  1. i requested a CCA back in Decemeber 2006 and they didnt give me it! they didnt give me any replies to any of my letters and i had to go to HBOS to get any answers at all, so im in.
  2. the problem is the outstanding balance is just over 5k, so i can see them going to court for that! although in doing so, they wouldnt only have to explain the APR but also why it took them 9 months to get my my copy of the agreement! but im still waiting on TS to get the Terms and conditions before doing anything else. Once i get the Terms and Conditions, ill see what they say, and go from there. Unless you think i should just contact them myself regarding the APR situation?
  3. makes them aware that i am in contact with my solicitor (which i am!) im fully 100% ready to take them to court, and we are working on the papers for that now because my solicitor and myself think they will give me a "bog off" letter lol i actually want it to go to court, is that evil! Lol
  4. was thinking of putting something like. After discussion with one of your telephone operatives, i have been advised that you aim to have your response to my complaint to me no later than the 27th September 2007. As you are aware this date is outwith the deadlines set by me in my previous letters, copies of which are enclosed for ease of reference. Notwithstanding that, following the advice of my solicitor, i have now decided to suspend all further legal action until your investigation is complete, however if no response is recieved by 27th September i will instruct my solicitor to commence legal action against your company without any further warning or communication. Regards KPR thoughts?

  7. well if you didnt tick the PPI and they charged you, i think you should now SAR (if you havent already) and claim that back. plus if the account balance is ZERO - they have nothing to collect on
  8. no i put the purpose of the loan as car, but didnt actually use it on a car, and the AA could have cared less, they just put the money into my account. ill wait for the T&C's, but with the APR being wrong, the fact they have my mother as my spouse, and have me as having 2 dependants when in fact i have none, would a judge make this enforceable?
  9. write to the halifax bank of scotland then. i did, unforunately, it looks like ill have to pay the 5k now.
  10. also there was no prior face to face contact but there were prior telephone calls, im guessing that doesnt count for the cancellation rights?
  11. Thanks Peter for your help and information. I have asked Trading Standards to contact them again for the terms and conditions mentioned in the agreement (which i believe to actually be the back page) once these come back ill have a better idea. and the credit agreement states it was for a car. They have sent me so far - a statement of account (with one charge for £25) and this front page of the agreement. thats all. they have yet to send the default notice i asked for
  12. so what does that mean for me? are you sure they are not charging 9.6 on the actual loan and counting the redundancy charge seperate? (with no interest?) and no i didnt sign on the premises, they sent the form out to me as an acceptance (thats why their date of signature is 2 days before mine) i signed it and returned it to them. so they executed it with a signature and date before i did. so back to the APR. isnt the APR on the actual LOAN minus the £695 charge for the stupid redundancy payment i didnt need!
  13. sure, have done it on my thread. but the rendundancy i signed on the advice of the AA i was young, didnt completely understand, and ended up paying for it. i did lose my job but because i wasnt made "redundant" the cover did nothing for me. Thanks
  14. ive had a message saying someone cant make out the figs A - £5000 B - £625 D - £5625.00 E - £1229.88 F - £6854.88 i dont know why i signed the redundancy thing, i know i did it on the advice of the guy on the phone, i was young and now realise it was a sales pitch, there was no way i was going to every qualify for redundancy.

  16. also i can see no "right to cancel" section on the main page, if it isnt on the back page (the one i dont have) that would be good as thats one of the prescribed terms, correct?

  20. now whats interesting here, and i dont know if i could get them on any of these . but 1 - they have put my mum down as my spouse (eeew) 2 - they have put me as single 3 - they have put me as having 2 dependants (I HAVE NONE) i dont know if any of these would matter, or if i could get off on a technicality? or would it be seen as "well you should have checked the information was right before you signed it!"
