  1. Hi hopeful1, Thanks for the post. I bet you can`t wait for you holls eh? We haven`t had any more calls today, just the one this morn. One of the halfs whitts must have read it. They`re probably trying to spoil my Christmas, because they haven`t any friends or family to share it with. By the way, the coffee was good, but at £3.30 a mug it want`s to be bloody brilliant.   3. Hi all, Finished work this morning at 11, I was on a 6-2 today, but went in late, at 8, LOL. I now have 19 days off for Christmas. Yippee!! I`d just like to take the opportunity to thank everyone helping me with this thread and wish you all a very Merry Christmas and all the best for the New Year. Right, that`s the nonsense out of the way. We have an UPDATE! CB`s letter was delivered this morning before 9, by Special Delivery. The dame thing cost me £4 odd, but at least it gets there and was signed unlike bog standard Recorded Delivery. Anyway, the knob splats have rang AGAIN this afternoon. Can you beleive these arse wipes? I also included the section from the Telephone Harrassement Letter (did I spell that right? Who cares!) and also a line reading `I WILL NEVER SPEAK TO YOU`, yet the bum holes STILL ring. Unbeleivable or what? I think I spelt that wrong too. Anyway, just thought I`d let you know.     Hi acdc, I agree with the previous few posts about how your attitude will change. You will learn lose that fear factor and start relishing the challenge of these empty heads. I was once a good guy paying his way untill I ran into problems and Argos started war on me via Morecroft. A letter from good old Curlyben (the curliest of all bens) did the trick. Morecrap have bailed out of the fight without a CCA and now Fredrickson International are on the case instead, LOL. An even better letter was launched this morning and is expected to land tomorrow (unsigned and sent Special Dell of course). Right, You have nothing to worry about now acdc, your in the best hands you can find, even better than the Citizen Advice I would say. So, relax and try and get some sound sleep, then you will be ready and waiting to give them a good kicking if they pop up again. Anyway, I`m off to bed now, got to be up at 4.30 for a 6 start, it`s the last day then 19 days off, so I`m not too fussed. Good night all. Regards N.P

  7. Hi there, Thanks for the posts Jonni and Lulu. In response to Jonni`s post, this may be the only option as when he has rang them they clearly say HE has damaged the phone, in his last call they even mentioned water damage. Eh? In response to Lulu`s post, he said he plugged the original charger in and around 6 seconds later he noticed the charger`s plug was starting to glow, so he unplugged it and both the charger and phone were VERY hot he said. He said the phone still worked and his spare battery also works in the phone, only the phone will no longer charge up any of the batteries. He could buy a desktop charged for the batteries but that doesn`t fix the phones charging circuit or port. The charger plug has brown burn marks on it, so it looks like the charger has fried the phones charge port / circuits. Even if it was a dodgy battery, it has still damaged the phone. I think we may have to go with Jonni`s claim, although I`m not sure how much a report would be. Thanks again for the help on this one, I`d appreciate any more advice you can offer us. Regards N.P

    Hi acdc, Welcome to CAG. Your among some great people on here, CurlyBens one of the best on here and he is helping me with a couple of problems, so your by no means alone. So, do exactly as he says and no more. Could you tell use how old the Credit Card is and possibly what Bank or Loan Company it was for? This will give people on here a little more to go on.   13. Hi there, Thanks for the posts advisee and cal37. Those are two very interesting posts, especially the post from cal37. The problem now is this, tomorrow Wednesday) is our last day and we are due back on January 7th. Thursday and Friday of this week are in fact extra days off we have been given with pay, as the company has done so well this year. Now, as I say, we were due back on the Wednesday 2nd but are now due back the following Monday 7th, as we have been told we MUST take the 2, 3 and 4th off, either out of our floating days or out of our pay, paying back one hours pay a week. Or, a mixture of both. So, saying that, everyone has picked an option as we were told we MUST stay off. The company has a Union, which I am not in as it is totaly useless, it seems the Company just does what it wants and the Union simply stalls things. To be honest, I think as tomorrow is our last day and we are due back AFTER the 3 days in question, that it may be too late. However, saying that, if cal37`s post is correct, then we have been lied too and forced to stay off at our expense. Cal37, do you know any legislation to back up your comments, IE if they say they have no work and we are available for work etc? I may feel like challenging their lies at a later date. They have pulled this one on us before. Further to advisee`s post. We have set holidays at Christmas ever year. This year they say we must take an extra 3 days straight after due to a lack of work.   14. Hi again, We can take them out of our floating days if we wished, but why should we if there is insufficient work that week and they want us to stop off?. That was just one way of paying them back. The other as I mentioned was 1 hour a week from our pay untill the full 3 days were paid back, or, the half floating days and half pay back. So, is this whole thing legal? Where, if they can`t find us work and they want us to stay off, they can do this? Shouldn`t they give us time off with pay? Regards N.P
  15. Hi there, Thanks for the post barracad. Basically we have set holidays and floating days. The set holidays are for bank holidays, Christmas, Easter etc. The floating days are whats left out of our annual total to take whenever we want. I also have 1 extra floating day because I have a service day for 5 years service. Because we don`t have much work on the week we were expected back, on the 2nd of January, they want us to take 3 extra holidays off. But, we have to take them at our expense. We can take them without pay. Or, pay back 1 hours pay a week for X amount of weeks, or use one and a half days from our floating days and pay the other one and a half days back by 1 hours pay a week. When I state 1 hours pay a week. I mean they take back 1 hours pay from each weeks wages, as we get paid fortnightly, they will take back £15.04 from our wages as we are on £7.52 an hour. I know this may sound somewhat confusing but I hope it makes sense. I was just wondering if there was any working Act that states if employee`s are forced to take time off, then the company must compensate them. Thanks again. Regards N.P
  16. Hi there, I have a work related question but am unsure which forum to post it in, so I thought I`d try this one. I work in a factory and like everyone we are almost upon our Christmas holidays. The thing is, we were due back at work on Wednesday January 2nd, but due to there not being much work for that week we have been told we have to take an extra 3 holidays, Wednesday, Thursday and Friday and start back at work on Monday 7th January. The problem is, we must pay these 3 days back either by - 1. Paying back 1 hours pay a week. 2. Use 1 and a half days of our floating days from next year and then pay back the other 1 and a half days via 1 hours pay eack week. 3. We can take them off without pay. I was wondering, can they actually force us to do this? I was under the impression that if they wish us to take extra time off they should give us the time off with pay, and not expect us to pay it back or take it off at our expense. Is there some Work or Factories Act regarding this? This dodgy deal affects only the permanent staff such as myself as the temp workers have their own problems. I can`t really think of any other information to add to help you people but if you need to know anything else then please ask. I look forward to hearing from you soon. Regards N.P

