  2. i wouldnt count on it they may have, the only way to check would be to check your credit file. maybe poke them with a stick, make a follow up letter saying they have yet to answer your previous correspondance?

Fax number of International Collections Limited (their in house collectors) 0870 263 5082 Shop Direct Financial Services (littlewoods) Complaints Department Fax Number 0870 263 5087 now this isnt their main number, they told me they were having problems with that but if i sent it to that number it would reach them. its very handy to have fax numbers - you fax what you want, print out the fax header to say its been sent, and saves on recorded delivery!

  5. please do keep us up to date DEDEE! however beware! just because they tell you they wont pursue the debt, wont stop them entering a default on your credit file - thats what they have done to me and im fighting it. Manf - let us know what happens, i hate littlewoods and am out to help everyone i can!
  6. i dont think there is much you can do until they say the cant get a copy of the agreement, you could remind them though that while the account is in dispute they are not allowed to share your data with any 3rd parties (including credit reference agencies) under the guidelines of the OFT.

Update After my complaint letter of July they have sent me a standard response basically saying they are going to look into it. so im simply firing this letter back at them (just to keep them on their toes) Thank you for your letter of xxx 2007, the contents of which have been noted. Please be advised that all legal action on my part has now been suspended pending the result of your enquiry, however please note that action may again be resumed without further notification to yourselves if no resolution can be met or if your enquiry takes longer than 21 days.   8. dont care if they "accept" them or not, fact is the prescribed terms are not on the main document! end of story.
  9. dont send it by cheque cause they might (and i say again MIGHT) take your signature off it. send a postal order
  10. well im still waiting on a reply - if i get nothing im going to start court action, i work full time, but i dont have a lot of money, so ill just throw a claim in for costs/compen while im at it, i wont state a figure, ill let the courts decide!
  11. have not issued a claim at this point, i gave littlewoods 14 days which expire this coming Wednesday, after that i will see what happens. Have yet to complain to CRA's using their "official complaints" but dont expect anything there when/if i do. PM me the link to your threads once you start them, and ill be glad to help.

IF YOUVE SENT YOUR CCA REQUEST AND CAN PROVE ITS BEEN RECIEVED BEFORE THIS LETTER WAS PRODUCE! you have nothin to worry about sit back and let the time expire, if they DID go to court you can defend, and non compliance of CCA is a total defence in ANY court, you may want to write a letter to that effect.
  13. exactly - thats where i am. the default isnt legal because 1 - there is no CCA therefore no executed agreement which can be defaulted on. 2 - no CCA = the terms and conditions are also invalid therefore no default can be entered and in my case 3 - when default was placed on file, it was clearly while the debt was in dispute, this is against the guidelines of the OFT. they cant win, but fight to the bitter end, costing them more and more money. where is the sense in that?????????
  14. but hten you can reclaim the late payment charges as they are penalty charges.
  15. well at this point i have complained to the CRA's - no luck there tried reasoning with littlewoods directly - no result complained to ICO - have yet to hear back. after that i think Court WOULD be the only other option as the rest have been exhausted. although i havent used Littlewoods official complaints procedue but have requested it. watch this space i guess.
  16. Manf wait for them to see if he does "put it in writing" if he does come back to us in the meantime wait for the timescales of the CCA to run out. dont send him anything. just sit tight, wait for them to make next move and that means - their next mistake!
  17. i dont know if you should reply. Why dont you try emailing them the CCA request (omitting the part about the £1 fee) i sent them a CCA and didnt enclose the £1 fee they didnt ask for it try your luck just email them the CCA letter see what they send back, if they ask for the £1 come back to us for a response.
  18. like i said, its just scare tactics to get you to Pay, we have all had them! its just unfortunate that some people cave.
  19. keep the recording - you may need it. Fax it to him straight away! keep the printed header sheet. just advise him that while he has not responded to your CCA request the company is NOT permitted to take any further actions until they comply!
  20. scare tactics, dont rise to them, its to scare you into paying money! when he phones again and he will get his name, and an address and a fax number simply write him a letter stating "i have made a legal request of your company and as of yet you have failed to respond, please be aware that if this matter was to go to court the court would not issue any judgement unless and until my legal request was satisfied". i think thats about right but you may have to check with someone else. PriorityOne?

  22. when you complain to the OFT they pass it to Consumer Direct who in both my cases passed it to my Local TS anyway, but if you go through CD and they refer you, you have a better chance of something happening.
  23. they have 12 working days in which to provide you with the CCA if they dont they then default, which means you can legally stop payment, after the 12 working days are up, its takes a further 1 calender month before they commit a summary criminal offence, after that time, if they produce the agreement, they must go to court to get it enforced. So basically wait until the 12 working days are up, come back and tell us and then start your countdown to the 1 calender month is up. of course if they write back to you in the meantime let us know
