  1. Hi boys and girls, Right, the other half said she forgot to post Curly`s letter this morning, so I have just faxed a copy through to them ding dong`s at Macky Hall. She said she`ll post the letter in the morning (I think she`s scared of these witless wonders). I`ll keep you all posted as events unfold, ha ha. Thanks again for all the posts from everyone.   2. Hi boy and girls, I had another boring standard letter from Lloyds Collections again this morning. It basically says the account is now in arrear`s and has been passed to their Collection Centre (horror of horror`s, anyone but them duck eggs). It goes on to say please make IMMEDIATE CONTACT (like I`m going to drop my tea and call them knob splats). Then there is just more dribble about the charges that I will occur and likely consequences of continued default (like I`m really bothered now). I`m guessing I should just blank this untill they start their dreaded further action, as they are still in default, still putting on more charges and still trying to take money off me every month. Don`t you just wish you were above the law like these amoeba`s think they are? Do you think it`s time to launch one of Curlys letters yet or keep sitting tight?   4. Hi again, Thanks for the posts firstwithit and ODC. Radio Rental, you say, wow! that name is quite old now, but not as old as D.E.R (The people who invite you in to play), remember them? I`ve asked my girlfriend is she has had any dealings with Radio Rentals in the past and she say`s she has never had anything from them either. I`m starting to wonder if her ex-husband (wife beater) has possibly rented something in her name at some time. The letter had on Mrs, but she has been a Miss for a number of years now. I have copied and pasted CB`s letter and also SG`s line regarding the last bill. `I would ask that no further contact be made concerning the above account unless you can provide evidence as to my liability for the debt in question, i.e. the last bill at the address you hold.` Could I add a line that this letter could be seen as a possible phising (even though phising is a computer term) trip and the Police could also be involved due to their attempted fraud by deception? I`m not sure how to word it but it was just a thought. What do you think? Any idea`s? Thanks again people. I look forward to hearing from you again soon. Regards N.P.
  8. Hi people, Back again, this time a letter to my girlfriend from some fools called Mackenzie Hall. She received this during the week and I found it in a draw, she says she was going to tell me about it, but forgot to. Anyway, her ex-husband, who, shall we say was a wife beater, ran up all kinds of debts, some using her name instaed of his own. She insists she has never rented anything from BoxClever in the past and has never even heard of the Company, although her and address are on the letter, but the name starts with `Mrs`. She divorced years ago, and has been using Miss from then. I have been with her for around 7 years now and I`ve never known her buy anything from, or mention BoxClever before. The letter reads : Her Name: Address: Varde Investment (Ireland) Limited V Mrs our lass. Original Creditor: BoxClever TV and Video Rental Agreement Account Reference: Our lass Principal Sum: £300 something. You have been written to on numerous occasions however the debt above remains outstanding. To avoid further action, a monthly repayment plan must be in place within the next 7 days. Therefore, as a gesture of goodwill, our client will accept the account to be paid by monthly installements providing the Standing Order Mandate is completed, signed and returned to Mackenzie Hall within the next 7 days. On receipt of the Mandate being returned, Mackenzie Hall will not take any firther action against you providing you do not default on your payments. Then a Standing Order Mandate form is included. Since we don`t know anything about this and the fact they are offering us a Goodwill Gesture, I think they are just trying it on. Should I CCA these losers or send them a cleverley word from Curly Bens or Rory32`s arsenal? I appreciate and suggestions and look forward to hearing from you. Regards N.P.

I`ve just read on someone else`s thread that they won`t pay up these Charges basically because the OFT say they are ok? Is that true of just some fob-off type waffle? Thanks again, Regards N.P.
  11. Hi again, Just a little update. Right, I`ve just checked my online statement regarding the Credit Card. The next monthly statement is available online now and even though they still haven`t showed up with a CCA (they are now in default) they have still added Unpaid Direct Debit and Late Payment Charges of £12 each. There is also a PPI premium of £45. Should I remind them the account is now is dispute and that they have so far failed to comply with my CCA request, and cancel the PPI? Or, should I just keep waiting untill the start DEMANDING payments? I was thinking along the lines of do nothing untill they start demanding payments and if they come up with a valid CCA then go for Charges and PPI. I would like to see the actual application to see if I ticked the PPI box. Any comments or idea`s on what to do next if anything? I look forward to hearing from you. Regards N.P.

