      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Smashedbobo, what is this about the car?:o How much were they wanting him to pay? And does the old man's other half know about it? Can't it be got rid of?

 

Start another thread on that if necessary, cos this is for success stories and that is a partial one I suppose. (Its alright, i know smashedbobo...you just have to keep her in line!!! (joke SM)

Well I'm doing quite well.

So far I've had 6 DCA's give up on me, either by passing it back to the original creditor or just stopped contacting me.

Ok in that number are 2 that have simply passd the debt to another of their trading names, but I think it still counts.

I always ignore their first letter just to make sure they have enough information and it's not just a fishing excercise.

After that I put the debt to the test, so it's CCA time.

If I'm in a really evil mood, especially where charges exceed the debt, then I call them and have some fun. Of course this ISN'T on their 0870 number, but more normally on a freephone one.

Thank gid for SAYNOTO0870.COM - Non-Geographical Alternative Telephone Numbers, sometimes takes a bit of work, but it's well worth it in the end.

 

There is no point hiding from these people and I'm so glad I have found this site as it has helped me get my life sorted and I'm now working my way through some serious debts that are very nvolved indeed.

 

If you have debts it is better to face up to them and get them resolved one way or another, even if it means paying some nasty DCA.

 

It's hard though facing up to the inevitable isn't it? I can be a bit of an ostrich, although i know i have to sort out my finances. I'm lucky that I have a good job, but the stress is still bad and the WHAT IF's do my head in. Well done you though.!!!!!!;)

Oh i think people are bothered. The problem is that with DCAs is that they are soooooooo long winded. But what goes around comes around. Read some of diskmandaves other threads. I think it just going to take time for folk to put up the thucktheth thtories up. Me got a lithp. I dont think tho

I know, it's a bit quiet on that front.

 

I'm geting better at this now, when i first started this thread i did it under a different name cos I forgot my username - GO FIGURE!!! So cazza1968 is no more cos I was originally and still remain lemma1968 - yet another blond moment came upon me. The fact that i spotted it...eventually, is a success I suppose!!:grin:

 

On another note, MBNA sent me someone else's application in response to my CCA request! I call that a success. I sent them the stroppiest of letters in response. I await their response, it gets exciting when things like that happen ( i know, i need to get a life!!!!!!:p )

I think the point of my thread is being misinterpreted!:-|

 

How many people have had had DCA's back off completely and accept defeat because they cannot fulfil THEIR legal obligations?

 

Or have accepted reasonable offers of F&F?

 

I ask this cos I think it assists those in motivating themselves when they feel as if the world on their shoulders and want to give up cos of the stress and fear.

 

Deliberate debt avoidance or actions that may wind up a District Judge and then get you into trouble is not what I was trying to encourage!
