Hi all Thanks KTC, you were right about it coming soon. Postie delivered letter today from Hali and they have offered me half of what I was claiming. My claim is for £2533.24 ,Thats the contractual or £1507.87 8% , then theres the court costs to go on and my own costs ; postage and the like. I know I shouldnt have gone for the contractual after that judge set a precedent so I am willing to accept the 8% but in their letter after the usual bumf about how they wouldnt be able to claim costs back if they won they say; " For this reason, but without admission of liability, Halifax is willing to reimberse £1055.00 in respect of the bank charges incurred, together with £168.10 in respect of approx interest at 8% that Hai has calculated was charged on your account as a result of charges. Hali will also reimberse you £120.00 in respect of the Court Fee. This amounts to £1343.10 Halifax does not conside that you are entitled to the further £1321.74 that you are claiming . Unless you can provide evidence of this further loss Halifax will fil a defence in respect of his part of your claim" What do I do guys? I get the amount to £1507.14 with just the 8% and if I add the Court Fee as well then is £1627.14. Should I ring them and say Ill be willing to accept my figures and if they dont agree then tell them I reject the offer and am willing to take it to court cause even though I know I wont get the contractual rate if I win I will get the 8% so Ill get my figure not theirs. I know its only £300 short but its better in my pocket than theirs and it is MY money after all. Any advice would be gratefully accepted. I'm in a quandry about what to do. Thanks guys

Well I sent the letter to shabby today to tell them that I want the full amount within 10 days , and authorizing them to take the money out of my account that they have put in if they wont agree to pay me in full. I hope they think that the amount Im claiming is not worth going to court for . Its only just over £900 so hopefully they wont bother , but, I bet they still make me wait for it. Sure theres some Sadists working in the banks. Like the thought of making us all squirm and wiggle round like helpless tiddlers in their big pond , but they should realise by now that even little tiddlers grow into big fish and we'll jump up out of the pond and bite;) I'll sit back now and wait I think they should get it on Monday so start the countdown from then. Hi all Well the postman brought me a pressie today. Haliprats have now acknowledged my claim.:o It says the Defendant filed an Acknowledgement of Service on 29 June. They have 28 days from the date of service , which I reckon is the 27 July. So I guess this means that Ive got to do the bundle for sure now, On the back stapled to it is another piece of paper that says Response Pack. Am I supposed to be able to read what this has on it cause its been photocopied and I really cant make out what it says. Im not sure if this is just what the bank had to fill in and send back, Its got the Solicitors signiture on at the bottom so I guess it is just for them. It wouldnt have any directions for me would it? I really cant read it. Ill have to do more reading now cause I think I have osubmit my bundle now dont I . Im not sure , must read more threads. Have you had one Ja-De . Have they acknowledged yours? Just hope Im not the one to have to go to court cause knowin my luck Ill be the one who looses. LOL ( or not ). Hi Just to update , Ive still heard nothing from the Haliprats and I keep checking my account. BIG FAT SQUIDDLY ZILTCH! Their time is up on 9th so only 4days to go, TICK TOCK. Its getting closer. If I dont hear anything from them do I get in touch with the court to see if they have? Or do I apply straight away for a judgement against them from the court. Sort of win by default? I think I need to read up some more dont I. I know there has been other people in the same boat sometime or other. I was toying with the idea of giving them a ring and telling them that Im willing to settle for a lower rate as opposed to the contractual rate, just to see if that might make it move faster. Plus I still dont think Ive got a chance of claiming that back. I think Ive got NO HOPE OR BOB HOPE of doing that so willing to compramise. Any thoughts anyone. Just wish it was all done and dusted .Im hopeing that once Ive got one under my belt that it will give me more confidence to go after all the others. You know,sort of give me dutch courage, ( normally have a drink to get that so nice to have the same feeling without the prospect of the hangover) LOL. Although Ive said it before I know, but I never thought Id have the bottle to do something like take on the bank. Cant be too much longer now till you have the money, YOUR MONEY, back where it belongs and dont forget to claim your costs and expenses as well. Get everything outa the B*****s thats what I say. Ive got the same prob re money put into my bank with the Shabby not filed yet though. gonna write with new schedule and tell them to pay in full or take the money back (SOB) and then Ill file in court. See how they like them little apples. Ive not heard anything back yet from the halifax and my time scale is the same as yours. Their time runs out on the 9th. I sent the LBA off end of May and havent