are playing the system FAIRLY and the system allows for me to offer a reduced settlement.
  4. I had something similar but the work was OK It took them 4 months to invoice me so it took me 4 months to pay
  5. ROFLMAO The bin has just been emptied @ 13.05 Went out to the lads who were doing it and asked them what had happened. He said they had the DIRECTOR, not assistant, of waste management telling them THEY MUST GET THE BIN EMPTIED They said he was VERY adamant it was done before 2pm. They asked me what I had said. Showed them the fax and they said good on ya. They are always telling us to reject bins for the slightest misdemeanor. About time someone took them on.
  6. I have given them 8 days since my calls. They are a massive organistation. They should, again in my opinion, have dealt with this before now and not just left it as a "We will do it next Wednesday when we would normally have to do it" As someone else mentioned, I have moved from Sheffield and had a normal bin 50% bigger than the one we have now. I asked for a bigger one but I didnt fall in the criteriaI have 4 black bags outside that the father in law is going to take to the tip for me today. I admit, the fast track thing was an error. How many times am I supposed to keep ringing, being told it will be done, and for it not to be done.
  7. Thanks for that I have read the F&Q but mine seems to be a little different in a way The debt is Statute Barred if there has been no contact for 6 years. However, I was still paying the debt of 4 years ago so IMO, they are not statute barred as I was still paying/being chased for these amounts then. IMO, just because the debts were applied 6 years or over, I was still paying them 4 years ago so obviously relevant Mods thoughts appreciated
  8. Dear Sir/Madam. I have been for 1 week repeatedly telephoning with regard my green wheelie bin. Below is a list of the conversations I have had 12/7/2006 15.22 Phoned regarding why my bin had not been emptied. I was asked if the rest of the streets had been emptied. I advised that they had. I was asked if any contamination leaflet was on the box. Advised there was not. Was told they could be back tomorrow, let us know if not emptied 13/7/2006 15.30 Phoned again. Advised bin still not emptied. Explained how due to the shape of the road, my bin was outside a neighbours. Was told they would put it down for an immediate collection. 14/7/2006 11.55 Phoned as conscious it was Friday and early finish. Was told it was down for collection and that if it was not today it would be Saturday morning as they have crews working particularly for these occurrences. 17/4/2006 08.35 Phone the general council number and asked for the name of someone in change of collections. Given the name Andy Brandl (sic). 17/4/2006 9.10 Phoned waste management and asked for Andy Brandl (sic). Was advised he wasn’t in. Explained I was unhappy and would seek legal advice and amazingly he was in. He said bear with us, it might not be today because we are short staffed but we are fully crewed tomorrow. 19/4/2006 11.45 Grey Bin emptied but green one left. Spoke to someone again who advised that she would put the bin down for collection. I explained that the green bin and been out in the blairing sun for the last 9 days and was smelling. It was now starting to become a health hazard. She took my mobile number and someone would ring me. This has now gone beyond reasonable. You are failing in your duty of care. This bin is becoming a health hazard. It is attracting insects and is an undesirable eyesore for my neighbours. I have no means of going to a “tip” as neither of our cars are designed for the purpose. If the bin is not emptied by 4pm this afternoon, 20/07/2006, I will hire the smallest skip available to myself and empty by green bin and green bin only, into the skip and have the driver take it there and then. I will then forward the bill on for payment within 7 days. If the bill is still not paid within 7 days, I will issue a letter before action advising you that the bill must be paid within 14 days. If the bill still remains unpaid, I will start proceedings in the small claims court, using the fast tract facility, allowed as the claim will be for under £5000 Please treat this with the seriousness it warrants. Regards Name Address SENT UNDER FAX To 01226 772040 20/7/2006 @ 11.05am
  9. And the bin STILL hasnt been emptied despite 2 phone calls this week, 1 to the Assistant Director to waste management. I can not believe that they are not obliged unders soome duty of care to empty a bin. As you can imagine, its been out on the street now under the impression its going to be emptied and to be quite honest, it stinks vile. All the grass is a mass of mush Any thoughts Seriously considering the skip Idea and then just billing them then take them to court. Happy to waste £70-80 just to bring this to an embarrasing point for them
