  1. yes will get transferred to your local court but it'll take at least two weeks before you hear anything from them in my experience and looking on site and then its just a letter with a date and request for all paperwork to be in 14 days prior to date so don't worry too much about going away just enjoy it , mine was transferred last week and spoke to court today be another week before they even let me know a date and then probably be early september they said , good luck though !!
  2. i think that your best course of action would be to as you say write a letter stating that this amount is accepted as full and fianl settlement with all the approprite a/c no's on then as you say carry on with the claim for £4000
  3. please help with this i know i'm twitting on but have i done the right thing sending a copy of draft directions to SC&M , and does anyone think it will help to ring and see if they have received it just to nudge them ?
  4. the guy i spoke to said that nearly all had been settled before date due but that those that hadn't had not been lost so i am hoping that is the case , yes and he did say that the judges there are fed up so i hope this is a good sign after the decision on kevin at birmingham this is what has got me wobbling and do you know if i was right to send a copy of draft directions to SC&M anyone ??
  5. Rung York County Courts today and they said my claim is with the judge be back tomorrow so faxed across draft directions to them and asked if this was ok they said no problem when i explained that due to no allocation questionaire it was a bit confusing as to when to send in directions, they said it will be added to my case and sent up to judge but no cases were now being referred from them to leeds as the judges at York are now sick of banks not turning up so they are allocating in batches of 100 and all being heard together so hope this is good news .Faxed across copy of directions to SC&M also as i think this is what i'm supposed to do , hope this is all right anyone help with what to do now and if this is correct , moral support be really appreciated getting a bit wobbly now , its getting really close now !!!!!

The documents/evidence you will need to submit will include; - Schedule of charges - Statements showing charges have been made - All correspondence between you and the bank - All cases and statutes upon which your claim relies - OFT report All this can be found in the Basic Court Bundle Additionally, you should add as much other evidence as you can compile. Examples of other useful pieces of evidence are; - The Competition Commission report - The McNamara interview - Australian Default Fee's report - BBC Commission conclusion but link to australian default doesn't work put link on my thread last page , lisam

  17. I Don't See How It Can Be Correct But You Do Need To Check The Dates On Your Direct Debit Because They Could Take It Out At Midnight Sunday / Monday And Still Be Legal And You Would Still Be Overdrawn As You Can't Pay In Money To Cover At That Time , Hope This Helps , Lisam
