Both my cases are at Lancaster county court so to say I'm a bit worried is an understatement-never mind I just hope that I don't get the same judge.From what I've read the claimant didn't even turn up and it was dismissed because there was a problem with his POC. Wish me luck Glad

I phoned the court today as I still haven't had anything from them regarding Abbey's defence.Told that they are experiencing a backlog with claims at the moment but should be sent an AQ within the next week or so.Oh well another £100 but lets hope it will be worth it in the end. Hi thanks for your reply-I was just hoping that it was further down the line and was a bit disappointed that it hasn't even been sent yet.

WELL!!!! Court papers taken to court on 15th May and I still hadn't had anything back so called court this morning to be told that they have such a backlog of cases that they haven't even sent the paperwork to the Halifax yet!!!!! They may not even by done by next week- wish I filed online now. Glad:evil:

Hi Have you started your court claim yet or are you at the LBA stage?I had already started the court proceedings when Abbey made a GOGW so I rejected it with letter 5 that I adapted a little help from other users.My thread if you want to look is Glad vs Abbey GOGW.It may help Glad:)

P.S I don't think that the defnce has changed much since the LLoyds case as I was reading Mariejaders thread and the defence Abbey had sent her reads very much like ours.

Hi It's good to hear from people at exactly the same stage. I think a paralegal is some sort of legal assistant not a solicitor(I'm not a 100% sure on that) I haven't got that email address. Did you get it with your defence paperwork. I really don't know what the best advice is either to wait for the court paperwork or to contact Abbey itself. Perhaps someone with a bit more knowledge on the Abbey and how best to play it reads this and will let us know. Keep in touch and let's see what happens next. Glad:p

Today received the defence from Abbey.It reads It is signed Willem Basson-Paralegal-WHATEVER THAT IS Is this a usual defence and any help as to what I do next will be greatly appreciated as i'm a bit confused by all the legal jargon.Also does it matter if I don't have a copy of the T & Cs from 1997 when I opened this as I can't get them off the archive website for some reason. Also Abbey put £400 into my account as a GOGW which I refused and asked them to remove which has never happened.Do I declare this to the court and take it off my claim total???? Thanks Glad

Hi I phoned the Abbey and asked and surprisingly they were quite helpful and told me when I opened it because like you I hadn't got a clue. Try and give them a call. Glad
