In fact it's better because if big motoring world realise that you are getting advice and that you are coming for them, it will make them more likely to pay attention. There is no point in secrecy in these kinds of things. Let's see the video so we can understand what's happening
    • Hi i have the video footage now downloaded on my computer. However, the video has some personal information such as the reg. I have tried editing out the plate but struggling.
    • Well I certainly wouldn't worry about the registration number. It will actually be a good idea to have it on display for people who end up being offered it in the future once you have managed to return it. What other personal details are there? And anyway, you should have a copy for yourself anyway. You should be doing this kind of thing. You should be recording all telephone calls and confirming telephone calls in writing. You should record all conversations that you have with them in person. You should have a call recorder on your telephone and should keep that in your pocket. This is not the time to start getting slack and casual. I think you've already paid the price for this. You must now start getting your act together, getting evidence. Making sure that you have copies. Stop relying on other people to either tell you the truth – or to hold copies of things for you which might then be difficult to get from them if they feel that they are being compromised. Why can't you even access the video and record it onto your own computer?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have sent letters claimed on line Corbetts have sent form that they intend to defend I received a letter Saturday with an offer of £152.00

on a claim for nearly £400 I intend to refuse the offer but I cannot find the letters of refusal. I thought I had copied and posted the to my e-mail address ( as I was looking through the threads at work naughty naughty) but now I cannot find the threads.

 

Please help going square eyed looking

I have today received my money from the Natwest bank via

The Royal Bank of Scotland Litigation department. The strange

thing is I received a letter from Mr H offering me £152.00 which I was

going to write back and reject (of course) but today I received a cheque for

my full claim plus court costs and interest £420.93 in total with a letter more

or less stating is was not worth them defending my claim (I had also received

a note from the court that the solicitors were going to defend).

The only slight problem I have with this cheque is after my name it gives the

bank account no. but this is not the account no. the claim was against but I do want to

make a claim against this account as I have just received my statements for

the last six years – should I write to them thank them for the cheque but let them

know they have to wrong account, or should I leave it, as there is no form to sign

to say I agree this as a full and final settlement.?

Once the cheque has cleared I will make my donation although I haven’t posted

much I read the threads carefully and all the advise, taken it on board and at my

lowest the positive vibes from everybody kept me going. In my very humble opinion

I think you are all wonderful and for anybody still waiting for their money

keep the faith because you will get it.

On my cheque i crossed out the account no and payed it into a different bank altogether............

 

So bank it ................

 

then reclaim!!!!!!!!

 

the account no on the cheque will make no difference to any claim...

 

make sure you do not agree to any of there conditions

Thank you Scott you have been a great help.:D

 

I will bank the cheque and not bother to write I know its only a small

amount compared to some but I do feel a moral victory over the big

bad bank.