DMD, well done with your RW campaign, I have just had a quick browse through of the latter pages and you`ve become something of a hero on this site. I agree with what you say though, when we stop laughing, then it`s time to give up". My girlfriend laughs at me the way I take the mick out of every stupid letter some numpty sends me.   13. Hi boys and girls, Time for a couple of updates regarding the Lloyds TSB Credit Card. I received the statements on Friday 2nd November. There are some late payment charges and a few overdrawn charges, and also PPI which started out at around £5 a month, now it is around £45 a month. Also, they still tried to take money from the account, even though I have none in now and my wages are going into a different bank. This account has been in default now for a few weeks. I have since cancelled the Direct Debit for the Credit Card from my Lloyds TSB Current Account. As there is an overdraft on the Current Account, I am still paying in £25 a month to cover the overdraft interest. Now this morning I received a letter from Lloyds Card Service which I have typed out below - Dear Mr X. Your account number ****whatever**** We have been notified by your branch that the Direct Debit for your card account has been cancelled on your bank account. Your account may now be settled by either completing the bank giro credit portion of your monthly statement and paying it over the counter at any U.K. bank, or by posting the completed slip with your payment to us. Please allow sufficient time for future payments whether they are made through your bank or by post If you would like to know any more about the services we offer, or if you need further assistance please telephone our Helpdesk on the number at the top of this letter. Please can you ensure you include your full account number on all written correspondence, and always have these details to hand when contacting us by telephone. Yours sincerely, Some idiot called Mike Gislingham Operations Manager Customer Accounts Now considering, I CCA`d these fools a number of weeks ago, and they still haven`t shown up with anything and are still trying to take money from the Account and even paid the £1 CCA fee off the alleged Card debt. I think these ding dongs are trying to wind me up aren`t they? My plan is to do nothing untill the nasty threatograms start demanding money. What do you think? I look forward to hearing from you all.   14. Hi Mick, I thought I`d join in as Morecrap are also on my idiot list. First, never speak to DCA`s on the phone, on anywhere else come to that. Everything must be in writing. If they ring and you accidently answer their call, just scream "only in writing moron`s", then put the phone down, once you start talking to them they will try and talk you into paying up anything you can, so NEVER speak to them. No one can really tell you what to do with your payments in the meantime, you could keep up the payments untill the 12 working days are up, if you can afford it. Personnally, I had my account sent to Morecrap because I was struggling with payments, I`d missed the last few, but after I CCA`d them they never hassled me again, so I haven`t paid anything for a few months now as they haven`t showed up with a CCA. Everything is straight forward once you start. I was quite nervous when I received the first letter from them, but once I sent off the CCA request I immediately felt in control again. Regards N.P.

The scan quality of the CCA`s are not very good, although I`m no expert, so I`m not sure what we should be looking for. Hopefully someone with more experience and knowledge will be along soon.   16. Hi, I`m not sure, but I would have thought that the overdraft would be covered by a CCA as it is basically an on-going loan which you are paying interest on. Sometimes they even up the credit without your permission. Does anyone else have any comments on this? Regards N.P.
  17. Hi madh21, Ooops, I didn`t realise pressing TAB would send the message. Anyway, I`m pretty much in the same boat as you. Lloyds TSB are wanting over £5K from me. I CCA`d them approximately 3 weeks ago and have heard nothing back from them. The morons even tried to withdraw this months payment from my current account yesterday, but I had already emptied and moved my money to my Halifax account. That payment was bounced so they`ll probably whack another charge on. Should they turn up with a valid CCA then I`m going for charges and PPI. I`m also expecting them to ask for full repayment of the overdraft on my current account, which also has charges on. I`ll CCA that too and ask for the account opening form which was originally open with TSB 22 years ago. I`ll watch your thread with interest. Regards N.P.
  18. Hi everyone, I`ve just had a quick read of some of the posts on this thread and they are quite interesting. Just a quick one though, if a Bank, Loan or Credit Card company lends you money without an actual agreement, then surely they is NO agreement to pay it back, in which case you could say they gave you the money, how nice of them. If their application forms and agreements are supposed to be regulated by the CCA 74 or 2006, then they should be exactly that. If they aren`t then there is no debt due to the pretendy Mickey Mouse paperwork. I have a few couple of disputes myself, and quite frankly, I beleive I was bombard with offers of loans and cards etc to a point where I had no choice but to accept them. Then, the next strategy would be to up the credit limit then lash me with high interest and late payment charges in order to trap me in debt and get even more out of me. If people want to dump money in my Bank Account and let me spent it without an agreement to pay it back then cool. Regards N.P.

  20. You could send them another CCA and request the Account Opening Form for the Bank Account, see what they churn up. I beleive you can CCA a Bank Account, but you don`t ask for a Credit Agreement, but a Opening Form. Hope this helps. Regards N.P.
  21. Yes, I sent a £10 Postal Order with the SAR. i went into the bank with two envelopes, one addressed to Lloyds Card Services (SAR) and one to Lloyds Collections (CCA). I used their own internal mailing system instead of the crap Royal Mail which never gets signed for. It`s just they used the £1 CCA request fee, and paid this off the card. The 12+2 working days are actually up on Thursday (11th October), so I was wondering if I should cancel my Direct Debit then or wait a few more days due to the Postal Strike. I`m also going to have my wages paid into my Halifax Account, instead of Lloyds. Also, I`m paying over £45 a month for Payment Protection on the Credit Card, I`m not sure if I ticked the box or not for that, perhaps I should just it all back. The Account also has a number of Charges on, so I can dispute it from a number of angles. I also have an Overdraft on the Current Account, which I`m expecting them to call in. There`s a few Charges on that also, but I`m also going to CCA LLoyds asking for the Account Opening Form. I opened the TSB Account 22 years ago, so that could be interesting. How much longer do you think I should wait before cancelling the Direct Debit for the Lloyds TSB Card? They default on Thursday. Regards N.P.
  22. Hi everyone, Just a thought, as I`m waiting for statements from Lloyds Card also. I sent Lloyds Card and Lloyds Collections a CCA and SAR request regarding the Card Account. So far, I have heard nothing back in a week and a half, yet they have used the £1 CCA request fee to pay towards the Card debt. Cheeky or what? Anyway, even though they think they are still in the right regarding Bank Charges and have put a hold on claims, don`t they still have an obligation under the Data Protection Act to supply ANY requested information, whatever it`s for?   24. Hi there, I was informed in one of my own threads by a CAG member that you can CCA a Bank regarding a overdraft. Instead of asking for a Credit Agreement, I beleive you ask for the Account Opening Form. I`m not sure, but it`s what I was told. He says he`s done it himself and it works. I hope it`s true as I`ll be using this strategy soon. Regards N.P.
