Abbey settled in full for my case (funds received 14th June), i have since wrote them a letter demanding full refund of wasted costs. I have not had a reply for them yet, and i have not let the court know abbey have settled yet.

 

My court date is the 28th June, but i am definately unavailable to attend on that date now. If i submit a wasted costs order to the court, will they make me attend on the 28th still?

So Inga has started to reply to me with the following:

 

We refer to your email below. We note that you have accepted our payment in full and final settlement of your claim. This does not entitle you to now raise a further claim for costs. The claim, as agreed, having been settled in full.

Should you proceed with your proposed costs order we shall be bringing your email below and this response to the attention of the Court.

We trust in any event such action is not necessary.

In which i replied:

Thanks for replying. If you read my letter and email, i have stated the following:

 

I can confirm that, subject to costs, I am willing to accept your offer in full and final settlement of this claim, and will contact the court to discontinue proceedings upon receipt of these costs. I have calculated my total costs to date to be £320.48, as detailed at the end of this letter.

Therefore untill you award me costs, then i have not accepted the payment as full and final settlement

 

I shall attend court on thursday to claim my costs, which in turn will rise as i have to take leave from work.

I hope this clarifys my postion.

 

 

She has now replied with:

 

"Without prejudice"

Dear x,

I am not prepared to pay additional costs in addition to the £220.00 already provided to you. The Court bundle is in one and the same form as that precedent provided on various websites. It can not therefore be the case that you have spent 30 hours printing off what is largely pre-existing material. Printer ink and postal costs are likewise not recoverable. Should you wish to reconsider your position, I am happy to continue discussions with you.

Just wondering what happened???

 

I've received exactly the same response from Inga regarding my claim for wasted costs of £333.75.

 

Any help/advice would be appreciated.
