      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

Been looking through your site with interest. Going through my statements now!

 

I'm having some trouble with Tesco Personal Finance (credit card), which is in my husband's name.

 

Tesco have passed hubby's account details to Triton Credit Services, who keep insisting that my husband rings them - I've sent them three letters asking to continue making the regular £30 pm payments (which we have made each and every month, although we may have missed the 'pay-by' date a few times - I have asked them in the past to change this date to no avail). I sent them a sheet of our financial expenditure and they say it's incomplete.

 

Should I be corresponding with them or Tesco? As far as I can see, apart from the interest, no charges have been added.

 

They are threatening to take further action without warning or delay. Any advice on what I should/could be doing? Many thanks. Angie

I suppose that you know that the Tesco Personal Finance credit card is a joint venture card between Tesco plc & The Royal Bank of Scotland and...

Triton Credit Services are The Royal Bank of Scotland's in-house collections. I would say, that at this stage the debt has not been sold on as it is obviously being dealt with by Triton!

 

I would not speak to either Tesco or Triton on the telephone and would suggest that you write to Tesco a letter of COMPLAINT explaning your situation and request that they do NOT telephone you, as you wish to communicate only by letter. Continue to make your monthly payments, but again request a change to your pay-by-date, it would be unreasonable for Tesco to refuse!

 

Don't forget to keep copies of your letters.

 

I do not have any legal expertise and am simply a member of the BAG, just like you.

Therefore, I hope that this information will assist you.

Hello Guys

 

First of all i would like to say thanks to all of you for posting all of your help on these forums, you have helped me become much clearer on my situation.

 

Secondly, i would like to ask for your help! I used a Tesco Credit Card on the last couple of weeks of my travelling trip and had to use it when i returned to buy things i needed for the house etc. The current amount on the card is 1274.56 and i havent been able to pay the monthly repayments for some while as i didnt have a job, after not paying for a couple of months it got to the point where it had added up so i got worried and couldnt pay anything. I now have a job and can afford to start paying a monthly fee of around 30-40 pounds but my details have been passed onto to Triton Credit Services Limited in Basildon (literature through Green and Co solicitiors, Telford) and they informed me i have a week to pay it off. Unfortunately i have no way to pay for this as i am a student and cannot affor to eat most of the time!

 

Like i said above i can afford to pay a monthly amount of between 30-40 pounds and would like to start doing so in order to wipe my slate clean. If it is at all possible then would somebody advise me of the correct action to take (what letters to send, to whom etc etc). This would be massively appreciated.

Hi jonny

 

Start paying the £30-£40 anyway - that always looks good. Write to Triton and tell them that's what you are doing. Also, I would ask them for a copy of the executed agreement for the account under s78(1) of the Consumer Credit Act 1974. Remind them that the statutory period for them to reply is 12 days and send them £1 fee (as a postal order).

 

Note what angry cat says - Triton are just RBS by a different name.

Hi Everyone

 

I'm very confused at the moment because i've just looked on my internet banking and found that i'm paying £100 to Green and Co solicitors for my Tesco bonus credit card which Triton had passed on to them but, i had a phonecall from Triton the other day saying that my agreement had been broken and that i could pay £120 a month for it. I'm paying twice for the same thing and i don't know why, surely Triton and Green & Co communicate. Can anyone help me out on this? It would be much appreciated.

It would be best if you started your own thread so we can keep your stuff seperate and avoid confusion - click on the newthread.gif button at the top or bottom of the forum.

 

Your situation cries out for some sort of clarification. I suggest you write to both and ask them who you should be paying (tell them you have written to the other as you seem to be paying both at the moment). See what that brings up.

can i just ask why the £1 postal order?

im trying to deal with triton on my own at the moment, and i dont know where to turn for help.. luckly tho by trying to fine an actual web site for them i cam accross this site, and after reading different posts, i can see now that its everyone who is getting harrassed by theese people not just me.

but again why the £1 thing? that makes no sence to me :confused:
