      Hello,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

      We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

Just in case they do not acknowledge your claim after 14 dys then you could always write to them and give them another 7 days to do so .

This is always best as the Judge would rather see a case settled out of the Court.

Plus this action would go in your favour as well shows your willing to settle. Anything that looks good on you will show the bank in a bad light.

 

Or you could always File for Judgement by Default if you didnt want to give them another 7 days. This means that you would need to fill out the form on the front of your Notice of Issue ,

This does not automatically mean you win, you could file for this and then the bank could still acknowledge the claim.

Its entirely up to you ,

Take a look around the "Guide To Reclaining Bank Charges" on here there is loads you might pick up on.

 

Whatever you decide to do we are all right behind you .

Hi Deadly.

 

Your not by yourself then , Im not too clever either but dont worry we'll get there.

 

When the bank has had your claim served on them then they have 14 dys to Acknowledge.

 

All it means is that they have so long to say if they have recieved it and they are going to defend your claim

 

Its ok cause even though they say they will Defend they hardly ever do, its very rare.

 

Some leave it to the very last day of the deadline to Acknowledge and some dont but they still have 28 days from first served upon them.

 

As I said before if they dont Acknowledge then itsin your best interest to write to them and give them another 7 days, This lets the Judge see that it is you who is being reasonable and doesnt look too good for them in the long run.

 

It is ultimately your decision though, Go with what feels right for you.

No one can deal with this for you but we can all be here to offer advice and loads of encouragement when you need it .

 

Your doin ok everythin seems to be going smoothly so just stay with your timescale and you should be ok.

 

As for this OFT thing the general feeling (if Im right) is to just carry on as normal . Nobody knows for sure what the outcome will be or what the consequences will mean to all of us on here.

There is a very good common sense thread on here by Bookworm but off hand I cant remember the link but its really good advice and all about peoples veiws regarding the test case.

 

Perhaps someone will come up with the link for you before I do , have a read of it and you should feel more relaxed about it all.

I havent either, Think I know why though.

 

See they know you and I are waiting for our money so their going to make us wait for a while longer and then when we go to check our account some day in the niot too distant future , HEY PRESTO there it will be

Then we will get a letter from them saying they are sorry they made us wait for so long and cause we've been so patient they are giving us a little bonus to make up for it!

Its this waitin thats the worse isnt it. Dont know what to do with myself, Ive a feelin I should be doing something , BUT WHAT.

I think they forgot about my claim as if you read my thread youll see Ive had another letter off them.

Glad to hear the wedding went without a hitch. You must have been so proud of her.

 

Hope the break in Blackpool does you good , as you say the weather doesnt really matter to kids I dont think as long as they are kept busy they dont seem to mind.

So glad you enjoyed your hols. I bet you had a blindin time with Stone and his better half. Did you all go on the fair , did you venture on that BIG ONE thingy.

Id be scared stiff, I hate heights, get vertigo just standin on a kerb. LOL

Ive not seen the lights since my kids were little, I bet they were spectacular. Looking forward to going on mine soon , cant come quick enough.

 

Well it seems your at the same stage as me then now. Hope yours goes quicker than mine is doing. Seem to be waiting forever, if you think about it my Judgement has been in originally since the 24th July but with the mix up in the form I filled in its put it back.

What form did you fill in for the Judgement, did you use the one on the front of the Notice of Issue, hope its the right one for you .

Poor you, I think its awful the way they mess ppl about, How can they tell you to put Judgement in on 15th and tell you its too late for bank to file on the 4th Sept and then tell you today that the claim WAS Acknowledged on the 7th. Thats shameful. Its like giving you a piece of cake then taking it back to crumble up in front of you.:evil:

 

Even if the Courts are running behind schedule surely they should have told you before now that they had Acknowledged , I mean , come on thats a month ago, to my mind they cant justify that. Its awful.

 

Its back to waiting then now is it? Although just because they have Acknowledged the claim it doesnt have to follow that they will put in a Defence, My claim was Acknowledged but still not Defended and their time was up on the 24th July, And as you know Im still waitin for somethin to happen.:?

 

Never mind try to keep your spirit up and you know we are all routing for you , lets hope you get resolution sooner rather than later.

Hi DK

 

As far as I know they still have to file defence on time and then if they dont you have to apply for Judgement by Default .

 

Youll find the bit you need to fill in on the lower half of your Notice of Issue . Unless its a specified amount then you need a N205A form you get this from Court.

 

I had the same letter from them a while back saying that if I filed at court then they would ask for stay pending the test case.

I had to laugh coause when I got mine I had already applied for Judgement. Left hand and right hand springs to mind.:rolleyes:

I guess they are that bogged down with claims that they really dont know what they are doing half the time. LOL

Glad to hear your ok, doing college course eh, good for you .

 

Still sittin on thumbs then well at least they havent filed defence so thats somethin.

 

I dont know why they try to put the frighteners on us by saying they are going to stay claim when we all know its up to the Judge. Seems so futile on their part.

Keeping my fingers crossed for you to hear something soon. I will be watchin with interest.

I hope you get some news soon , any news just so you know that your claim is still being dealt with and not gathering dust somewhere. LOL

 

Ive checked my bank again today but still no money in it.:( .

I suppose I should send them a copy of my Judgement along with the letter demanding that they pay up, or go for a W o Ex. Dont know what to do yet giving them till Monday then Ill do it I think.

 

Good Luck and keep flexing those thumbs, all that twiddling cant be good for them. LOL:D

I think your right they really cant check which claims they are dealing with if they are sending out duplicate letters.

No news again then . One consolation there then and that is that cases in before 12th wont get stayed. Hold onto that thought.

 

I know its a right royal pain haveing to wait all this time but ,"Everything comes to he who waits" or so the saying goes. Lets hope in your case its 100% true. You deserve to have the title changed on this thread by now.

Just came to see if youve any good news yet.

Thought that with you not being around much yesterday that youd maybe had some great news and were left speechless. LOL:D

 

I just wish that one of us could get that Win sign on top of our threads.

 

All this waitin isnt good for my health, (fit as a flea really);-)

 

As you can probably guess Ive had no news either.:(
