WHAT??? They've got to be winding you up! You now have it in black and white that they are refunding your charges (exactly which ones we're not sure, but lets not be picky ) Surely their error is not your problem? What about contacting Customer Satisfaction Dept? And get the court claim done - quick! -
Thanks for your advice both of you. I'd had a bit of trouble getting my head round the next stage - despite spending most of yesterday reading up on it all! In the end I'd managed to confuse myself totally. N1 it is then - thanks once again!

Ellie! I wondered where you'd got to - we're about neck and neck then. I'm not holding my breath for large cheque from Abbey anytime soon.... but I'm still trying to figure out whether to use N1 route or MCOL. Did you take up their kind offer of a loan then?? Good luck with Cap 1!!

I sort of cheated on this bit as I couldn't work it out either. I modified a spreadsheet which originally showed 8% interest with a daily rate underneath. If you change it to the rate you need it adjusts the daily bit accordingly. I think it was one of Vamps, but it was a while ago so I'm not 100% sure.

Hi Pabtyf, I'm not sure I'd give them any leaway at all. All I got was a list of dates and fees from them after my SAR request (which was all I asked for). My hubby phoned MBNA because we wanted to know the interest rate they charged . It turned out we were on 24.9% from the very first late fee we ever got. I might be tempted to estimate the charges, claim 24.9% (or whatever you think your rate is) and send the LBA. It's then their job to prove otherwise. Good luck, Dizzy

...and I've only sent LBA letters out so far. I've now read so much, I've actually managed to confuse myself and now I'm beginning to lose my bottle. Can anyone just put me straight on a couple of points please? Firstly, what is the actual difference between filing an N1 and using MCOL? Do MCOL charge you a percentage of the fee that you may/may not win or is it perhaps that its easier for claims up to / or over a certain amount? If I use the N1 route, do I actually have to physically hand the paperwork in at the court, or can I send it by Recorded Delivery? Its just that my nearest County Court is Ashford - about 25 miles from where I live and I don't drive. Please don't think I'm being lazy and can't be bothered to look the answers up for myself - I've spent most of the day reading threads, sticky's and FAQ's etc - but I think I've managed to 'do my own head in'! LBA going off today, as still haven't heard from them about claim - I've not even had a letter of acknowledgement . Abbey / MBNA must have a 'rudeness' policy in place, because both my claims (bank and credit card) haven't even warranted a 'sod off' letter as yet. Either that, or they're busy writing my cheques.......

Its all very quiet on the Abbey front....... I sent my LBA last monday, along with a letter asking them to stop levying further charges on the account as it is now 'in limbo' (we've gone to parachute account) and have yet to hear a dicky bird from them - not even an acknowledgement!! How rude! :o I got all prepared for a snotty letter from them - bagged up all cheque books, debit cards etc ready for them to demand them back...and , well nothing. I've still got online facilities, still got a working account....and still got an overdraft! But not even a good will gesture of a tenner or a 'sod off' letter! Hmmmm....... something tells me they could be up to their necks in claims. Oh well, thats the nearest they'll get to sympathy they'll get from me. Better get started on preparing court claim then........
