  1. Hi everyone, Just thought I`d `bump` this thread. Has anyone any comments on my previous post `50` regarding the charges etc? They are still adding on charges and interest. Are they allowed to do this on an account that is in dispute and no CCA has been show yet? I`d appreciate anything from anyone on this. Regards N.P
  2. Hi pecky1 and Hopeful1, Thanks for the posts, everything is much appreciated. I`ve just noticed on the recent letter from Fredrickson, the balance has gone up by £12. Surely this can`t be the £12 fee applied by Morecrap for sending out the letter as per the terms and conditions of the Credit Agreement they failed to send. Should I possibly add a line or two about this or charge these numpties £12 for me sending CB`s response? I could give them 14 days to pay up then whack in a N1 Court Claim. Does anyone have any comments on this? I`ll be posting CB`s response first thing Monday. Thanks again guys and gals. Regards N.P

  4. Hi people, Well, time for an update. After recently receiving a letter from Morecrap stating they are unable to supply the requested CCA, only this morning I receive a letter from Fredrickson International, stating they are acting on behalf of Argos Card Services and require Full Payment or they are going to kick my head in. Seem`s that these idiots are trying to spoil my Christmas now. I guess I send the usual `what you playing at? this account is in dispute` letter?   6. Hi pecky1, Just thought I`d drop in to see how you were doing with this one? Have you received anything from them or had any more calls? I received a letter from Morecrap over a week ao stating they were unable to provide a Credit Agreement and have closed their files and sent the account back to Argos. I was hoping for more of a fight, but there you go. Still watching with interest. Regards N.P

  8. Hi again all, Just a little update. He said a couple of nights ago they rang his mobile and his girl friend answered. They said they need to speak to him regarding a debt and that he need`s to contact them to discuss a payment plan. She said they should speak to him then she hung up. Isn`t that a breach of the Data Protection Act? Also, the Royal Mail confirms a signed delivery of the CCA request this morning. I`ll keep you updated. Thanks. Regards N.P
  9. Hi all, Just a thought regarding the phone calls. I wouldn`t be suprised if they get FREE local and international calls. They probably have some deal with their phone company as clearly they make lot`s of calls. After all, you can get FREE calls on your own land land and mobile with your service rental. I just thought I`d add that if someone thinks they might give up ringing on the basis that they might run up a huge phone bill. Regards N.P

  12. Hi boys and girls, Here we go again, this time it`s for a work mate of mine. Basically it goes like this. He said he has an oldish alleged debt of around £280 for a Burtons Store Card. He hasn`t paid anything on this for around 2-3 years. Now, he`s been getting letters from Thames Credit delivered to his old address (his mother`s) for around 4 months and now they are actually writing to him at his new address which he only moved to this weekend. Last night, and today at work they even rang his mobile phone to make contact. How the hell they got this I don`t know. The only thing I can think of is because he got a new mobile contract with `3` around 4 months ago, and I think they must have updated his Credit Reference details and it was flagged up for collection, or something like that. That`s all I can think of. Anyway, I`ve advised him to do everything in writing and tell these knob splats where to go when they ring him. They thing is, their letter states if he contqcts them to arrange payment they will offer upto 35% discount on the debt, payable by 3 monthy installments. They also threaten to send around the heavy field agents mob, heh heh. To me, the letter is worded like they don`t really know what they are doing and may just be trying to bluff him into paying something. I`m in the process of printing out a CCA request, but was wondering if anyone has any cool worded letters regarding the telephone calls and threats of door step visits? They also stated he has another chance to pay up as the account is being prepared for dispatch to their solicitors or field agents, heh heh. Don`t you just love their choice of words?   13. Hi there, Yeah, the CAG site is absolutely awsome (that word is so nobbish), I always paid my way through life, and always got ripped off but was affraid to challenge anyone. Now I beleive we have a right to defend ourselves any way we can and the CCA route is a start as it tells them we won`t be taken for a ride any more. So yes, I have to say "Thanks" to the CAG.   14. Hi gaz2954, I`m just subscribing to your thread with GREAT INTEREST. I CCA`d Lloyds Mastercard around 2 months ago, maybe longer and I am still getting the `you have not paid you monthly payment` letter. I received another one this morning which is the 3rd I`ve had over 3 months. It basically waffles on that I have no Direct Debit set up and I should contact them ASAFP to arrange payment. But, just like you, I have not received any CCA, although I also SAR`d the mofo`s at the same time and I have received my statements and there are a number of charges applied. There is also Payment Protection Insurance which I was paying around £45 a month for, which I beleive you can claim back, so I`ll add that to my defence when needed. Anyway, they are still adding charges on each month, so the alleged debt is getting higher. What a bunch of morons! I`ll keep watching your thread with great interest. Regards N.P
