In my experience they are pretty quick to reply, and they also made me an offer after the prelim and LBA letters, pitiful as it may have been

Okay, bit confused. Have you had your statements? If not, how do you know how much you are claiming for?? If I've got this wrong apologies. If you have had your statements then the court is basically trying to encourage you both to resolve this matter before 19th July. I would suggest (although I'm no expert and I haven't got this far myself), that you contact HFC by letter so that you can show the judge that you have attempted to resolve the matter. If HFC do not enter into dialogue with you, then that won't look very good for them

Hi Deeks, It took me nearly 60 days to get my dads statements. I sent the initial letter, then the LBA, I then contacted the customer service department by e-mail saying how patient my dad had been and mentioning the information commissioner and court action. Within a week, we had the statements. It's worth a try

Yes I know what you mean. I really don't know how to advise you on this. Try phoning the helpline and see what they think. They may have some idea of how the companies may react if you were to claim. I'm sure they've probably dealt with this type of situation before, but keep reading because you may find others who are in the same situation. I know that I have read similar threads, but I'm just struggling to find them at the moment.

Hiya, Just to correct you in one area of your letter. A Data Controller is entitled to do three things: a) Ensure that they have received the appropriate payment for the request b) Have received the request itself c) Satisfy themselves that the person requesting the information is indeed the subject. Therefore, they can request additional information if they so wish.

Apparently it's a charity that offers free impartial advice for people with debt problems and don't worry, I've been there and done that, so I know what it's like dealing with debts. You will see the light at the end of the tunnel

Mmmmm, not 100% sure on this one, but I would say that if you contact the people who are managing your debts and explain what you are planning to do they will be able to advise you. I wouldn't have thought that they can go back on the agreement they have made but I'm really not sure. If you read around there are other people who are on DMP's and are doing the same thing. If I come across any on my rounds I'll come back and post them for you

I must say that when I e-mailed the customer service team, the statements arrived pretty pronto, but like I say, I had already sent the SAR and a LBA at that point

Don't worry, I made the same mistake with another one. If you haven't filed your claim yet, then it doesn't matter what you have put in your spreadsheet, that's history. I can really sympathise with you guys. My husband had a Flexible Loan Account and when we got into money troubles back in 2000, we went to Baines & Ernst debt management. Every other creditor agreed to the payments offered by Baines & Ernst on our behalf, except for HFC. They took our payments of £32 per month for two years, whilst slapping a £15 admin fee every single month until finally they agreed to shut down that account and take out a new loan with a payment of £32. Even then, they took more in admin charges then they should have and then didn't administer our transactions properly. They've got until Tuesday and then I'm filing :D Hopeless

Wow this sounds really technical. I haven't had all this because the accounts with HFC were settled a few years ago. It's a shame because there are only a few HFC claimants and therefore not much to compare with really. Steven 4064 is normally quite knowledgable around the more technical aspects so hopefully bumping this back up to the top of the list he will pick it up and have a look -
I don't think it would hurt to mention this somewhere along the line, data protection and all that!!