touched it since. Lack of funds to do the both claims. Earlier in the week I was just going to have a laugh and look in the account to see IF I hadanymoney left in and Lo and Behold they have refunded me £240 .I was gobsmacked. (Not to mention tempted).Money in and I cant touch it:-x I got a letter off them yesterday to say they have as a GOGW refunded me £273 (OH NO YOU HAVENT) and they hope Im happy or words to that effect (SOOOOOOOO NOT). So like you Ive been running gound this site wondering which letter to use and which way to turn. Ifound what Im looking for in the templates , just need to adjust it a wee bit to fit my own circumstances. Hopefully Ill get it done tonight also Im going to include an amended spreadsheet and give them another 10 days to comply or Ill file in court. (gives me a few days to scrape the £120 together then). I hope Ive not shot myself in the foot cause I havent replied straight away, dont think I have. Anyway the interest is growing all the time so its their loss not mine eh. Hi OHOH Thanks for that. Ive recieved the letter today to say the bank has refunded my account with £273 (not, it was £240) as a gesture of goodwill LOL. Ive decided now to use one of the letters on the site you sokindly gave me the link to . I will need to alter it just a wee bit in keeping with my own circumstances of course ,but, it has come in very handy indeed. I'll give them another wk or 10 das to refund all monies an I think ill send them an amended schedule of charges as well cause the one I sent previously only went up to May and there are a couple of new charges on my account now. Lets see if they like them there apples. At least with sending them another letter it will allow me a bit more time to scratch the money together as well to file, Just in case they do take the money they refunded back from my account:-o OOOOOOOOOWWWWWWWWW HOPE THEY DONT!Will keep you updated anyhow. Hi Ja-De Sorry to have missed you again. Still no news then, same here , not even a sniff of any nice new notes. They say no news is good news but i wish they would do something its ding my head in. Ive been busy printin stuff off just in case. I checked the bank this mornin but still nothin. Its ironic really as when i used the other bank (abbey) I was gobsmacked to find theyve refunded me £240 . I havent done anything with them since the end of May, couldnt afford to file two at the same time so thought id put theirs on hold till Halifax was sorted, then that! Gonna email them and reject money I think or tell them Ill take in part payment , then try an file on Friday. Why couldnt Halifax do that always got to be complicated, never just nice and straight forward. Have you go all your stuff done yet. Isnt there a lot of printin to get on with. Dont know how many cartridges Ive used and their not all that cheap either are they. Its a wonder I havent burnt the printer out.LOL Smoke comin from me fingers an all that like. Ive got quite a pile of stuff and knowing me half of it wont really be relevant to anything I need. If I read somethin I think sounds good or interestin then its printed out. My little corner of the livin room where Ive got the comp is just piled with files. Always doin too much though I think. Im just obsessed with printin things. The amont of paper I get through as well is just unreal. Still should all be worth it in the end eh. As you can see by the time ive replied to this thread , its just after 5o'clock in mornin, just cant seem to sleep these days, well not durin the nigh anyhow . I have no problem with sittin down to watch the telly and the next thing I know its the time when all sane people would be climin the stairs to get their head down. Hi England, Im a bit puzzled as to what to do seeing as they have aready put it into my bank. Do I email them to tell them ive acknowledged the amount and that iaccept it in part payment but that i still intend to file either tomorrow or Friday, or should I tell them to take it out of my account and just reject it totally still telling them that i still intend to file? I really dont know what to do:? See I dont want to leave it too long as they might take my silence as some sort oacceptance ad think that Im not going to persue the full amount . Also if it does get to court (once ive filed) will it look bad on my part that ive accepted it but not acknowledged it , or rejected it or whatever? See Im totally lost now , wish they hadnt done it. Dident really want to take it to court stage yet as money a bit low . Now seems like ill have to or else they will think im rolling over and playing dead. Decisions , decisions . Hi all Just to update . Ive not filed this claim yet as ive got a claim going for halifax and to be honest could not afford te fee yet to do this one as well, (still not working). I had a letter off them yesterday to say they wre investigating my complaint . I am ging to try and file soon BUT just checked my account with them cause I think theyve just bounced another d/dand lo and behold i find they have refunded me £240 . No letter telling me they have done this so do you think I should write to them telling them that I will accept this as part payment but will still file or tell them to take it back. Dont really know what to do, Any suggestionswould help. thanks