  15. Hi there, Just subscribing. It probably won`t make you feel any better, but when was the Argos Card taken out? Mine was taken out around 4 years ago and I have been paying over £115 a month, but only this year the account was sent to Morecrap also, for collection. I CCA`d them a number of months ago and only this week they replied saying they are unable to provide a Credit Agreement and have returned the account back to Argos, therefore I`m not paying anything. I think the best comfort I get is knowing there are a lot more people in a worse position then me and they seem to help each other through things. Regards N.P.
  16. Hi there, Thanks for the posts buzby and jonni2bad. From what he told me, he simply plugged it in to charge it up and both the phone and charge got really hot within about 6 seconds. He then immediately unplugged it and the end of the charger plug was glowing. The new charger did not charge the phone, so it appear`s the charge circuit may have been fried. To look at, there doesn`t appear to be any internal damage, although the contacts may be fried. When he returned the phone, he also returned the original charger. He says, when he was on the phone, they accused if of basically do anything and everything to the phone to damage, in order to get a new phone out of them. Now buzby mentioned water damage, he did actually say they said it had been wet. They also said he had dropped it and even crushed it. Now, the problem is, I beleive the phone still works with a charged up replacement battery, but a charger will not charge up the battery in the phone. He uses the phone at work and has it in his pocket at all time, so really the only marks that there may be on the phone are everyday use ones, as he doesn`t use a case. He got the feeling they were calling him a liar. I don`t really have anything else to add, except he is now very angry with their customer service and beleive`s he should not have to buy a new or refurbished phone under any circumstances. The thing is, in the mean time, he is still being billed for the service he can`t use. Well, thanks again guys for your help and comments. I`d appreciate any more suggestions you may have.   17. Hi people, This is my first visit to the Telecoms Forums. I`m on here for a work mate. His problem is this. He signed up for a 18 month contract with 3 Mobile on a £15 a month tariff. He had the option of a free cheap phone or pay something towards a better phone. He picked the LG Chocolate which was £30. Now, he has nad no problems with the service or anything, but after 4 months of use, he plugged the charged into the phone to charge and suddenely, after around 6 seconds, both the charger and phone became very hot. He said he unplugged the charger and the end of the plug was glowing. He asked me if I could get hold of suitable charger for him next time I visited town, and I popped into the local 3 Store and purchased a LG charger for £15. The thing is, when I gave him it, the LED on the charger came on, but the phone was not charging, so he assumed the phone was damaged. After calling 3 for help, they said he could buy a new phone for £15, to which he replied, why should he? It`s only 4 months old. So, they sent him out an envelope to return the phone for assement. This was just under 2 weeks ago, and this morning he received the phone back, in exactly the same state, it had been checked, but hadn`t been fixed or changed. The said he had done physical damage to the phone, so they would not entertain a repair of swap. Tonight, he rang 3 and he called me to say he had been on the phone for an hour with 3 different people. The first person said he needed to speak to Technical, so they transferred him there, Technical said they weren`t interested as he had caused physical damage to the phone and said it was pointless sending it back as their tests would come up with the same answer, so they transferred him to Contract Cancellation. He told these imbeciles he had grounds to cancel the contract and they then offered him 2 choices, a refurbished phone for £45 or a £250 fee to cancel the remaining contract, now in my books 14 months at £15 a month is only £210, not £250. He was also told that the warranty was with LG and not 3. Myself, I beleive he has a contract with 3 and not LG. He paid £30 for the phone, which is only 4 months old and has been damaged due to a dodgy charger which they sold him. I was wondering, is their some way he can terminate his contract without the charge? I beleive their is under the Sale Of Goods Act. He purchased a phone and charger with a fault, and it is now no good for the job it was purchased for. I would appreciate any feedback and help on this from anyone. He still has 14 months of a contract for which he has no phone to use it with. I look forward to hearing from you on this. Regards N.P.