  10. Dont tkae this the worng way but the banks have been taking £25-£40 a time for something they have no right to charge you for and you paid without battering an eyelid (Until now ). £4.10 to know your letter is going to get there and if not, proper compensation is payable, is a small price to outlay. Remeber, document it and claim it back as well
  11. My mums car was stolen about 4 months ago. Anyway, we didnt know this but the car was found the next day burnt out and the recovery service sent my mum a letter, by recorded delivery to say they had the car, it was something like £130 for the recovery and a storage of £22 per day (I Believe) Now at the time, I had a redirection from my mums house to me for my mail only. i had had no end of complaints over it and infact, they had already givent me my subscription back. At the time, me and my family went ot Austrailia for 6 weeks. When we returned, as you can imagine there was piles of post but what stuck out for me was 1 recorded delivery and one special delivery just for the point of, how can they deliver these, there was no one here >???? Now one of these were the recorded delivery letter from the recovery company that had been redirected in error to me and it had my mums name on. Now unfortunately, my mum was also on holiday when I got back and so when she eventually opened it, the recovery company had had the car for about 50 days. I enquired A Why it had been redirected to me B Who the hell signed for it. When they looked at the signature, it did indeed say My name. No doubt about it. I was absolutely livid. I went down to the sorting office and showed the manager my passport, my visas to prove i was at the other side of the world and loads of other stuff like photos etc etc There is now a criminal prosecution going against the postman as I believe there is an offence to do with post and its missuse.
  12. Hand Delivered DPA request on 26/6/2006 so deemed delivered 27/6 Received On Saturday a massive pack of paperwork form them. But the statements only go back exactly 6 years. To June 2006. No my problem is, there is hardly any charges on the remaining statements, about £80 I believe but they were PLENTY more prior to this. I have no doubt that they have the statements on file that will show considerably more charges. My Question is A:- Im I able to pay them £5 per sheet as per their charges list for statements prior to 6 years. Will they still hold the records. B:- If they wont supply these, can I estimate the charges forcing them to reveal what they belive the charges are. Reason being, my first statement supplies shows a carry over balance of £900 with only a £180 overdraft and we knopw the only way to be so overdrawn is by charges Thanks for your help
  13. Id personally wait until they offer you an out of court settlement and then when they do, tell them you want these charges as well. If it goes to court and you win, which we know you will, then tell them if they dont pay these you will take them to court again (And I still havent had my bin emptied)
  14. Monkey I am trying to help the lad. If he went, IMHO, too far with this, he could find himself in massive trouble.
  15. Alt I dont know whether I explained my situation fully BUT I have just moved in with 2 children, 2 weeks ago so this is my first green bin empty. The bin is not contaminated, it is for Garden waste and Cardboard. It has grass and cardboard boxes, broken down, inside it. It was placed out on Tuesday night for collection on Wednesday. I have telephoned 5 times and been told, "Its down for collection" I have the black bin FULL and overflowing with a black bag at the side. I have cardboard boxes broken up waiting for the green bin to be emptied as obviously they were used to transport stuff from my other house. The black bin is actually 20% smaller than the one I had it my other house that was emptied weekly. I have a convertible and the wife a mini so transporting the rubbish to a tip is inpracticable
  16. They have not allowed someone who is underage to gamble. They have asked his age, he has said he is 18 or over and they have accepted his application. If he had deposited and then been asked for ID he would have only provided fake documents to support his application which he admits to having had done in the past so no preventative measures by the bookmakers would have prevented him losing as he would have worked his way around it. I have worked in bookmaking/gaming/gambling environments for over 17 years and unfortunately, there is always someone out to make a cheap buck with some [problem] or another and the jo public just say, oh its the bookie, they deserve it/can afford it. Well I dont subscribe to that. They are running a legitamite business and as part of the online application, he has had to say he is over 18.
