  1. Don't count on it, they'll probably file a defence at the very last moment (maybe even a day late), thats generally the rule! But for every rule there is an exception so fingers crossed.
  2. you don't have to supply any information to natwest, just copy them in with any correspondence you send to the court. Fill in the AQ and send it back to the courts, if any more info is required by the judge the courts will request it. Natwest sent me a CPR Part 18 request basically asking for info that they already know about. I think this is intended to scare you off with all of the legal spiel. You are not required to answer this as it's going through the small claims track. have a look at my thread Laffar v's Natwest to see how i responded to them. hope this helps

Anyway, i've found the perfect response for you in the Barclays forum, just fill in the stars. On the subject of interest. The interest you claim at this point is that incurred on any overdraft thats made up of these charges, this is NOT the 8%. The overdraft interest can be calculated by using the spreadsheet vampiress has so kindly made. The 8% is only added at the moneyclaim stage. Hope this is clear
  5. Have you passed the stage of filing your claim on-line? Or is this before the Letter Before Action? If its after the moneyclaim online stage i wrote the following (but reading back it may be a little aggressive) Dear Sir or Madam: Claim No: ******** Your Client: National Westminster Plc I Acknowledge receipt of your letter dated: Whenever I believe that my claim will not fail in court and will only accept a settlement for the full amount of the claim including interest. Therefore I am declining your offer of £600. I don't think there's a specific template letter to send in response to this, however, the standard reply is to say thanks and you'll accept it as a partial refund but will continue with the claim for the full amount. If their offer was in response to your Prelim letter i would add this to the Letter Before Action ... you don't want to be delaying more than you have to by sending seperate letters. They won't give you the £600 seperately anyway.
  6. Ooooo yes, i'm psychic, got a cheque for the full amount when i got back from my weekend away!! it's a big relief i can tell you, just hope it doesn't burn a hole in my pocket. thanks for everyones support and advice.
  7. Yep, they all seem like the right things to claim back ... not too sure about the service fee though, depends what it was for. If it actually was for a service then these shouldn't be included in the claim .. however, if they are for a service and they didn't say anything in their response to the LBA then i wouldn't worry about it. And deducting the adv gold fee from the claim was the right thing to do, as this IS a service (allegedly) and chargeable
  8. By law they're only obliged to keep 6 years of records\statements .. however, it doesn't hurt asking for 16 years and see what you get. From there you may be able estimate the charges back. There's a thread on here somewhere where someones claiming back more than 6 years on an estimate .. it's quite a "mature" thread so may already be settled. Can't remember which one it is though .. sorry!
  9. Did you send them the spreadsheet with your prelim letter or letter before action? If it's been revised and you get to the Allocation Questionnaire bit you can send it to the courts (and a copy to natwest or cobbetts) as additional information. If Judgement is passed before the AQ then you should be awarded whatever value you've put in your moneyclaim form, so the revised spreadsheet is not needed. Hope this helps

  11. Don't think it'll get to the stage of judgement being passed at this point. They're tending to file a defence on the last day .. sometimes a day late, but the courts are accepting the defence anyway. Probably a bit more to'ing and fro'ing yet matey! Sorry to be the bearer of slightly bad news

  13. It won't be that great, just going home for the weekend (fairly near you actually). But after a crap weekend (probably) what better way to cheer myself up than to cash my big fat cheque!?

Got a response to my last Secure message saying they've found proof i've requested the PPI and i should receive this in the next couple of days... this should be interesting as i cannot see anywhere in my DSIR or my original contract where the request was made ... I feel they're trying to wriggle out of it, and if so i'll be following this up as far as i can and take them to the cleaners Can a Mod give me some advice on this please. If they do fabricate evidence that i've requested the PPI what can i do to really annoy or even damage them, surely this could be construed as a criminal matter, fraud maybe..!!??
  15. Cathie, I'm still waiting, getting a little worried .. although it's encouraging that someones in the same boat, at least they're not picking on me!! I'm going away until monday so hopefully there'll be a nice (full) offer waiting for me when i get back, and news that you've had your claim settled too. Not holding my breath though
  16. I have also had an offer at this point. Sent a "no thanks" letter about 2 weeks ago, haven't heard a thing since ... getting a tad worried, but i'm sure everything will be ok!
  17. Got a letter from Egg on Friday that made me swear! It basically said they confirm the PP has been cancelled. They cannot reimburse me at this stage as they have to establish if i requested PP and to do this i must pay £10 for a DSIR. ARRRRRGGGGGHHH I've paid for and had my DSIR... Whats wrong with some of these people, do they not check what's been going on. I fear it's just another delaying tactic!

  20. I'm just past this stage, you should get a big letter with their defence enclosed and a CPR Part 18 request for more info. At this point you can do 1 of 2 things, 1) Respond saying you expect it to go through the small claims track and hence do not have to respond to the Part 18 Request. Or 2) Respond with you own Part 18 request asking for a breakdown of costs incurred to bounce a cheque, direct debit etc ... I chose option 1 and recently received an offer of about half my claim ... which i rejected of course!

Just so you know what to expect, Natwest should acknowledge on the final possible day, then they'll send you a scary looking defence full of legal waffle, this is the part 18 thingy a few people have got. You can do 2 things here, tell them you expect it to be allocated to the small claims track and therefore you do not have to respond to the part 18 request OR as a couple of people have done (i think Lynne "bs0lth" did) respond with your own part 18 request for more info, namely their breakdown of costs. If bs0lth did respond with her own part 18, then i'd recommend that being the course of action, as she has had her money returned, whereas i am still waiting.
  22. Agreed! They admitted they were wrong, offered me the three months, i said it wasn't sufficient, so one woman back-tracked saying her colleague had made a mistake and the PPI was applied correctly.
  23. Good luck with yours, Egg have until tomorrow to respond to my Prelim letter regarding PPI. It's good to have someone at a similar point. I had a similar response to you when i first mentioned it to Egg, apart from item 2 in your list. They did however offer me 3 months refund as a goodwill gesture ... hmmm, not quite 6 years worth!!
  24. It started on the 28th July. I wouldn't count on getting the settlement in time for 2nd September. You still have a while to go yet ... mainly due to Natwest\Cobbetts dragging their feet. Expect them to Defend the claim on the very last day ... even the day after the last day (the courts are generally allowing this).