  18. Hi folks, Just a thought. Argos left a Default on my Credit Reference before setting Morecrap onto me. Now, I was wondering. If there is no CCA (so far), then shouldn`t I be able to apply to the Credit Reference Agency`s to remove the Default? If their is no CCA, then I couldn`t have agreed for them to give my details to a third party. If this is so, then who do I contact? I`d appreciate any feedback on this please? Regards N.P.
  19. Hi all, MORECRAP UPDATE I received a letter this morning from them morons at Morecrap. It reads - Dear N.P. RE: Argos Card (Ref: **whatever**) We write further to your recent letter. We can confirm that on this occasion we are unable to provide a copy of the signed Credit Agreement as we are no longer dealing with the above account. We have therefore returned the postal order submitted in that connection. Please forward all future queries and payments direct to our client. Yours sincerely Mrs K Dyde. Now then, I`m quite puzzled as to their wording on this, `as we are no longer dealing on the above account`. Does anyone know exactly what this means? I`m thinking someone else might have taken over or is it just their way of say they give in? I`m all puzzled as to why they haven`t even sent me an application form back, nothing, just this letter.   20. Hi pecky, Nice to hear from you again, thanks for the post. How you doing at your end? Nope, I haven`t heard a sausage, no more letters or calls since my last posts, cool eh? Perhaps if you correspond with them you get letters back, but maybe they just give up if you totaly blank them, I don`t know. Have you had any more calls or letters from anyone? I`m using the money for driving lessons at the moment, heh heh. I just hope I can pass before someone comes up with a CCA. I have a test booked for 8th January, so wish me luck, ha ha.   22. Hi speedtrip, Yes, I actually popped into my local branch and handed over the letters and demanded a receipt. I had a seperate envelope for Lloyds TSB Bank regarding the SAR and a seperate one for Lloyds TSB Collections regarding the CCA. There`s also the £1 deposit on the Credit Card Account which was the CCA fee, morons or what? I`ve been thinking though, although the Account should now be in Dispute, they are still wanting money and still adding charges and interest each month, so the alleged debt is actually going up. Shouldn`t the morons hold ALL action on the account now? I mean, what happens if they turn up with a enforceable CCA? Should I start payments from what the balance was at the time it should of entered a Disputed state? Or, are they allowed to keep piling on the charges and interest? If they add on charges, THEN add interest, then it will be higher than it should and will also make it more difficult to work out. Any thoughts on this? Thanks in advance. Regards N.P
  23. Hi there, I know what you mean about ignoring letter`s. I CCA`d and SAR`d them over a month ago. I received my statements but they have totaly ignored my CCA request, they commit an offence next Wednesday, although they are still asking for money and still adding on interest and still hounding me and still being morons and still ........ I too changed banks so they couldn`t help themselves. I`ll keep watching with interest. Regards N.P.
  24. Hi Rory, Thanks for that, I thought that`s what I should do but I was just checking. I`ve just worked out the days from when I dropped the letters into the bank and it`s been 37+2 working days or 51+2 days (including weekends). The 12+2 and the 30 days would take it to next Wednesday 21st November. Thanks again Regards N.P.