  17. I am under the impression PJ believes the actual routers and sky box were in there. I am refering to the cardboard boxes. Is anyone aware whether i can cross charge them for the skip. I will actual be prepared to pay for the skip then take them to court over the money and have the local rag cover the story. Im under the impression that the whole recycling fiasco is of great interest to them
  18. Im really struggling to understand why anyone can attempt to blame the bookmakers. I am not saying they are angels but, again, WE WOULD NOT BE DISCUSSING THIS IF THE OP HAD WON. The bookies are in a no win situation. A general customer like myself who is made to jump through hoops to open an account just wont do it. There has to be a status quo with regards KYC (Know Your Customer) and ease of use for the site and its prospective customers. Irrespective of his age, he knew exactly what he was doing when he attempted to open his account and stated he was over 18. Just because he isnt 18, does not meen he is not responsible for a crime. I personally would keep quiet about it and not ruffle feather. Remember, while they are in competition with each other, they will share information about you if they believe a crime has been commited, and I think you have commited 3 and your mum 2.
  19. PJ Not being funny but are you serious. Ive moved here from Sheffield but are you saying I cant put cardboard boxes that have had products in. I am REALLY hoping you thought the actual router and sky box were in there. This was just the cardboard boxes they came in. What amazed me was I was yes, I will go for the recycling thing everything helps, so I asked for a Brown bin and a blue bin. They can get them to me in October
  20. As you say, A gambling Debt. NO gambling debt is recoverable by law. But how would an online company ensure the person is over 18. Ask them to tick a tick box to say he is, which he has. Ask him to provide ID to prove it, which he doctored. Only allow credit cards, which he used his mums in her names. Im sorry, but it seems he is just trying to con the organisation. Like I said, if he was still winning, we wouldnt be having this conversation 3. Rules for registration The following rules apply to registration under regulation 2(1)(a) — 1. No person may be registered except on an application for registration in such form, and containing such particulars, as may be approved by the Commissioners. 2. No person under the age of 18 may be registered. 3. Before an applicant for registration is registered, he must provide details of — (i) his age; (ii) his identity and (iii) his place of residence. The above is the paragraph from the Act. My understanding would be, if the applicant entered a date in his Date of Birth that made him under 18, the site would reject his application. I have just tried Bet Direct, betfred and Paddy Power and they do.
  21. He wouldnt, in my opinion, have any recourse against the operator. When you sign up to any bookmakers site, you click you agree to there terms and conditions and one of the first terms and conditions is, you are over 18. If he has, and he will have, said he is over 18, he has no recourse. I notice you only come and ask how to get your money back when you have lost, not should I give it back when you won. Sorry if I sound a tad aggresive on this subject but it is one I fell strongly on as this is the work i do.
  22. Hello mate When I phoned them up first they said they would phone the crew, the crew said they emptied all the bins but "some were contaminated". She asked me what was in the bin and I said Grass and some cardboard. They were cardboard boxes from some phones, a router and a broken down sky box. She said if my bin had been a problem, they would have put a sticker on saying why. No sticker on my bin. Im really struggling here. The black bin is overflowing, I cant get the green bin to a tip as we dont have the cars to do it. I have a convertible and the mrs has a mini. I cant think of anything else to do.
  23. Wow something I know what Im talking about.... I presume you used an online wallet such as Neteller or Moneybookers to deposit into these bookmaker. You will have depsited into these using a BACS transfer and then depsited into these accounts via said source. Now have a look at this:- Gambler's £158,000 loss on parents' cards | This is Money This is a story of a lad who Lost £158,000 on the internet (It actually was £90k of his mum and dads credit card money he stole). Now people go on and whinge how internet has made gambling easy and the scourge of our society. For my troubles I packed in work 1 year ago and am a professional trader on the internet using exchanges against bookmakers. You DELIBERATELY tried everything you could to get your bets on. You used third party sources to fund your accounts and web wallets to dilute the paper trail. You knew EXACTLY what you were doing and Im sorry, but your mum needs to sit back and look at herself and look where she went wrong, letting her 17 son bet using her account. The bookmakers will do a check to confirm that the card used is registered to the address on the account. If this fails they will then ask for ID. They are taking due dilligance. If you then send in doctored documents, you are then committing, and i say this as an assumption rather than a statement, Fraud, attempting to obtain property by deception and if your mother didnt know about the bets, theft. My advice is, sit back, take it on the chin and pay it back. I would also suggest a trip to your local Gamblers Annonymous. You will see people who have lost everything. Homes, marriages, kids and least of all money. Gambling is an addiction. One medical research actually classed it more addictive than Heroin so you can see where YOU COULD end up.