What is that about. I do know that they have an obligation to supply the document wether they are the Original Creditor or not, but I wasn`t sure exactly why.   19. Hi there, Thanks for the posts spiritgirl and paul. Yeah, I think I understand what you mean regarding the Default situation. The Lloyds Card also has PPI on which at the moment is around £45 a month. Could I possibly use this is my defence and claim this back, should they show up with something legit? Im not sure what grounds though, maybe miss-sold or say I didn`t tick the box, but then there will probably be a YES and NO box. Any idea`s on how to tackle this one? Agreement Number: Whatever Outstanding Balance: Whatever We refer to your recorded delivery letter regarding the above referenced account. You requested copy documents citing the Consumer Credit Act 1974. We are not the original creditor. We did not provide you with the original credit facility. We purchased your outstanding debt balance and right to collect that balance. We did not purchase your actual agreement, so we have no obligation to provide you with a copy of that Agreement. However as a metter of good practive we have ordered the application form from GE Capital Bank Ltd and ask you to be patient whilst this information is being collated. In the meantime however, unless you are speciifically denying that you have knowledge of this debt, or you are specificially denying that you are liable for this debt, then there is no reason why you should not make proposals for repayment. Please contact us on the above telephone number within 7 days to discuss the options available for repayment of your account. We note your comments regarding visiting your home address and can confirm that we have no intention of instructing home visit agents. Yours faithfully, An empty head at Thames Credit. Now, I suggested we do nothing, let them waste their time trying to find the application form then send them a letter saying what a bunch of scrotums they are and that we didn`t request the application form.   21. Hi folks, Update! Just received a call from an 0845 number, 8.45pm. We ignored the number and I redialled it with 141 in front and guess who it was? Yep, Those fools at Fredrickson. There was just an answering service saying I was placed in a que, so I just hung up. I have no intention of talking to these moron`s. I was just curious as to who rang. Regards N.P
  22. Hi again, Right, time to see if we can get this thing sorted. I have obtained the letter sent to my friend from `3` regarding his damaged phone. It reads - Dr N.P`s mate, Sorry, your handset`s damage isn`t covered by the warranty. Thank you returning your handset, which we forwarded on to the manufacturer`s repair agent. We`re sorry but they`ve informed us that your mobile has suffered physical damage - shown in the picture below. This type of damage is outside the terms and conditions of their warranty, which covers defects in materials and workmanship - if you would like more details please refer to the care instructions conatained in the manufacturer`s user guide and their warranty. How can we help? We`re returning your handset, but would like to help you get up and running with a new `3` mobile as soon as possible. So, here are a couple of options that we hope you`ll find useful: 1. You may be entitled to a free upgrade amy also be able to take advantage of some of our new highly-competitive line rental offers. Just give us a call on 08707 330 333 and select option 1, then 5 and then 2 to speak to our upgrade team. 2. Now, the picture they refer to was a image on the letter with a couple of arrow`s pointing to some very darkened area of the phone`s circuit board. The image is a photo of the inside of a phone, and it could be any image dragged off the Internet as it is totally blurry and very dark. It could be anything, as far as I`m concerned. Next to the image is a little pargagraph reading - Opposite: The physical damage on your mobile. Physical damage is commonly caused by dropping the handset or it being crushed. It does not state what the damage is supposed to be, Now, I have the phone in my possesion and it is what I would say is in mint condition. There are no scratches or denting at all, as you would expect from a phone which had been dropped or crushed. And, as mentioned before, when he called them up they also said it had been dropped in water. The charger, which we beleive was the cause of the problem, shows signs of burning on the plug, which connects to the phone. This charger and also the new charger will not charge up the phone, so we beleive the charger has damaged the phones charge circuit/port. Also, my friend says they returned the phone for a totaly different reason to what he sent it in for. It`s like they are saying anything so they don`t have to replace the phone. Has anyone any idea`s as to how we should proceed with these fools? Could he possibly put in a claim towards them? This may nudge them into replacing his phone. He is still paying for a service he is not using. I would appreciate any help on this matter and look forward to hearing from you soon. Regards N.P

  24. Hi there, Thanks for the post SG59, I guess we are in exactly the same boat. When did you open your Account with Lloyds Card? Mine was opened in 2002. Is is right that if they Default you and take you to Court, you can actually sue them for the Default to the amount of the alleged debt + £1000 if they don`t have a CCA? I`m not sure but I`m sure I read a few threads mentioning that. If that`s true they you could turn the whole game around with that. Let`s hope eh?
